Section III: Legal, economic, financial and technical information

III.1) Conditions relating to the contract
III.1.1) Deposits and guarantees required:
Garantia de participare este de aproximativ 1 % din valoarea estimata fara tva a contractului conform anexei B. Modalitati de constituire a garantiei de participare: 1) Scrisoare de garantie bancara pentru participare la procedura/ Instrument de garantare emis in conditiile legii de o societate de asigurari; 2) Ordin de plata sau virament bancar (vizat de banca) in contul RO22TREZ2165005XXX006884 deschis la Trezoreria Municipiului Cluj-Napoca; 3) Pentru plata prin numerar, aceasta se poate achita la casieria autoritatii contractante, intre orele 7.00-15.00. Perioada de valabilitate a garantiei de participare va fi de minim 90 de zile de la data limita de depunere a ofertelor. Autoritatea contractanta are obligatia de a retine garantia de participare, in baza articolului 37 din HG 395/2016. Dovada constituirii garantiei de participare se va depune, scanata, in SEAP. Echivalenta leu/alta valuta se va face la cursul stabilit de BNR inainte cu 5 zile de data limita stabilita pentru depunerea ofertelor. Ofertantul declarat castigator va trebui sa puna la dispozitia autoritatii contractante o garantie de buna executie in cuantum de 10 % din valoarea fiecarui contract subsecvent fara TVA, emisa in conditiile legii de o societate bancara sau o societate de asigurari, care devine anexa la contract. Garantia de buna executie se prezinta in original. Garantia de buna executie se poate constitui si prin plata prin virament bancar.

Information and formalities necessary for evaluating if the requirements are met: Ofertantii, tertii sustinatori si subcontractantii nu trebuie sa se regaseasca in situatiile prevazute la art.164, 165, 167 din Legea nr.98/2016. Modalitatea prin care poate fi demonstrata indeplinirea cerintei: se va completa DUAE de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei lor. Documentele justificative care probeaza indeplinirea celor asumate prin completarea DUAE urmeaza a fi prezentate, la solicitarea autoritatii contractante numai de ofertantii clasati pe primele 3 locuri in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor.
Aceste documente pot fi:
1. certificate constatatoare privind lipsa datoriilor restante la momentul prezentarii;
2. dupa caz, documente prin care se demonstreaza faptul ca operatorul economic poate beneficia de derogarile prevazute la art. 166 alin. (2), art. 167 alin. (2), art. 171 din Legea 98/2016 privind achizitiile publice;
3. Cazierul judiciar al operatorului economic si al membrilor organului de administrare, de conducere sau de supraveghere al respectivului operator economic, sau a celor ce au putere de reprezentare, de decizie sau de control in cadrul acestuia, asa cum rezulta din certificatul constatator emis de ONRC/actul constitutiv.

Operatorii economici ce depun oferta trebuie sa dovedeasca o forma de inregistrare in conditiile legii din tara de rezidenta, sa reiasa ca operatorul economic este legal constituit, ca nu se afla in niciuna dintre situatiile de anulare a constituirii precum si faptul ca are capacitatea profesionala de a realiza activitatile care fac obiectul contractului.
Modalitate de indeplinire: completare DUAE, in conformitate cu Notificarea nr.237/2016, urmand ca documentul justificativ, respectiv certificat constatator emis de ONRC, sau in cazul ofertantilor straini, documente echivalente emise in tara de rezidenta, urmeaza sa fie prezentate, la solicitarea autoritatii contractante, doar de ofertantii clasati pe primele 3 locuri in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor. Informatiile cuprinse in certificatul constatator trebuie sa fie actualizate la momentul prezentarii documentului.
Nota: Pentru oferte depuse in asociere, fiecare asociat va trebui sa prezinte documentele pentru partea din contract pe care o realizeaza.
