Perioada de valabilitate: cel putin egala cu perioada minima de valabilitate a ofertei, astfel cum a fost solicitata prin documentatia de atribuire. Modalitatea de constituire: garantia de participare se constituie prin virament bancar sau printrun instrument de garantare emis in conditiile legii de o societate bancara ori de o societate de asigurari, care nu se afla in situatii speciale privind autorizarea ori supravegherea, in conditiile legii. Garantia de participare trebuie sa fie irevocabila. Instrumentul de garantare trebuie sa prevada ca plata garantiei de participare se va executa neconditionat, respectiv la prima cerere a beneficiarului, pe baza declaratiei acestuia cu privire la culpa persoanei garantate si se prezinta autoritatii contractante cel mai tarziu la data si oralimita de depunere a ofertelor.Nu se accepta file CEC. In cazul viramentului bancar, sumele se vor depune in contul nr. RO43TREZ7005005XXX000166, deschis la Trezoreria Operativa a Municipiului Bucuresti, nr. CUI 4266863. In cazul in care instrumentul de garantare este emis de catre o societate de asigurare, ofertantul este obligat sa faca dovada platii politei de asigurare aferente. Instrumentul de garantare emis intro alta limba va fi insotit de o traducere autorizata in limba romana. In cazul unei asocieri, instrumentul de garantare va fi emis pe numele oricaruia dintre membrii asocierii si va acoperi in mod solidar toti membrii asocierii. Autoritatea contractanta are obligatia de a retine garantia de participare in conformitate cu prev. art. 37 din HG nr. 395/2016. Se va constitui doar pentru contractele ale caror valori vor fi mai mari decat valoarea prevazuta la art. 7 alin. (1) din Legea 98/2016, in termen de 5 zile lucratoare de la data semnarii contractelor. Cuantum: 10 % din valoarea fara TVA a contractului. Modalitatea de constituire: prin virament bancar sau printr-un instrument de garantare emis in conditiile legii de o societate bancara sau de o societate de asigurari, care devine anexa la contract. Perioada de valabilitate a garantiei de buna executie a contractului va fi cel putin egala cu durata contractului.

III.2.1) Personal situation of economic operators, including requirements relating to enrolment on professional or trade registers
Information and formalities necessary for evaluating if the requirements are met: Ofertantii, tertii sustinatori si subcontractantii nu trebuie sa se regaseasca in situatiile prevazute la art. 164, 165, 167 din Legea nr. 98/2016. Se va completa declaratia privind neincadrarea in situatiile prevazute la art. 60 din Legea nr. 98/2006: Formular 3 ? se va completa de ofertant si de asociat / tert sustinator ori subcontractant, odata cu DUAE. Se va completa DUAE de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei lor. Documentele justificative care probeaza indeplinirea celor asumate prin completarea DUAE urmeaza a fi prezentate, la solicitarea autoritatii contractante, doar de catre ofertantul clasat pe locul I in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor. Aceste documente pot fi:
? certificate constatatoare privind lipsa datoriilor restante cu privire la plata impozitelor, taxelor sau a contributiilor la bugetul general consolidat (buget local, buget de stat etc.) la momentul prezentarii;
? cazierul judiciar al operatorului economic si al membrilor organului de administrare, de conducere sau de supraveghere al respectivului operator economic, sau a celor ce au putere de reprezentare, de decizie sau de control in cadrul acestuia, asa cum rezulta din certificatul constatator emis de ONRC / actul constitutiv;
? dupa caz, documente prin care se demonstreaza faptul ca operatorul economic poate beneficia de derogarile prevazute la art. 166 alin. (2), art. 167 alin. (2), art. 171 din Legea 98/2016 privind achizitiile publice;
? alte documente edificatoare, dupa caz. Persoanele cu functii de decizie din cadrul autoritatii contractante sunt: Cosmin Dinescu ? secretar general; Lucretia Tanase, secretar general adjunct; Gabriela Ochenatu director DPBCS; Eugen Enache director DAPA; Valentin Macec director adjunct DAPA. Certificat constatator, eliberat de Oficiul Registrului Comertului (informatiile cuprinse in certificatul constatator trebuie sa fie reale/actuale la momentul prezentarii), din care sa reiasa ca ofertantul are ca obiect de activitate principal sau secundar furnizarea de produse similare celor ce fac obiectul achizitiei.
Persoane fizice/juridice straine: documente edificatoare care sa dovedeasca o forma de inregistrare in conformitate cu prevederile legale din tara in care ofertantul isi are sediul social/domiciliul sau apartenenta din punct de vedere profesional, precizand numele complet, sediul, persoanele autorizate/administratori, domenii de activitate.
Obiectul contractului trebuie sa corespunda domeniului de activitate mentionat in respectivul document/documente. Se va completa DUAE de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei lor.
Note:
1. Certificatul constatator emis de ONRC, sau in cazul ofertantilor straini, documentele echivalente emise in tara de rezidenta, urmeaza sa fie prezentate, la solicitarea autoritatii contractante, doar de catre ofertantul clasat pe locul I in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor.

Pentru vizualizarea documentatiei de atribuire incarcate in SEAP operatorii economici trebuie sa aiba un program necesar vizualizarii fisierelor semnate electronic (acest program fiind disponibil gratuit pe siteurile furnizorilor de semnatura electronica). In cazul in care mai multe oferte admisibile au acelasi cel mai mic pret ofertat, modalitatea de departajare a acestor oferte se va realiza prin transmiterea de catre autoritatea contractanta catre ofertantii aflati in situatia respectiva, a unei solicitari de reofertare la sectiunea intrebari. Ulterior operatorii economici vor transmite raspunsul (noua propunere financiara), semnat electronic, in aceeasi sectiune. DUAE se poate completa de catre operatorii economici interesati, accesand linkul urmator: https://ec.europa.eu/growth/tools-databases/espd/filter Documentele emise de societati de asigurare si/sau banci vor fi inaintate in forma originala.
