Section III: Legal, economic, financial and technical information

III.1) Conditions relating to the contract
III.1.1) Deposits and guarantees required:
Cuantumul garantiei de participare este de 10 182 RON defalcat pe loturi conform Anexa B.
Perioada de valabilitate a garantiei de participare este de 90 zile de la data limita stabilita pentru depunerea ofertelor. Garantia de participare va fi constituita in conformitate cu prevederile art. 36 alin. (1) din HG 395/2016, prin virament bancar sau printr-un instrument de garantare emis in conditiile legii de o societate bancara sau de o societate de asigurari in forma prezentata in formularul ?Scrisoare de garantie. In cazul in care ofertantul opteaza pentru contituirea garantiei de participare prin virament bancar, acesta va vira contravaloarea garantiei intr-unul din conturile conturile RO11 RZBR 0000 0600 0070 7034 sau RO20BRDE040SV18401150400 ? in RON, deschise la Raiffeisen Bank si BRD sucursala Bacau.
Dovada constituirii garantiei de participare va fi scanata si postata pe SEAP in fisier separat denumit ?Garantie de participare impreuna cu DUAE, oferta tehnica si financiara pana la data limita de depunere a ofertelor 5 % din valoarea contractului conform legislatiei in vigoare.

III.2.1) Personal situation of economic operators, including requirements relating to enrolment on professional or trade registers
Information and formalities necessary for evaluating if the requirements are met: Cerinta 1. Se prezinta DUAE. Ofertantii, tertii sustinatori sisubcontractanti propusi nu trebuie sa se regaseasca in situatiile prevazute de art.164, 165, 167 din Legea nr. 98/2016;
Modalitatea prin care poate fi demonstrata indeplinirea cerintei: se va completa DUAE de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei lor, pana la data si ora limita de depunere a ofertelor.
Documentele justificative care probeaza indeplinirea celor asumate prin completarea DUAE urmeaza a fi prezentate, la solicitarea autoritatii contractante, de ofertantul clasat pe primul loc in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor.
Aceste documente pot fi:
1 -certificate constatatoare privind lipsa datoriilor restante cu privire la plata impozitelor, taxelor sau a contributiilor la bugetul general consolidat ( buget local, buget de stat, etc) la momentul prezentarii;
2 -cazierul judiciar al operatorului economic si a membrilor organului de admistrare, de conducere sau de supraveghere al respectivului operator economic sau a celor ce au putere de reprezentare, de decizie sau de control in cadrul acestuia, asa cum rezulta din certificatul constatator emis de ONRC/ actul constitutiv;
3 - dupa caz, documente prin care se demonstreaza faptul ca operatorul economic poate beneficia de derogarile prevazute de art. 166 alin. (2), art.167 alin. (2), art. 171 din Legea nr. 98/2016 privind achizitiile publice.

Cerinta 2. Ofertantii, tertii sustinatori si subcontractantii nu trebuie sa se regaseasca in situatiile prevazute la art. 58-60 din Legea nr. 98/2016.
Modalitatea prin care poate fi demonstrata indeplinirea cerintei: se va completa DUAE de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei lor.
Documentele justificative care probeaza indeplinirea cerintei asumata prin completarea DUAE urmeaza a fi prezentate, la solicitarea comisiei de evaluare ofertantului clasat pe primul loc, de catre orice operator economic care depune oferta in mod individual sau in asociere, subcontractant sau tert sustinator.
Nota: In cazul in care in tara de origine sau in tara in care este stabilit operatorul economic nu se emit documente de natura celor prevazute mai sus sau respectivele documente nu vizeaza toate situatiile prevazute la art. 164, 165 si 167, se vor accepta declaratii pe propria raspundere sau, daca in tara respectiva nu exista prevederi legale referitoare la declaratia pe propria raspundere, declaratii autentice date in fata unui notar sau a unei autoritati administrative sau judiciare sau a unei asociatii profesionale care are competente in acest sens. Orice operator economic aflat in oricare dintre situatiile prevazute la art. 164 si 167 care atrag excluderea din procedura de atribuire poate furniza dovezi care sa arate ca masurile luate de acesta sunt suficiente pentru a-si demonstra in concret credibilitatea prin raportare la motivele de excludere. Cerinta nr. 1.
Operatorii economici ce depun oferta trebuie sa dovedeasca o forma de inregistrare in conditiile legii din tara de rezidenta, din care sa reiasa ca operatorul economic este legal constituit, ca nu se afla in niciuna dintre situatiile de anulare a constituirii precum si faptul ca are capacitatea profesionala de a realiza activitatile care fac obiectul contractului. Obiectul contractului trebuie sa aiba corespondent in codul CAEN din certificatul constatator emis de ONRC.
Modalitatile prin care poate fi demonstrata indeplinirea cerintei:
? se va completa DUAE de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei lor.
Document obligatoriu: Certificat constatator eliberat de Oficiul Registrului Comertului. Informatiile din certificatul constatator trebuie sa fie reale/valide la data prezentarii acestuia.
Documentele justificative care probeaza indeplinirea celor asumate prin completarea DUAE, respectiv certificat constatator emis de ONRC, sau in cazul ofertantilor straini, documente echivalente emise in tara de rezidenta, urmeaza sa fie prezentate, la solicitarea autoritatii contractante, doar de catre ofertantul clasat pe locul I in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor.
Justificare: Cerinta a fost impusa in virtutea art. 173 din Legea nr. 98/2016.

In cazul in care operatorul economic demonstreaza indeplinirea criteriilor referitoare la situatia economica si financiara ori privind capacitatea tehnica si profesionala invocand sustinerea unui tert, DUAE include informatiile mentionate mai sus cu privire la tertul sustinator. In cazul in care operatorul economic intentioneaza sa subcontracteze o parte/parti din contract, DUAE include si informatiile solicitate cu privire la subcontractanti. Autoritatea contractanta solicita ofertantului clasat pe primul loc dupa aplicarea criteriului de atribuire sa prezinte documente justificative actualizate prin care sa demonstreze indeplinirea tuturor criteriilor de calificare si selectie, in conformitate cu informatiile cuprinse in DUAE. In cazul si in masura in care autoritatea contractanta are posibilitatea de a obtine certificatele sau informatiile relevante in mod direct, prin accesarea unei baze de date nationale din orice stat membru, disponibile in mod gratuit, nu se vor mai solicita acele documente justificative.
