III.1) Conditions relating to the contract
III.1.1) Deposits and guarantees required:
Cuantumul garantiei de participare, in conformitate cu art. 35 alin. (4) lit a) din HG nr. 395/2016 pentru aprobarea normelor de aplicare a prevederilor referitoare la atribuirea contractelor de achizitie publica/acordului ? cadru din Legea nr. 98/2016 privind achizitiile publice, modificata si completata prin HG nr. 8966/2016, este de: 14 900 RON. Perioada de valabilitate a garantiei de participare este de 90 zile de la data limita prevazuta pentru depunerea ofertelor, cu posibilitatea prelungirii acesteia la cererea autoritatii contractante. Modul de constituire a garantiei de participare: garantia de participare se constituie prin virament bancar sau printr-un instrument de garantare emis in conditiile legii de o societate bancara ori de o societate de asigurari, care nu se afla in situatii speciale privind autorizarea ori supravegherea, in conditiile legii; contul de trezorerie pentru constituirea garantiei de participare prin virament bancar: RO20TREZ6215006XXX017650 deschis la Trezoreria municipiului Timisoara, beneficiar: Directia Politiei Locale Timisoara, cod fiscal: 27872311. In conformitate cu prevederile art. 36 alin. (4) din HG nr. 395/2016 pentru aprobarea normelor de aplicare a prevederilor referitoare la atribuirea contractelor de achizitie publica/acordului-cadru din Legea nr. 98/2016 privind achizitiile publice, modificata si completata prin HG nr. 8966/2016, in orice situatie, dovada constituirii garantiei de participare trebuie sa fie prezentata cel mai tarziu la data si ora-limita de depunere a ofertelor. Garantia de participare se retine in conditiile prevazute la art. 37 alin. (1) din HG nr. 395/2016. Garantia de buna executie se va constitui in termen de 5 zile de la data semnarii contractului, in cuantum de 5 % din valoarea contractului fara TVA. Aceasta se constituie prin oricare din formele prevazute la art. 40 alin. (1) din HG 395/2016. Autoritatea contractanta are dreptul de a emite pretentii asupra garantiei de buna executie in conditiile art. 41 din HG nr. 395/2016.

III.2.1) Personal situation of economic operators, including requirements relating to enrolment on professional or trade registers
Information and formalities necessary for evaluating if the requirements are met: Potrivit prevederilor art. 193 din Legea nr. 98/2016, autoritatea contractanta va accepta in cadrul ofertelor DUAE (Documentul Unic de Achizitie European) in vederea demonstrarii cerintelor de calificare, ca dovada preliminara. Ofertantii, tertii sustinatori si subcontractantii nu trebuie sa se regaseasca in situatiile prevazute la art. 164, 165, 167 din Legea nr.98/2016. Ofertantii, tertii sustinatori, subcontractantii vor prezenta o declaratie conf. art. 60 din Legea 98/2016 odata cu depunerea DUAE. Inainte de atribuirea contractului de furnizare, autoritatea contractanta va solicita ofertantului clasat pe primul loc dupa aplicarea criteriului de atribuire, sa prezinte documentele justificative actualizate: certificate fiscale privind lipsa debitelor restante cu privire la plata impozitelor, taxelor sau a contributiilor la bugetul general consolidat precum si la bugetul local, valabil la momentul prezentarii, cazierul judiciar al ofertantului si al membrilor organului de administrare, de conducere sau de supraveghere, sau a celor ce au putere de reprezentare, de decizie sau de control in cadrul acestuia,asa cum rezulta din certificatul constatator emis de ONRC/actul constitutiv, dupa caz documente prin care poate beneficia de derogarile prevazute la art. 166 alin. (2), art. 167 alin. (2), art. 171 din Legea 98/2016, alte documente edificatoare, prin care sa demonstreze indeplinirea tuturor criteriilor de calificare, in conformitate cu informatiile cuprinse in DUAE. DUAE se va depune si de catre tertul sustinator si de subcontractant, daca este cazul.

Certificat constatator, extins, emis de Oficiul National al Registrului Comertului al judetului unde firma isi are sediul privind date de identificare ale societatii; filiale; sucursale; puncte de lucru; administratori; reprezentanti; imputerniciti; durata societatii; actionari/ asociati; obiect de activitate (cod CAEN). In etapa evaluarii ofertelor, autoritatea contractanta va solicita ofertantului clasat pe primul loc, inainte de transmiterea comunicarii privind rezultatul procedurii de atribuire, de a prezenta pentru conformitate documentul in original/copie legalizata sau copie lizibila cu mentiunea conform cu originalul. Informatiile din Certificatul constatator trebuie sa fie reale/valide la data prezentarii acestuia. Potrivit prevederilor art. 193 din Legea nr. 98/2016, autoritatea contractanta va accepta in cadrul ofertelor DUAE (Documentul Unic de Achizitie European) in locul documentelor solicitate in vederea demonstrarii cerintelor de calificare, inclusiv a capacitatii de exercitare ca dovada preliminara.
Inainte de atribuirea contractului de furnizare, autoritatea contractanta va solicita ofertantului clasat pe primul loc dupa aplicarea criteriului de atribuire, sa prezinte documentele justificative actualizate prin care sa demonstreze indeplinirea tuturor criteriilor de calificare, in conformitate cu informatiile cuprinse in DUAE. DUAE se va depune si de catre tertul sustinator si de subcontractant, daca este cazul.

Documentele care sustin cele asumate in DUAE sunt copie contracte/recomandari/certificate/alte documente certificate pentru conformitate cu originalul si vor fi prezentate doar la solicitarea entitatii contractante, doar de catre ofertantul clasat pe locul I in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor.
