Section III: Legal, economic, financial and technical information

III.1) Conditions relating to the contract
III.1.1) Deposits and guarantees required:
Cuantumul garantiei de participare reprezinta 1 % din valoarea celui mai mare contract subsecvent (lei fara TVA) din cadrul fiecarui lot in parte, in conformitate cu art. 35 alin. 3 lit.a din HG 395 / 2016 si alin. 4 al aceluiasi articol introdus prin HG 866 / 2016 (anexa B). Perioada de valabilitate a garantiei de participare va fi cel putin egala cu perioada de valabilitate a ofertei si se va constitui conform prevederii art. 36 alin. (1) din H.G. nr. 395/2016. Contul pentru depunerea garantiei de participare este: RO04BTRL03301202G43470XX.
Echivalenta pentru o garantie de participare depusa in valuta se va face la cursul BNR din data publicarii anuntului de participare in SEAP. Dovada constituirii garantiei de participare se va depune scanat in SEAP, pana cel mai tarziu la data si ora-limita de depunere a ofertelor.
In cazul depunerii de oferte in asociere, garantia de participare trebuie constituita in numele asocierii si se mentioneaza ca acopera in mod solidar toti membrii grupului de operatori economici. Garantia de participare emisa in alta limba decat romana, va fi insotita de traducerea autorizata in limba romana. Garantia de buna executie va fi in cuantum de 5 % din valoarea fara TVA si se va solicita contractelor subsecvente a caror valoare depaseste pragul valoric prevazut la art.7 alin(1), lit. b) din Legea 98/2016 privind achizitiile publice. Aceasta poate fi constituita in termen de 5 zile lucratoare de la data semnarii contractului subsecvent prin virament bancar sau printr-un instrument de garantare emis in conditiile legii de o societate bancara sau de o societate de asigurari, care devine anexa la contract.

Indeplinirea obligatiilor exigibile de plata la bugetul consolidat al statului. Operatorul economic (lider, asociat, tert sustinator) va completa cerinta corespunzatoare in formularul DUAE din documentatia de atribuire. Pentru confirmarea celor declarate in DUAE se va solicita ofertantilor clasati pe locurile I, II si III dupa aplicarea criteriului de atribuire (inclusiv de catre ofertantul asociat al castigatorului licitatiei sau tertul sustinator, dupa caz ) prezentarea pana la data incheierii raportului procedurii de atribuire a urmatoarelor documente: -certificat de atestare fiscala pentru persoane juridice privind obligatiile de plata la bugetul consolidat al statului in original sau copie certificata pe proprie raspundere pentru conformitate cu originalul, document din care sa reiasa ca ofertantul nu are datorii restante la momentul in care trebuie sa prezinte acest certificat. Pentru persoanele juridice straine ca modalitate de indeplinire a cerintei este si completarea DUAE conform art.193 din Legea 98/2016, urmand ca documentele edificatoare sa fie prezentate doar la solicitarea autoritatii contractante, la finalizartea evaluarii ofertelor. In ceea ce priveste obligatiile fiscale acestea vor fi indeplinite in conformitate cu prevederile din tara de rezidenta. Cazierul judiciar al operatorului economic si al membrilor organului de administrare, de conducere sau de supraveghere al respectivului operator economic, sau a celor ce au putere de reprezentare, de decizie sau de control in cadrul acestuia, asa cum rezulta din certificatul constatator emis de ONRC / actul constitutiv; dupa caz, documente prin care se demonstreaza faptul ca operatorul economic poate beneficia de derogarile prevazute la art. 166 alin. Operatorii economici ce depun oferta trebuie sa dovedeasca o forma de inregistrare in conditiile legii din tara de rezidenta, ca sunt legal constituiti, ca nu se afla in niciuna dintre situatiile de anulare a constituirii precum si faptul ca are capacitatea profesionala de a realiza activitatile care fac obiectul contractului. Modalitatea prin care poate fi demonstrata indeplinirea cerintei: se va completa DUAE de catre operatorii economici (lider, asociat, tert sustinator) participanti la procedura de atribuire cu informatiile aferente situatiei lor. Documentul justificativ care probeaza indeplinirea celor asumate prin completarea DUAE este certificatul constatator emis de ONRC, sau in cazul ofertantilor straini, documente echivalente emise in tara de rezidenta. In cazul in care nu este livrat in termenul de valabilitate, furnizorul se obliga sa il inlocuiasca pe cheltuiala proprie (a furnizorului). In acest sens se va prezenta o declaratie pe proprie raspundere prin care se asuma aceasta cerinta si se vor atasa poze, etichete sau orice alte documente care sa confirme cele declarate
? Declaratie pe proprie raspundere a furnizorului, cu privire la asigurarea transportului produselor, cu mijloace proprii sau inchiriate pe cheltuiala acestuia.

Autoritatea contractanta isi rezerva dreptul de a denunta unilateral acordul cadru inainte de termen in cazul in care Ministerul Sanatatii va incheia in baza oug 71/2012 acorduri cadru avand ca obiect produsele din prezenta procedura.

Documentatia de atribuire este afisata in SEAP, www.e-licitatie.ro Documentul DUAE este disponibil in format electronic, prin intermediul serviciului on-line, pus la dispozitie gratuit de Comisia Europeana, disponibil la adresa de internet https://ec.europa.eu/growth/toolsdatabases/espd/filter .

In cazul in care doua sau mai multe oferte clasate pe primul loc au acelasi pret, atunci, in vederea incheierii acordului cadru, la solicitarea scrisa a comisiei de evaluare, transmisa in SEAP, sectiunea ?loturi/intrebari, se va raspunde cu o noua oferta sau, dupa caz, confirmarea ca se mentine pretul initial. Dupa o noua evaluare si aplicarea criteriului de atribuire, va fi declarat castigator ofertantul care a avut pretul cel mai mic sau, in caz de mentinere a egalitatii, pana la stabilirea unui castigator, iar in cazul in care nu se poate stabili nici un castigator, procedura se va anula. Conform legii 98/2016 ,ofertantul este obligat sa utilizeze DUAE (Document Unic de Achizitie European). Ofertantii aflati pe locurile I, II si III, dupa evaluarea tuturor ofertelor depuse, conform criteriului de atribuire precizat in anuntul de participare, vor trebui sa prezinte documentele suport indicate in fisa de date a achizitiei, in vederea probarii celor asumate prin DUAE.
Solicitarile de clarificari vor fi transmise on line.
