Cuantumul garantiei de participare ? conform sectiunea Informatii privind loturile. Garantia de participare este valabila 90 de zile de la data limita de depunere a ofertelor. Modul de constituire a garantiei de participare: curs de referinta BNR din data publicarii in SEAP a invitatiei de participare. Garantia de participare la procedura de achizitie se constituie, in conformitate cu art. 36 din HG 395/2016, prin virament bancar sau printr-un instrument de garantare emis in conditiile legii de o societate bancara ori de o societate de asigurari, in lei, in conformitate cu prevederile legii, in cuantumul mentionat si cu o perioada de valabilitate egala cu perioada de valabilitate a ofertei, respectiv 90 de zile de la data limita de primire a ofertei. Information and formalities necessary for evaluating if the requirements are met: Ofertantii, tertii sustinatori si subcontractantii nu trebuie sa se regaseasca in situatiile prevazute la art. 164, 165, 167 din Legea nr. 98/2016. Modalitatea prin care poate fi demonstrata indeplinirea cerintei: se va completa DUAE de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei lor. Documentele justificative care probeaza indeplinirea celor asumate prin completarea DUAE urmeaza a fi prezentate, la solicitarea autoritatii contractante numai de catre ofertantii clasati pe primele 3 locuri in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor.
Aceste documente pot fi:
1. Certificate constatatoare privind lipsa datoriilor restante cu privire la plata impozitelor, taxelor sau a contributiilor la bugetul general consolidat (buget local, buget de stat, etc.) la momentul prezentarii;
2. Cazierul judiciar al operatorului economic si al membrilor organului de administrare, de conducere sau de supraveghere al respectivului operator economic, sau a celor ce au putere de reprezentare, de decizie sau de control in cadrul acestuia, asa cum rezulta din certificatul constatator emis de ONRC / actul constitutiv;
3. Dupa caz, documente prin care se demonstreaza faptul ca operatorul economic poate beneficia de derogarile prevazute la art. 166 alin. (2), art. 167 alin. (2), art. 171 din Legea 98/2016 privind achizitiile publice;
4. Alte documente edificatoare, dupa caz.
Ofertantii, tertii sustinatori si subcontractantii nu trebuie sa se regaseasca in situatiile prevazute la art. 59-60 din Legea 98/2016. Declaratiile conform art. 59 si 60 din Legea 98/2016 vor fi prezentate de ofertanti, terti sustinatori si subcontractanti odata cu DUAE.
Persoanele cu functie de decizie din cadrul autoritatii contractante, in ceea ce priveste organizarea, derularea si finalizarea procedurii de atribuire, sunt: manager ? prof. dr. Operatorii economici ce depun oferta trebuie sa dovedeasca o forma de inregistrare in conditiile legii din tara de rezidenta, sa reiasa ca operatorul economic este legal constituit, ca nu se afla in niciuna dintre situatiile de anulare a constituirii precum si faptul ca are capacitatea profesionala de a realiza activitatile care fac obiectul contractului. Modalitate de indeplinire: completare DUAE, urmand ca documentul justificativ, respectiv certificat ONRC (sau pentru ofertantii straini, document echivalent emise in tara de rezidenta) sau orice alt document justificativ echivalent emis pentru ofertantii straini in tara de rezidenta, sa fie prezentate doar la solicitarea autoritatii contractante numai de catre ofertantii clasati pe primele 3 locuri in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor.

Conform art. 179 lit. ?l din Legea nr. 98/2016, prezentarea de fotografii si/sau descrieri amanuntite (stampilate si semnate de operatorul economic) a caror autenticitate sa poata fi dovedita in cazul in care autoritatea contractanta doreste acest lucru cuprinzand: denumirea produsului, producatorul, continut si compozitie.
Certificat de marcaj CE emis de un organism notificat sau Declaratie de conformitate CE care atesta ca operatorul economic participant la procedura de atribuire respecta Directiva CE pentru gama de produse comercializata.
Dovada implementarii unui standard de asigurare a calitatii care sa demonstreze implementarea unor proceduri pe baza principiilor HACCP conform art. 5 din Hotararea nr. 924/2005 privind aprobarea Regulilor generale pentru igiena produselor alimentare, documente valabile la data prezentarii acestora.

Modul de departajare a ofertelor cu preturi egale: pentru fiecare lot in parte:
a) In cazul ofertelor de pret egale (2 sau mai multe oferte) si clasate pe acelasi loc, modul de departajare intre oferte se va face prin reofertarea preturilor in SEAP. Pretul reofertat nu poate fi imbunatatit decat pana la nivelul pretului ofertat de operatorul clasat pe locul anterior.
b) In cazul in care comisia de evaluare constata ca au fost depuse oferte admisibile cu preturi unitare egale la ofertantii clasati pe primul loc, autoritatea contractanta va solicita o noua propunere financiara in SEAP. Clasamentul se va stabili in urma reofertarii preturilor.
In cazul mentinerii egalitatii de preturi:
a) In cazul in care se mentine egalitatea de preturi pe primul loc, atunci intreg lotul se anuleaza;
b) In cazul in care se mentine egalitatea de preturi pe locurile 2 sau 3, atunci se anuleaza numai acele locuri si urmatoarele. Orice solicitare de clarificari ale ofertantilor vor fi transmise numai prin intermediul SEAP-ului. Contractele subsecvente vor fi incheiate cu ofertantul clasat pe primul loc.
In cazul in care acesta nu mai poate sa-si sustina pretul sau nu-si indeplineste obligatiile contractuale in mod corespunzator, atunci autoritatea contractuala va solicita incheierea contractelor subsecvente cu ofertantul clasat pe locul 2, daca exista.
