III.1.1) Deposits and guarantees required:
Valoarea garantiei de participare este de 8 400 RON si se constituie in conformitate cu prevederile art. 36 alin. (1) din HG nr. 395/2016. Perioada de valabilitate a garantiei pentru participare este de 60 de zile de la data limita de depunere a ofertelor. Pentru plata prin virament se va folosi contul RO82TREZ23120F330800XXXX, deschis la Trezoreria Constanta. Dovada constiuirii garantiei se va prezenta pana cel tarziu la data si ora limita stabilite pentru depunerea ofertelor. Lipsa garantiei de participare duce la descalificarea ofertantului. Valoarea garantiei de buna executie este 5 % din valoarea fara TVA a contractului, in conformitate cu art. nr. 39 din HG nr. 935/2016. Aceasta se constituie prin virament bancar, printr-un instrument de garantie emis in conditiile legii de o societate bancara sau o societate de asigurari. Pentru plata prin virament se va folosi contul RO82TREZ23120F330800XXXX, deschis la Trezoreria Constanta.

III.2.1) Personal situation of economic operators, including requirements relating to enrolment on professional or trade registers
Information and formalities necessary for evaluating if the requirements are met: Operatorul economic care depune oferta trebuie sa nu se incadreze in situatiile prevazute al art. 164, 165, 167, din Legea nr. 98/2016. Deasemeni, ofertantii terti sustinatori si subcontractantii nu trebuie sa se incadreze in prevederile art. 58, art. 164, art. 165, art. 167, din Legea 98/2016.
Cerintele vor fi indeplinite prin completarea formularului DUAE.
Se vor prezenta:
? certificate constatatoare privind lipsa datoriilor restante la plata impozitelor, taxelor sau contributiilor la bugetul general consolidat (buget local si buget de stat) la momentul prezentarii;
? cazierul judiciar al operatorului economic si al membrilor organului de administrare, de conducere sau de supraveghere al operatorului economic, sau a celor care au putere de reprezentare, decizie ori control in cadrul operatorului, asa cum rezulta din certificatul constatator emis de ONRC ori actul constitutiv.Informatiile din certificatul constatator trebuie sa fie reale si valide la momentul prezentarii;
? documente prin care sa se ateste faptul ca operatorul economic poate beneficia de derogarile prevazute in art. 166 alin. 2, art. 167 alin. 2, art. 171 din Legea 98/2016, daca este cazul;
? alte documente edificatoare, dupa caz.
Persoanele juridice straine pot depune documente echivalente, conforme cu legislatia aplicata in tara de rezidenta, acolo unde este cazul.
Ofertantul situat pe locul 1, dupa finalizarea evaluarii, va prezenta documentele, la solicitarea autoritatii contractante.
Operatorul economic care depune oferta trebuie sa nu se afle in situatiile prevazute al art. 58, din Legea nr. 98/2016.
Cerinta va fi indeplinita prin completarea formularului DUAE.
Se va prezenta formular ?Declaratie pe proprie raspundere privind neincadrarea in prevederile art. 58/63 (conform model-formulare) din Legea nr. 98/2016.
Ofertantul situat pe locul 1, dupa finalizarea evaluarii, va prezenta declaratia, la solicitarea autoritatii contractante.
Conform art. 193 din Legea 98/2016, autoritatea contractanta va accepta DUAE, in locul documentelor de calificare, ca dovada preliminara.
In cazul in care in tara unde este stabilit ofertantul nu se emit documente cum sunt cele enumerate mai sus, sau documente ce nu vizeaza situatiile prevazute la art. 164, 165, 167, nu prevad declaratii pe proprie raspundere, autoritatea contractanta are obligatia de a accepta o declaratie autentica, a unei autoritati administrative sau juduciare, a unei asociatii profesionale competenta.
Urmare art. nr. 63.1, persoanele cu drept de decizie cu privire la organizarea, desfasurarea si finalizarea procedurii, sunt: conf. univ. dr. Stelian Paris-manager-, dr. Radu Baz (membru comisie)- sef Laborator de Radiologie si Imagistica Medicala-, ec. Elena Ioancea- Serviciu Financiar-Contabil, ing. Georgeta Gheorghe (membru comisie)-Serviciul Tehnic-, ref. Nicoleta Radulescu (membru comisie)-Serviciul Administrativ-Achizitii-, ref. Manuel Popa (presedinte comisie)-Serviciul Administrativ-Achizitii-, jr. Adina Mocanu-Serviciul Juridic.
Operatorul economic care depune oferta, trebuie sa faca dovada formei de inregistrare, certificat eliberat de ONRC, document real si valid la momentul prezentarii, din care sa rezulte obiectul de activitate, obiect care sa fie corespondent CAEN, cu obiectul contractului.
Cerinta va fi indeplinita prin completarea formularului DUAE.
Operatorul economic va prezenta Autorizatie de Comercializare/Distributie eliberata de Agentia Nationala a Medicamentului si a Dispozitivelor Medicale, coform Legii nr. 95/2006, repubilcata si reactualizata, art. 926.
Cerinta va fi indeplinita prin completarea formularului DUAE.
Operatorul economic va prezenta Aurorizatie de Furnizare si Manipulare emisa de Comisia Nationala pentru Controlul Activitatilor Nucleare, conform Legii nr. 111/1996, art. 2 litera ?c, repubilcata si reactualizata.
Cerinta va fi indeplinita prin completarea formularului DUAE.
Ofertantul situat pe locul 1, dupa finalizarea evaluarii, va prezenta documentele, la solicitarea autoritatii contractante, copii legalizate sau fotocopii lizibile, semnate si stampilate de reprezentantul legal, cu mentiunea ?conform cu originalul.
