Licitatie deschisa, in baza prevederilor art. 74 alin. (3) din Legea 98/2016
Situatia de urgenta este determinata de faptul ca produsele ce urmeaza a fi furnizate au facut obiectul unei proceduri de licitatie deschisa, anunt de participare nr. 170664/18.10.2016,in cadrul careia nu s-a depus nicio oferta sau au fost depuse numai oferte neconforme, fara ca aceste loturi sa fie atribuite;
In virtutea prevederilor art. 104, alin. (1), lit. a), autoritatea contractanta avea posibilitatea aplicarii NFPAP,dar a optat pentru licitatia deschisa (prezenta licitatie), cu aplicabilitatea prevederilor art. 74, alin. (3), in conditiile in care nu exista suficiente informatii privind potentiali operatori economici carora autoritatea contractanta sa le transmita invitatii de participare sau perioada necesara derularii NFPAP pentru toate loturile in cauza ar fi similara cu cea a unei Licitatii deschise, derulata in baza prevederilor 74, alin. (3);
Autoritatea contractanta nu a putut sa prevada ca la procedura de atribuire prin licitatie deschisa nu va prezenta oferta niciun operator economic sau ofertele prezentate vor fi neconforme, ca urmare urgenta nu se datoreaza unei inactiuni a autoritatii contractante;
In contextul in care achizitia directa este exclus a se efectua iar negocierea fara publicarea prealabila a unui anunt de participare are prevederi legale si mai restrictive, singura optiune a autoritatii contractante de a face fata situatiei de urgenta, reprezentata de achizitia de materiale sanitare ATI, coroborand cu prevederile legale in materie de achizitii publice, este folosirea unei proceduri concurentiale, in conditiile prevederilor art. 74, alin. (3) din Legea 98/2016;
Asigurarea materialelor sanitare ATI a fost solicitata inca din lunile august-septembrie 2016, autoritatea contractanta nemaidetinand in stocuri asemenea produse;
Perioada de valabilitate a primului contract subsecvent va fi corelata cu urgenta asigurarii materialelor sanitare ATI si termenul de livrare, si nu va fi mai mare de o luna de zile de la semnarea acestuia.
