Operatorii economici pot participa la procedura numai daca sunt inregistrati in SEAP. Solicitarile de clarificari ale potentialilor ofertanti se vor adresa in mod exclusiv in SEAP la Sectiunea ?Intrebari din cadrul procedurii de atribuire derulate prin mijloace electronice.

Raspunsurile la solicitarile de clarificari se vor posta in SEAP catre solicitantul clarificarii la sectiunea ?Intrebari, iar catre toti operatorii economici la rubrica de ?Documentatii, clarificari si decizii a anuntului de participare publicat pe site-ul www.e-licitatie.ro

Comisia de evaluare va transmite solicitarile de clarificare privind ofertele depuse, in SEAP la Sectiunea ?Intrebari.
Operatorii economici vor transmite raspunsurile la clarificari si eventualele documente solicitate pe parcursul evaluarii ofertelor prin intermediul SEAP (Sectiunea ?Intrebari), integral in sectiunea corespunzatoare respectivei solicitari, sub forma unuia sau a mai multor documente/fisiere distincte semnate cu semnatura electronica.
Modul de departajare al ofertelor: avand in vedere ca acordul cadru se incheie cu un numar maxim de 3 operatori economici, criteriul de atribuire fiind pretul cel mai scazut, modalitatea de departajare a eventualelor oferte cu preturi egale clasate pe unul dintre primele 3 locuri ale clasamentului va fi reofertarea. Reofertarea se va realiza prin incarcarea electronica in SEAP de documente care contin noile preturi. Pretul reofertat nu poate fi imbunatatit decat pana la nivelul pretului ofertat de operatorul clasat pe locul anterior.
Ofertantul isi asuma raspunderea exclusiva pentru legalitatea si autenticitatea tuturor documentelor prezentate in original si/sau in copie in vederea participarii la procedura.
Analizarea documentelor prezentate de ofertanti de catre comisia de evaluare nu angajeaza din partea acesteia nici o raspundere sau obligatie fata de acceptarea ca fiind autentice sau legale si nu inlatura raspunderea exclusiva a ofertantului sub acest aspect.
Operatorii economici clasati pe locurile 1, 2, 3 au obligatia de a transmite autoritatii contractante, la solicitarea acesteia, Formularul nr. 10 ? Imputernicire.
Accesarea DUAE, in vederea completarii, de catre operatorii economici interesati se face prin accesarea urmatoarelor link-uri:

Garantiile de participare se gasesc in Informatii privind loturile pe fiecare lot in parte. In cazul in care se constata ca ofertele clasate pe primul loc au preturi egale, autoritatea contrctanta va solicita clarificari prin intermediul SEAP, catre operatorii economici pentru departajare.
Daca pentru aceste medicamente va fi demarata procedura de licitatie centralizata de catre ministerul sanatatii, conform OUG nr. 71/2012 si a normelor de aplicare a acesteia, autoritatea contractanta isi rezerva dreptul de a anula aceasta procedura sau de a rezilia contractele pentru loturile licitate de ministerul sanatatii, atat in SEAP, cat si prin comunicare scrisa catre operatorii economici doar in cazul in care se constata ca anularea/rezilierea este mai avantajoasa din punct de vedere economic pentru autoritatea contractanta.
