Section III: Legal, economic, financial and technical information

III.1) Conditions relating to the contract
III.1.1) Deposits and guarantees required:
Ofertantul are obligatia de a constitui garantia de participare conform art. 36 alin. (1) si (6) din HG nr. 395/2016 in cuantum de: 1 470 RON pt. Lot 1; 3 900 RON pt. Lot 2; 924 RON pt. Lot 3; 672 RON pt. Lot 4
Perioada de valabitate a garantiei de participare trebuie sa acopere perioada de val. a ofertei, respectiv: 90 de zile de la data limita de depunere a ofertelor. Instrument de garantare: se poate utiliza Formular 1.
Pentru garantia de participare prin virament: RO33TREZ7035005XXX000063 deschis la Trezoreria Sector 3, cod fiscal 4192952, cu conditia confirmarii acestuia de catre banca emitenta, in favoarea autoritatii contractante.
Echivalenta pentru o garantie pentru participare constituita in alta valuta se va face la cursul BNR din data anterioara datei limita de depunere a ofertei cu 5 zile. Cuantumul instrumentului de garantare de buna executie este de 10 % din valoarea contractului, fara TVA valabila pe toata perioada de valabilitate a contractului.
Modul de constituire a garantiei de buna executie: in conformitate cu prevederile art. 40 din HG 395/2016, in termen de 5 zile de la data semnarii acestuia;

III.2.1) Personal situation of economic operators, including requirements relating to enrolment on professional or trade registers
Information and formalities necessary for evaluating if the requirements are met: 1. Ofertantii, tertii sustinatori si subcontractantii nu trebuie sa se regaseasca in situatiile prevazute la art.164,165, 167 din Legea nr. 98/2016.
Modalitatea prin care poate fi demonstrata indeplinirea cerintei: se va completa DUAE de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei lor. Documentele justificative care probeaza indeplinirea celor asumate prin completarea DUAE urmeaza a fi prezentate, la solicitarea autoritatii contractante, doar de catre ofertantul clasat pe locul I in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor. Aceste documente pot fi:
1. certificate privind lipsa datoriilor restante cu privire la plata impozitelor, taxelor sau a contributiilor la bugetul general consolidat (buget local, buget de stat etc.) la momentul prezentarii;
2. declaratie privind neincadrarea in situatiile potential generatoare de conflict de interese, asa cum sunt acestea definite la art. 60 din Legea 98/2016, conform prevederilor sectiunii IV din acelasi act normativ;
3. se solicita cazierul judiciar al operatorului economic si al membrilor organului de administrare, de conducere sau de supraveghere al respectivului operator economic, sau a celor ce au putere de reprezentare, de decizie sau de control in cadrul acestuia, asa cum rezulta din certificatul constatator emis de ONRC / actul constitutiv; dupa caz, documente prin care se demonstreaza faptul ca operatorul economic poate beneficia de derogarile prevazute la art. 166 alin. (2), art. 167 alin. (2), art. 171 din Legea 98/2016 privind achizitiile publice; alte documente edificatoare, dupa caz.
? Persoanele cu functie de decizie din cadrul autoritatii contractante implicate in procedura de achizitie publica sunt: Oberlander-Tarnoveanu Ernest, avand functia de manager; Moisescu Cristina, avand functia de contabil sef; Alina Dobre ? avand functia de economist; Adrian Rista avand functia de avocat; Alexandru -Mihail Badescu ? in calitate de presedinte comisie de evaluare; Cristina Olteanu in calitate de membru in comisia de evaluare; Ionut Dragoiescu in calitate de membru in comisia de evaluare; Gabriela Dragomir in calitate de membru de rezerva in comisia de evaluare; Ionel Ene in calitate de membru de rezerva in comisia de evaluare.
Operatorii economici ce depun oferta trebuie sa dovedeasca o forma de inregistrare in conditiile legii din tara de rezidenta, sa reiasa ca operatorul economic este legal constituit, ca nu se afla in niciuna dintre situatiile de anulare a constituirii precum si faptul ca are capacitatea profesionala de a realiza activitatile care fac obiectul contractului.
Modalitatea prin care poate fi demonstrata indeplinirea cerintei: se va completa DUAE de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatei lor. Documentele justificative care probeaza indeplinirea celor asumate prin completarea DUAE, respectiv certificat constatator emis de ONRC, sau in cazul ofertantilor straini, documente echivalente emise in tara de rezidenta, urmeaza sa fie prezentate, la solicitarea autoritatii contractante, doar de catre ofertantul clasat pe locul I in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor.
Pentru persoane juridice/fizice straine documentele care dovedesc o forma de inregistrare / atestare vor fi prezentate in traducere in limba romana.
