Section III: Legal, economic, financial and technical information

III.1) Conditions relating to the contract
III.1.1) Deposits and guarantees required:
Cuantum garantie de participare: conform sectiunea loturi, reprezentand 1 % din valoarea celui mai mare CS.
Modalitate de constituire: in conformitate cu prevederile art. 36 alin. (1) din HG nr. 395/2016. Perioada de valabilitate a garantiei pentru participare: 90 zile de la data limita stabilita pentru depunerea ofertelor (cel putin egala cu perioada de valabilitate a ofertei).
Viramentul bancar in favoarea Spitalului,se poate realiza in urmatorul cont de virament RO31TREZ7045005XXX000134 deschis la Trezoreria sectorului 4.
Note:
-In cazul depunerii de oferte in asociere, garantia de participare trebuie constituita in numele asocierii si sa se mentioneze ca acopera in mod solidar toti membrii grupului de operatori economici.
? In cazul in care garantia de participare se va constitui in alta valuta, valoarea garantiei de participare se va determina prin echivalenta RON/alta valuta, la cursul anuntat de BNR din ziua publicarii anuntului de participare in SEAP.
? Mentionam ca indiferent de forma de constituire a GP, aceasta se va incarca in SEAP, pana la data limita de depunerea ofertei
-In cazul in care ofertele nu sunt insotite de garantia de participare, acestea vor fi respinse avand in vedere art. 132 alin. 3 din HG 395/2016.
Cuantumul garantiei de buna executie este de 5 % din valoarea fara TVA a contractului subsecvent si se constituie conform art. 40 alin. (1) din HG 395/2016.

Conditie de calificare: Ofertantul/ofertantul asociat/subcontractantul/tertul sustinator nu trebuie sa se afle in niciuna din situatiile prevazute la art. 164,165, 166, 167 din Legea nr. 98/2016.
Declaratie privind neincadrarea in prevederile art. 58 ? 60 din Legea nr. 98/2016 privind achizitiile publice; Ofertantii, tertii sustinatori si subcontractantii nu trebuie sa se regaseasca in situatiile prevazute la art. 58-60 din Legea 98/2016
Declaratia conf. art. 60/Legea nr. 98/2016, va fi prezentata de toti participantii odata cu depunerea DUAE
Modalitate de indeplinire:
Se va completa DUAE de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei lor. Documentele justificative care probeaza indeplinirea celor asumate prin completarea DUAE urmeaza a fi prezentate, la solicitarea autoritatii contractante, doar de catre ofertantul clasat pe locul I in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor. Aceste documente pot fi:
1. certificate constatatoare privind lipsa datoriilor restante cu privire la plata impozitelor, taxelor sau a contributiilor la bugetul general consolidat (buget local, buget de stat etc.) la momentul prezentarii;
2. cazierul judiciar al operatorului economic;
3. dupa caz, documente prin care se demonstreaza faptul ca operatorul economic poate beneficia de derogarile prevazute la art. 166 alin. (2), art. 167 alin. (2), art. 171 din Legea 98/2016 privind achizitiile publice;
Precizari:
? In cazul depunerii unei oferte comune, cerinta trebuie indeplinita de toti membrii asocierii, precum si de tertul/tertii sustinatori, subcontractantul/subcontractantii, daca exista.
? In cazul in care in tara de origine sau in tara in care este stabilit ofertantul nu se emit documente de natura cazierului judiciar, autoritatea contractanta are obligatia de a accepta o declaratie pe propria raspundere sau, daca in tara respectiva nu exista prevederi legale referitoare la declaratia pe propria raspundere, o declaratie autentica data in fata unui notar, a unei autoritati administrative sau judiciare sau a unei asociatii profesionale care are competente in acest sens.
? In ceea ce priveste plata obligatiilor la bugetul de stat, plata impozitelor si taxelor locale, la nivelul DUAE trebuie sa ateste lipsa datoriilor restante la momentul prezentarii.
Nota: In cazul ofertantilor ce sunt persoane juridice straine se vor prezenta certificate echivalente care sa ateste ca acestia nu inregistreaza obligatii fiscale restante in conditiile legii incidente in tara de rezidenta.
? Persoanele ce detin functii de decizie in cadrul autoritatii contractante sunt urmatoarele:

Se vor prezenta:
a) Certificat constatator emis de Oficiul National al Registrului Comertului de pe langa Tribunalul Teritorial, in original/copie legalizata/copie lizibila cu mentiunea ?conform cu originalul, din care sa rezulte caobiectul de activitate al ofertantului include furnizarea de produse ce fac obiectul achizitiei. ( Pentru persoane juridice /fizice straine se vor prezenta documente edificatoare care sa dovedeasca o forma de inregistrare ca persoana juridica sau de inregistrare/atestare ori apartenenta din punct de vedere profesional, in conformitate cu prevederile legale din tara in care candidatul/ofertantul este rezident. Modalitatea prin care poate fi demonstrata indeplinirea cerintei: Se va completa DUAE de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei lor.
Documentele justificative care probeaza indeplinirea celor asumate prin completarea DUAE urmeaza a fi prezentate,la solicitarea autoritatii contractante, doar de catre ofertantul clasat pe locul I in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor.
b) Autorizatie de punere pe piata emisa de Ministerul Sanatatii pentru produsele ofertate conform Legii 95/2006 (art. 700 al. 1 si al. 2, art. 730 al. 5) privind reforma in domeniul sanatatii, Titlu XVII, Medicamentul, cu modificarile si completarile ulterioare in baza Ordinelor MSF nr. 263/15.3.2003 si nr. 895/20.7.2006, completand in acest sens in DUAE, urmand ca documentele justificative, respectiv autorizatia emisa de MS sau pentru ofertantii straini, documente echivalente emise in tara de rezidenta, sa fie prezentate doar la solicitarea autoritatii contractante la finalizarea evaluarii ofertelor.
Operatorii economici ce depun oferta trebuie sa detina atestare ori apartenenta din punct de vedere profesional, respectiv sa detina aviz emis de MS conform titlului XIX ? Dispozitive medicale din Legea nr. 95/2006, completand in acest sens in DUAE, urmand ca documentele justificative, respectiv avizul emis de MS sau pentru ofertantii straini, documente echivalente emise in tara de rezidenta, sa fie prezentate doar la solicitarea autoritatii contractante la finalizarea evaluarii ofertelor, doar de catre ofertantul clasat pe locul I.
Persoanele juridice /fizice straine: vor prezenta documente echivalente, emise in conf. cu legislatia aplicabila in tara de rezidenta.
Documentele justificative care probeaza indeplinirea celor asumate prin completarea DUAE urmeaza a fi prezentate, la solicitarea autoritatii contractante, doar de catre ofertantul clasat pe locul I in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor.
