Section III: Legal, economic, financial and technical information

III.1) Conditions relating to the contract
III.1.1) Deposits and guarantees required:
?Garantia de participare se constituie prin virament bancar sau printr-un instrument de garantare emis in conditiile legii de o societate bancara sau o societate de asigurari ,care nu se afla in situatii speciale privind autorizarea ori supravegherea,in conditiile legiicf.prevederilor art. 36 alin. 1 HG 395/2016 cu modificarile si completarile ulterioare.Cuantumul garantiei este cel precizat in Informatii privind loturile, pentru fiecare lot in parte.
GP se va constitui in procent de 1 % din valoarea estimata fara TVA pentru fiecare lot in parte dupa cum urmeaza
GP poate fi constituita si in valuta, la cursul BNR, din data publicarii in SEAP a anuntului de participare. Perioada de valabilitate a garantiei de participare: 60 zile de la data-limita stabilita pentru depunerea ofertelor Daca garantia se constituie prin virament bancar, transferul va fi efectuat in contul RO79TREZ7025005XXX000170, Cod fiscal 4204003 al autoritatii contractante, deschis la Trezoreria Sect.2 conform prevederilor art. 36 alin. (6) din Normele metodologice aprobate GP se poate constitui si prin depunerea in numerar, la casieria autoritatii contractante, a sumelor corespunzatoare fiecarui lot prin H.G. nr. 395/2016 Instrumentul de garantare trebuie sa prevada ca plata garantiei de participare se va executa neconditionat, respectiv la prima cerere a beneficiarului, pe baza declaratiei acestuia cu privire la culpa persoanei garantate, . GP constituita printr-un instrument de garantare se va depune scanat in SEAP. In cazul depunerii de oferte in asociere, GP trebuie constituita in numele asocierii si sa mentioneze ca acopera in mod solidar toti membrii grupului de operatori economici Cuantumul garantiei de buna executie este de 5 % din valoarea fiecarui contract subsecvent,fara TVA. Garantia de buna executie se constituie in termen de 5 zile lucratoare de la data semnarii contractului de achizitie,conform art. 39 alin. (3) din HG 395/2016 prin virament bancar sau printr-un instrument de garantare emis in conditiile legii de o societate bancara sau de o societate de asigurari in conformitate cu art. 40 ? 42 din HG 395/2016.

Information and formalities necessary for evaluating if the requirements are met: Ofertantii, tertii sustinatori si subcontractantii nu trebuie sa se regaseasca in situatiile prevazute la art. 164, 165, 167 din Legea nr. 98/2016 privind achizitiile publice.
1. Declaratie privind neincadrarea in prevederile art. 164 din Legea nr. 98/2016 privind achizitiile publice. Operatorul economic va completa cerinta corespunzatoare in formularul DUAE din documentatia de atribuire. Incadrarea in situatia prevazuta la art.164 din Legea nr. 98/2016 privind achizitiile publice atrage excluderea ofertantului din procedura aplicata pentru atribuirea contractului de achizitie publica.

Cazierul judiciar al operatorului economic si al membrilor organului de administrare,de conducere sau de supraveghere al respectivului operator economic,sau a celor ce au putere de reprezentare,de decizie sau de control in cadrul acestuia,asa cum rezulta din certificatul constatator emis de ONRC/actul constitutiv;
? dupa caz,documente prin care se demonstreaza faptul ca operatorul economic poate beneficia de derogarile prevazute la art. 166 alin. (2),art. 167 alin. (2), art. 171 din Legea 98/2016 privind achizitiile publice;
? alte documente edificatoare, dupa caz operatorii economici nerezidenti(straini)au dreptul de a prezenta orice documente edificatoare,eliberate de autoritatile din tara in care acestia sunt rezidenti prin care sa dovedeasca indeplinirea obligatiilor de plata a impozitelor catre bugetul de stat si bugetul local,in conformitate cu legislatia din tara de rezidenta.Certificatele trebuie sa ateste lipsa datoriilor restante cu privire la plata impozitelor si a asigurarilor sociale,la momentul prezentarii acestora.Documentele se vor prezenta insotite de traducerea autorizata a acestora in limba romana.

Operatorii economici ce depun oferta trebuie sa dovedeasca o forma de inregistrare in conditiile legii din tara de rezidenta, sa reiasa ca operatorul economic este legal constituit,ca nu se afla in niciuna dintre situatiile de anulare a constituirii precum si faptul ca are capacitatea profesionala de a realiza activitatile care fac obiectul contractului.

Se va completa DUAE de catre operatorii economici participanti la procedura de atribuire cu informatiile ce descriu modul in care garanteaza trasabilitatea produselor, urmand sa probeze indeplinirea cerintei cu documente justificative ce vor fi prezentate, la solicitarea autoritatii contractante, doar de catre ofertantul clasat pe locul I (in cazul asocierii de catre fiecare operator economic care face parte din asociere) dupa aplicarea criteriului de atribuire,pana la incheierea Raportului Procedurii de atribuire. Documentele justificative pot fi: liste de verificare/rapoarte interne cuprinzand punctele de control si criteriile de monitorizare a produselor si proceselor pe lantul de aprovizionare sau orice alte documente pe care ofertantul le considera relevante in indeplinirea cerintei.
Completare DUAE Acest document trebuie transmis numai de ofertantul clasat pe primul loc dupa aplicarea criteriului de atribuire, pana la incheierea Raportului Procedurii de atribuire, conf. art. 196 alin.
