Scopul acestei proceduri de atribuire este achizitionarea unui Sistem de optica adaptiva pentru fasciculul laser de 1 PW ce va fi folosit pentru corectii ale aberatiilor frontului de unda induse de transportul laserului cu ajutorul opticii in reflexie de la iesirea din compresoarele temporale ale Sistemului Laser de mare Putere (HPLS) si pana la camera de interactie.

III.1) Conditions relating to the contract
III.1.1) Deposits and guarantees required:
Cuantumul garantiei de participare este de: 2 300 EUR.

Garantia de participare poate fi constituita si in RON sau alta valuta, cursul de referinta calculat pentru plata acesteia fiind cel stabilit de Banca Nationala a Romaniei (BNR) ( www.bnr.ro ). Data de referinta calculata pentru constituirea garantiei de participare in valuta va fi: cu 5 zile inainte de termenul limita de depunere a ofertelor. Modul de constituire a garantiei de participare:

1. Prin virament bancar in contul RO92BPOS70903296299ROL0B, respectiv RO94BPOS70903296299EUR01 deschis la Banc Post ? Ag. Magurele.
2. Printr-un instrument de garantare emis in conditiile legii de catre o societate bancara sau de catre o societate de asigurari, conform modelului prezentat in Formularul 7 din Sectiunea Formulare.
Perioada de valabilitate a garantiei: 120 de zile de la termenul limita pentru depunerea ofertelor. Garantia trebuie sa fie irevocabila.Instrumentul de garantare trebuie sa prevada ca plata garantiei de participare se va executa neconditionat, respectiv la prima cerere a beneficiarului, pe baza declaratiei acestuia cu privire la culpa persoanei garantate.In cazul depunerii de oferte in asociere, garantia de participare trebuie constituita in numele asocierii si sa mentioneze ca acopera in mod solidar toti membrii grupului de operatori economici.
Documentul de constituire a garantiei de participare va fi scanat si atasat in SEAP astfel incat sa fie lizibil, numai in format PDF sau JPG, pana la data si ora-limita de depunere a ofertelor. Cuantumul garantiei de buna executie: 10 % din valoarea contractului de achizitie publica, exclusiv TVA.
Modul de constituire a garantiei de buna executie, in conformitate cu prevederile art. 40 din HG nr. 395/2016: prin virament bancar sau printr-un instrument de garantare emis in conditiile legii de o societate bancara sau de o societate de asigurari, sau daca partile convin, garantia de buna executie se poate constitui si prin retineri succesive din sumele datorate pentru facturi partiale.

III.2.1) Personal situation of economic operators, including requirements relating to enrolment on professional or trade registers
Information and formalities necessary for evaluating if the requirements are met: Ofertantii, tertii sustinatori si subcontractantii nu trebuie sa se regaseasca in situatiile prevazute la art. 58-60 din Legea nr. 98/2016. Modalitatea prin care poate fi demonstrata indeplinirea cerintei: se va completa DUAE de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei lor.
Ofertantii, tertii sustinatori si subcontractantii nu trebuie sa se regaseasca in situatiile prevazute la art.164, art.165, art.167 din Legea nr.9 8/2016.Persoanele cu functie de decizie din cadrul autoritatii contractante sunt: Nicolae Victor Zamfir; Mitica Dragusin; Constantin Ivan; Alexandru Popescu.
Modalitatea de indeplinire a cerintei: se va completa DUAE de catre operatorii economici participanti la procedura de atribuire (ofertant/ ofertant asociat/ subcontractant) cu informatiile aferente situatiei lor.
Documentele justificative care probeaza indeplinirea celor asumate prin completarea DUAE urmeaza a fi prezentate, la solicitarea autorita?ii contractante, doar de catre ofertantul clasat pe locul I in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor.
Aceste documente pot fi:
1. certificate constatatoare din care sa reiasa lipsa datoriilor restante cu privire la plata impozitelor, taxelor sau a contributiilor la bugetul general consolidat (buget local, buget de stat etc.) la momentul prezentarii;
2. cazierul judiciar al operatorului economic si al membrilor organului de administrare, de conducere sau de supraveghere al respectivului operator economic, sau a celor ce au putere de reprezentare, de decizie sau de control in cadrul acestuia, asa cum rezulta din certificatul constatator emis de ONRC / actul constitutiv;
3. dupa caz, documente prin care se demonstreaza faptul ca operatorul economic poate beneficia de derogarile prevazute la art. 166 alin. (2), art. 167 alin. (2), art. 171 din Legea 98/2016 privind achizi?iile publice;
4. alte documente edificatoare, dupa caz. Operatorii economici care depun oferta trebuie sa dovedeasca o forma de inregistrare in conditiile legii din tara de rezidenta, din care sa reiasa ca operatorul economic este legal constituit, ca nu se afla in niciuna dintre situatiile de anulare a constituirii precum si faptul ca are capacitatea profesionala de a realiza activitatile care fac obiectul contractului.
Modalitatea de indeplinire a cerintei: se va completa DUAE de catre operatorii economici participanti la procedura de atribuire (ofertant/ ofertant asociat/ subcontractant) cu informatiile aferente situatiei lor.
Documentele justificative care probeaza indeplinirea celor asumate prin completarea DUAE urmeaza a fi prezentate, la solicitarea autoritatii contractante, doar de catre ofertantul clasat pe locul I in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor.

VI.3) Additional information
Operatorii economici participanti in comun, a caror oferta a fost desemnata castigatoare, sunt obligati ca la semnarea contractului sa prezinte in forma autentica documentul/documentele care a(u) stat la baza participarii in comun la procedura de atribuire.

Pentru transmiterea solicitarilor de clarificari privind documentatia de atribuire, operatorii economici se vor inregistra in SEAP ( www.e-licitatie.ro ) ca operator economic conform prevederilor art. 5 alin.(1) din HG nr. 395/2016 si vor transmite solicitarile avand in vedere termenele de raspuns ale autoritatii contractante prevazute la art. 160-161 din Legea nr. 98/2016.

Se va avea in vedere incarcarea tuturor documentelor aferente documentatiei transmise, semnate cu semnatura electronica extinsa, bazata pe un certificat calificat, eliberat de un furnizor de servicii de certificare acreditat;
Analiza documentelor prezentate de ofertanti de catre comisia de evaluare nu angajeaza din partea acesteia nici o raspundere sau obligatie fata de acceptarea ca fiind autentice sau legale si nu inlatura raspunderea exclusiva a ofertantului sub acest aspect.
Preturi egale: In situatia in care exista 2 sau mai multe oferte cu preturi egale clasate pe primul loc, autoritatea contractanta va solicita clarificari prin intermediul SEAP, in vederea incarcarii electronice de catre operatorii economici de documente care contin noi preturi. Se vor respinge ofertele care au fost depuse la o alta adresa decat in SEAP.
