In accordance with NRS 338.1382, contractors must be qualified and eligible to bid on contracts for
public works projects by the State of Nevada Public Works Board (SPWB) in the cost category of
their bid amount at the time of bid opening. To verify your status on the SPWB Qualified Bidders List
or to download applications and information to become a Qualified Bidder, visit the Nevada SPWB
website at http://spwb.state.nv.us. Applications for Bidder Qualification must be sent directly to the

1. PROJECT SCOPE OF WORK
Furnish labor, materials, and equipment to replace selected existing chilled water coils, control valves,
and associate appurtenances for air handles AHU-6 AND AHU-7. To include include removal and re-
installation of ceilings and associated infrastructure as required.
2. PROJECT LOCATION
Rainbow Library, 3150 N. Buffalo Dr. Las Vegas, NV 89128
3. DESIGNATED CONTACT
The designated contact for questions or submission of notices pertaining to the Invitation to Bid is John Vino, General

4. CONTACT WITH OWNER DURING BIDDING PROCESS
Communication between a Bidder and a member of the Board of Trustees or a non-designated Owner contact, regarding
this Bid is prohibited from the time Bid is advertised until the time it is posted on an agenda for contract award.
Questions pertaining to this Invitation Bid shall be directed to the designated contact specified above. Failure of a Bidder,
or any of its representatives, to comply with this paragraph may result in its Bid being rejected by the Board of Trustees.
5. DEFINITIONS
A.
Addendum: A written document issued by the Owner, via the General Services Department, prior to the
submission of bids which modifies or clarifies the Bidding Documents by additions, deletions, clarifications, and/or
corrections.
B.
Additive Alternate Bid Item: An amount stated in the Bid to be added to the amount of the Base Bid if the
corresponding change in work, as described in the Bid Documents, is accepted by Owner. Additive Alternate
Items may be exercised by the Owner with the award of the project in sequential order only subject to the
availability of funds. Bidder must quote all items to be responsive and considered for award.
C.
Allowance: An amount stated in the Bid to be included in the Base Bid for items which have not been selected
and specified in the bidding documents.
D.
Apprenticeship Utilization Plan: A plan prepared by the Contractor and submitted to the Owner. Plan shall list
one or more apprentices to be used/reported for at least 10 percent (vertical construction) and 3 percent
(horizontal construction) of the total hours worked for each apprenticed craft or type of work to be performed on
the public work when more than three employees of a craft are employed for the work.
E.
Architect: Owner’s representative or other person designated by the Governing Body, acting directly or through
their duly authorized representative.
F.
Authorized Representative: A person designated by the Governing Body to be responsible for the development
and award of the Contract for the public work.
G.
Bidder: A Prime Contractor who submits a bid to the Owner for a project.
H.
Bid Form: Owner provided form bidder must submit
I.
Bid Documents: Includes, but not limited to, Invitation to Bid, Instructions to Bidders, General Conditions,
Special Conditions, Contract Requirements and Forms, Bid Forms/Attachments, Exhibits,
Specifications/Special Provisions and Drawings, and any Addenda issued prior to the date designated for
receipt of Bids, as applicable.
J.
Consulting Architect/Engineer: A licensed and registered professional contracted by the Owner to design the
project's special provisions and drawings.
K.
Consulting Construction Manager: The Construction Management firm contracted by the Owner to manage
the construction of the project.
L.
Contract: The entire agreement between the parties, as set forth in the Contract Documents, does not come into
existence until execution of the Agreement for Construction Services by the Owner.
M.
Contract Documents: Include the Bid Documents, Contractor’s Bid Form, all Addenda, Contractor’s Bonds
and Insurance, Notice of Award, Notice to Proceed, and applicable Prevailing Wage Rates.

N.
Contract Amount: The amount for which the Bidder has offered to complete the Work and is equal to the
amount of the Base Bid and, if applicable, each Additive Alternate bid exercised by the Owner to be included
as a part of the Project.
O.
Contractor: The person or entity identified as such in the Contract and referred to throughout the Contract
documents as Contractor or Successful Bidder. Contractor shall mean the Prime Contractor or its authorized
representative as defined by NRS 616A.285.
P.
Engineer: Owner’s representative or other person designated by the Governing Body, acting directly or
through their duly authorized representative.
Q.
Governing Body: Used throughout these documents will mean the Las Vegas-Clark County Library District
Board of Trustees.
R.
“NGEM System” refers to Owner’s electronic bidding system, the Nevada Governmental eMarketplace. This is a
web-based system that provides Bid Documents electronically to potential Proposers and forms the pathway
for interested Proposers to submit Proposals electronically in response to advertisement and ITB. The term
“electronic proposal” means the Proposers’ electronic response submitted on the electronic proposal to the Owner
by way of the NGEM System. The term “electronic proposal” also describes the process to submit an authorized
proposal electronically to Owner in response to an ITB via the NGEM System.
S.
Notice of Intent to Award: Letter issued by Owner notifying the Successful Bidder to proceed with procurement of
bonds and insurance.
T.
NRS: Nevada Revised Statute: The current codified laws of the State of Nevada. Nevada law consists of the
Constitution of Nevada (the state constitution) and Nevada Revised Statutes. The Nevada Supreme Court
interprets the law and constitution of Nevada.
U.
Owner: The term used throughout these documents will mean Las Vegas-Clark County Library District, Las
Vegas, Nevada.
V.
Plan Holders: Prospective Bidder(s) who have picked up/purchased the specifications and drawings for a
project.
W.
Solicitation Documents: May include, but are not limited to - Invitation to Bid, General Provisions, General
Conditions, Special Conditions, Product Specifications, Exhibits ,Special Provisions, Drawings, and any
Addenda issued prior to the date designated for receipt of Responses, as applicable.
X.
Subcontractor/Independent Contractor: Any individual, agent, firm, sole proprietor, or corporation to whom the
Prime Contractor subcontracts any part of the project. There is no contractual relationship between the Owner and
the above-mentioned Subcontractor who perform work or services for the Prime Contractor
Y.
Successful Bidder: Bidder who is the lowest responsive, responsible and/or best bidder, to whom the Governing
Body or the authorized representative has authorized the award of the contract.
6. REGISTRATION FOR NGEM SYSTEM
a)
The NGEM System is accessible at www.ngemnv.com. Bid documents can be viewed by selecting a specific
project from the Current Bid Opportunities list and clicking on that project after completing the Supplier
Registration.
b)
Potential Bidders MUST register as a “Supplier” by clicking on the Supplier Registration link and completing the
registration form. There is no cost to register or to use the NGEM System.
c)
Once registered, “suppliers” will receive emails notifying of bid opportunities. Downloading any project bid data
will automatically place the bidder’s contact information on the bidders list and the NGEM System will
automatically send any and all updates, changes or addenda associated with that project.
d)
An electronic bid proposal can only be submitted through the NGEM System. The Bid Documents can be printed
for Bidder’s use, but an electronic bid MUST be submitted through the NGEM System.
e)
