1. L'accord-cadre prend effet a compter de sa notification. Il est conclu pour une duree d'un an et reconductible tacitement 3 fois pour un an, sans que sa duree ne puisse exceder 4 ans.

2. L'accord-cadre est execute au moyen de bons de commande en application des articles 78 et 80 du decret n o 2016-360 relatif aux marches publics (DRMP).

L'accord-cadre est mono-attributaire, sans montant minimum ni montant maximum. Les prestations seront reglees par l'application de prix unitaires aux quantites reellement executees.

3. Les prestations font l'objet de paiements partiels definitifs apres constatation du service fait dans les conditions prevues a l'article 115 du DRMP. Le paiement s'effectuera suivant les regles de la comptabilite publique selon la reglementation en vigueur. Le delai global de paiement est de 30 jours. L'ordonnateur est le representant legal du pouvoir adjudicateur. Le comptable public est le Tresorier des EPL. Sauf renoncement du titulaire porte a l'acte d'engagement, une avance sera versee dans les conditions prevues aux articles 110 et 111 du DRMP, sur la base d'un taux de 5 %. L'avance ne pourra etre versee qu'apres constitution de la garantie a premiere demande prevue a l'article 112 du DRMP precite. Cette garantie a premiere demande ne pourra pas etre remplacee par une caution personnelle et solidaire. Le financement des prestations est assure par le budget propre du SIPPEREC.

4. Le Dossier de Consultation des Entreprises (DCE) est dematerialise (retrait via le site internet http://www.sipperec.fr-rubrique : appel d'offres et consultations ou via le site http://www.maximilien.fr ). En cas de difficulte quant au telechargement du DCE, le candidat est invite a se rapprocher du support technique au 01 76 64 74 08. Les modalites de retrait figurent a l'article 4.2 du reglement de la consultation.

5. Modalites de transmission des candidatures et des offres: conformement aux dispositions de l'article 40 II 2 du DRMP, les candidats doivent transmettre leur offre uniquement par voie electronique. Les candidats peuvent repondre en utilisant le dispositif MPS disponible sur la plateforme Maximilien. Les modalites figurent a l'article 5 du reglement de la consultation. En cas de remise des plis hors dispositif MPS, les candidats doivent transmettre leur offre par voie electronique. Les modalites de depot des offres hors dispositif MPS sont indiquees aux annexes 1 a 3 du reglement de la consultation. Si le candidat adresse plusieurs offres differentes, seule la derniere offre recue sera examinee. L'heure et la date limite de reception des plis ne peuvent faire l'objet d'aucune exception quelle qu'elle soit.
