Section III: Legal, economic, financial and technical information

III.1) Conditions relating to the contract
III.1.1) Deposits and guarantees required:
Garantia de participare este de: lot 1 = 1 220 RON; lot 2 = 930 RON.
Pentru alte valute se aplica cursul BNR valabil la data publicarii anuntului de participare simplificat.
GP se constituie cf. art. 36 din HG 395/02.06.2016. GP trebuie sa fie irevocabila (cf. art. 36, alin. (3) din HG 395/2.6.2016). Atunci cand GP se constituie prin Instrument de garantare acesta trebuie sa prevada ca plata GP se va executa neconditionat, respectiv la prima cerere a beneficiarului, pe baza declaratiei acestuia cu privire la culpa persoanei garantate, si se prezinta AC, cel mai tarziu la data si ora limita de depunere a ofertelor (cf. art. 36, alin. (4) din HG 395/2.6.2016). Pentru virament bancar trebuie folosit contul: RO86 TREZ 6215 005XXX01 9422; CUI 4269215. Perioada de valabilitate a GP trebuie sa fie cel putin egala cu perioada minima de valabilitate a ofertei (incepand cu data limita de depunere a ofertelor). Indiferent de forma de constituire a GP, o copie a dovezii de constituire se va incarca in SEAP cel mai tarziu la data si ora limita stabilite pentru depunerea ofertelor. AC are obligatia sa retina GP cf. art. 37 din HG 395/2.6.2016.
Restituirea GP se face conform prevederilor art. 38 din HG 395/2.6.2015. Garantia de buna executie este de 10 % din valoarea de atribuire a contractului fara TVA, conform art. 39, alin. (4) din HG 395/2.6.2016 si se constituie conform art. 39, alin. (4) din HG 395/02.06.2016. Garantia de buna executie se constituie in termen de 5 zile lucratoare de la data semnarii contractului de achizitie publica/contractului subsecvent conform art. 39, alin. (3) din HG 395/2.6.2016. Atunci cand se constituie prin scrisoare de garantie, perioada de valabilitate a garantiei de buna executie trebuie sa depasasca cu cel putin 10 zile termenul limita de livrare, instalare, punere in functiune si instruire personal. Autoritatea contractanta are dreptul de a emite pretentii asupra garantiei de buna executie in conformitate cu prevederile art. 41 din HG 395/02.06.2016. Restituirea garantiei de buna executie se face conform art. 42 din HG 395/2.6.2016.

Declaratie privind neincadrarea in situatiile de excludere prevazute de art. 59, 60, 164, 165 si 167 din legea 98/19.5.2016, Declaratie conf art. 59 si 60/Legea 98/2016, care va fi prezentata de toti participantii odata cu depunerea DUAE.
Modalitatea de indeplinire: se va completa cerinta corespunzatoare in DUAE de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei lor.
Incadrarea intr-una din situatiile prevazute la art. 59, 60 164, 165 si 167 din legea 98/19.5.2016, duce la excluderea ofertantului din prezenta procedura.
Documentele justificative care probeaza indeplinirea celor asumate prin completarea DUAE urmeaza a fi prezentate, la solicitarea autoritatii contractante, doar de catre ofertantul clasat pe locul I in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor, conform art. 196 alin. (2) din legea 98/19.05.2016.
Aceste documente pot fi:
1. certificate constatatoare privind lipsa datoriilor restante cu privire la plata impozitelor, taxelor sau a contributiilor la bugetul general consolidat (buget local, buget de stat, etc.) la momentul prezentarii;
2. cazierul judiciar al operatorului economic si al membrilor organului de administrare, de conducere sau de supraveghere al respectivului operator economic, sau a celor ce au putere de reprezentare, de decizie sau de control in cadrul acestuia, asa cum rezulta din certificatul constatator emis de ONRC / actul constitutiv;
3. dupa caz, documente prin care se demonstreaza faptul ca operatorul economic poate beneficia de derogarile prevazute la art. 166 alin. (2), art. 167 alin. (2), art. 171 din Legea 98/2016 privind achizitiile publice;
4. alte documente edificatoare, dupa caz.
Se prezinta de ofertanti, membrii asocierii realizata in vederea depunerii de oferta comuna, tertul sustinator si subcontractantii propusi, atunci cand este cazul.

