Tutte le comunicazioni e gli scambi di informazioni devono avvenire tramite piattaforma Sintel.

Le norme di partecipazione alla gara, il capitolato d'oneri e gli esiti, i chiarimenti sono pubblicati sul sito www.sanita.padova.it alla voce <<Bandi e avvisi di gara>> e sono ottenibili al medesimo indirizzo di cui al punto I.3).

La Stazione Appaltante si riserva la facolta insindacabile, anche con riferimento al singolo lotto, di:

a) sospendere, annullare, revocare, reindire e modificare, oppure di riaprire i termini della presente procedura con provvedimento motivato, senza che le imprese possano vantare diritti o pretese di sorta od incorrere in responsabilita e/o richiesta danni, indennita o compensi da parte del concorrente e/o aggiudicatario potenziale nemmeno ai sensi degli artt. 1337 e 1338 C.C.;

b) annullare/revocare la procedura di affidamento, senza che per questo il partecipante/offerente possa avanzare qualsiasi pretesa di compenso/indennizzo per spese sostenute nel caso intervenisse la stipulazione di una procedura di affidamento centralizzata a livello regionale o Consip nel caso intervenissero i prezzi pubblicati dall'Osservatorio dell'Autorita di Vigilanza dei prodotti oggetto di gara;

c) non procedere all'aggiudicazione nel caso nessuna offerta risulti conveniente o idonea in relazione all'oggetto contrattuale, e/o per ragioni di pubblico interesse, ai sensi dell'art. 95 del D.Lgs. 50/2016;

d) di non aggiudicare la presente procedura nell'ipotesi in cui, all'esito della valutazione tecnica, permanga una sola offerta valida, fatta salva l'ipotesi in cui la stessa risulti oggettivamente infungibile e/o esclusiva, o particolarmente vantaggiosa

Ai sensi del comma 35 dell'art. 34 della legge 221/2012 le spese per la pubblicazione sui quotidiani dell'estratto del bando di gara come prevista dal D.Lgs. 50/2016, saranno a carico delle imprese aggiudicatarie.

La stazione appaltante, in caso di incompletezza della documentazione richiesta, potra assegnare al concorrente un termine, non superiore a 10 giorni, perche siano integrate o regolarizzate le dichiarazioni necessarie, indicandone il contenuto e i soggetti che le devono rendere, pena l'esclusione dalla gara.

Il contratto non conterra la clausola compromissoria.
