IV.1.1) Type of procedure
Award of a contract without prior publication of a call for competition in the Official Journal of the European Union in the cases listed below
  • Additional deliveries by the original supplier ordered under the strict conditions stated in the directive
Explanation:

Radboudumc doet deze upgrade om de aanwezige apparatuur nog enkele jaren te kunnen gebruiken, en beroept zich hierbij op artikel 33 sub b van Aw2012: voor aanvullende leveringen door de oorspronkelijke leverancier die bestemd zijn hetzij voor de gedeeltelijke vernieuwing van leveringen of installaties, hetzij voor de uitbreiding van bestaande leveringen of installaties, indien verandering van leverancier de aanbestedende dienst ertoe zou verplichten leveringen te verwerven met andere technische eigenschappen, zodat incompatibiliteit ontstaat of zich onevenredige technische moeilijkheden bij het gebruik en het onderhoud voordoen; de looptijd van deze opdrachten en nabestellingen is in de regel niet hoger dan 3 jaar.

Waarbij in rechtsoverweging 108 bij de richtlijn (nieuw) staat:

De aanbestedende diensten kunnen worden geconfronteerd met situaties waarin aanvullende werken, leveringen of diensten nodig zijn. In die gevallen kan een wijziging van de oorspronkelijke opdracht zonder nieuwe aanbestedingsprocedure gerechtvaardigd zijn. Dat doet zich met name voor wanneer de aanvullende prestaties dienen ter gedeeltelijke vervanging of als aanvulling van de bestaande diensten, leveringen of installaties, en de aanbestedende dienst bij vervanging van de leverancier genoodzaakt zou zijn materiaal, werken of diensten met andere technische kenmerken aan te kopen, en daardoor incompatibiliteit of buitensporige technische problemen bij het functioneren de werking en in het onderhoud zouden ontstaan.