Informatii si formalitati necesare pentru evaluarea respectarii cerintelor mentionate:
Operatorii economici ce depun oferta trebuie sa dovedeasca o forma de inregistrare in conditiile legii din tara de rezidenta, din care sa reiasa ca operatorul economic este legal constituit, ca nu se afla in niciuna dintre situatiile de anulare a constituirii precum si faptul ca are capacitatea profesionala de a realiza activitatile care fac obiectul contractului.
Modalitate de indeplinire: Se va completa DUAE de catre operatorii economici participanti la procedura de atribuire.
Documentele justificative care probeaza inregistrare in conditiile legii din tara de rezidenta (Certificat constatator emis de Oficiul Registrului Comertului in baza Legii nr. 26/1990, sau echivalent, care sa corespunda situatiei reale a ofertantului, pentru persoanele fizice sau juridice romane, respectiv documente edificatoare care dovedesc o forma de inregistrare/atestare ori apartenenta din punct de vedere profesional in conformitate cu prevederile legale din tara in care ofertantul este rezident, care sa corespunda situatiei reale a ofertantului) urmeaza a fi prezentate, la solicitarea autoritatii contractante, doar de catre ofertantul clasat pe locul I in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor, conform art. 196 alin. (2) din legea 98/19.05.2016.
Documentele justificative solicitate trebuie sa fie valabile in momentul prezentarii.
Se prezinta de ofertanti si membrii asocierii realizata in vederea depunerii de oferta comuna.

Information and formalities necessary for evaluating if the requirements are met:
Experienta similara.
Ofertantul trebuie sa faca dovada ca, in ultimii 3 ani (raportati la data limita de depunere a ofertelor), a livrat produse similare a caror valoare cumulata a fost de minim: pentru lot 1= 125 00 RON, respectiv lot 2 = 95 000 RON.
Pentru alte valute se va aplica cursul mediu anual lei/valuta comunicat de BNR pentru fiecare an in parte.
Prin produse similare, pentru aceasta procedura, se inteleg aparate medicale si / sau aparatura de laborator.
Modalitatea de indeplinire: se va completa cerinta corespunzatoare in DUAE de catre operatorii economici participanti la procedura de atribuire. Documentele justificative care probeaza indeplinirea celor asumate prin completarea DUAE urmeaza a fi prezentate, la solicitarea autoritatii contractante, doar de catre ofertantul clasat pe locul I in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor, conform art. 179(b) din legea 98/19.05.2016. Se vor prezenta documente/certificate care sa ateste livrarea produselor similare corespunzatoare contractelor prezentate ca experienta similara, cu respectarea termenelor si clauzelor stipulate in acesta.

1. Precizari privind modalitatea de departajare a ofertelor care ar putea avea acelasi pret: in cazul in care se constata ca ofertele clasate pe primul loc au preturi egale, autoritatea contractanta va solicita operatorilor economici in cauza, clarificari prin intermediul SEAP, in vederea incarcarii electronice de catre acestia de documente care contin noi preturi pe baza carora se va reface clasamentul.
2. Precizari privind regulile de comunicare: toate intrebarile si solicitarile de clarificari se vor transmite autoritatii contractante numai prin intermediul SEAP. Autoritatea contractanta nu va da curs solicitarilor primite prin alte cai de comunicare.
3. Toate documentele vor fi redactate in limba romana, sau daca este cazul vor fi insotite de traducerea autorizata in limba romana.
4. Autoritatea contractanta accepta la momentul depunerii ofertelor prezentarea DUAE, conform art. 193 ? art. 200 din legea 98/19.05.2016.
5.
