Temeljem ?lanka 257. stavaka 1. i 266. Zakona o javnoj nabavi gospodarski subjekt obvezan je dokazati:

1. upis u sudski, obrtni, strukovni ili drugi odgovaraju?i registar u dr?avi njegova poslovnog nastana, a dokazuje se izvatkom iz sudskog, obrtnog, strukovnog ili drugog odgovaraju?eg registra koji se vodi u dr?avi ?lanici njegova poslovnog nastana.

Nastanak ugovora o javnoj nabavi uvjetovan je suglasno??u Ministarstva zdravstva kao mjerodavnog tijela te nastaje u trenutku pribavljanja njegove suglasnosti, a sve sukladno ?lanku 307. stavak 4. Zakona.

Temeljem ovog postupka javne nabave, a nakon ?to Odluka o odabiru postane izvr?na, sklopit ?e se Ugovor o javnoj nabavi robe.

5.8. Ostali bitni uvjeti za nabavu

5.8.1. Uvjeti i zahtjevi koji moraju biti ispunjeni sukladno posebnim propisima ili stru?nim pravilima:

1. Gospodarski subjekt mora danom potpisa ugovora, a najkasnije prilikom isporuke robe, biti ovla?ten za veleprodaju medicinskih proizvoda prema dr?avi svog poslovnog nastana.

Gospodarski subjekt ovla?ten je za veleprodaju medicinskih proizvoda ako ispunjava sve uvjete za obavljanje djelatnosti prometa na veliko medicinskih proizvoda u dr?avi u kojoj ima sjedi?te.

Ponuditelj ?e danom potpisa ugovora o nabavi robe iz to?ke 3.1. dokumentacije o nabavi ili najkasnije prilikom isporuke robe, dostaviti, ukoliko to naru?itelj zatra?i:

? Dozvolu za promet medicinskim proizvodima, sukladno Zakonu o medicinskim proizvodima (NN br. 76/13), ukoliko je odabrani ponuditelj iz RH.

Ili:

? Dozvolu za promet medicinskim proizvodima izdanu u dr?avi svog poslovnog nastana, ukoliko je odabrani ponuditelj pravna ili fizi?ka osoba sa sjedi?tem u Europskoj uniji.
