Reguli de comunicare si transmitere a datelor: solicitarile de clarificari referitorare la prezenta documentatie de atribuire se vor adresa in mod exclusiv in SEAP la Sectiunea ?Intrebari din cadrul procedurii de atribuire derulate prin mijloace electronice, iar raspunsurile la acestea vor fi publicate in SEAP la Sectiunea ?Documentatie, clarificari si decizii din cadrul anuntului de participare.
Pentru transmiterea solicitarilor de clarificari privind documentatia de atribuire, operatorii economici vor transmite solicitarile avand in vedere termenele de raspuns ale autoritatii contractante prevazute la art. 160-161 din Legea nr. 98/2016.
Pentru comunicarile ulterioare depunerii ofertelor:
? comisia de evaluare va transmite solicitarile de clarificari in legatura cu oferta prin utilizarea facilitatilor tehnice disponibile in SEAP (Sectiunea ?Intrebari).
? operatorii economici vor transmite raspunsurile la clarificari si eventualele documente solicitate pe parcursul evaluarii ofertelor prin intermediul SEAP (Sectiunea ?Intrebari), in format electronic, semnate cu semnatura electronica, conform Legii 455/2001.
Solicitarile de clarificari vor viza doar confirmarea unor elemente din documentele depuse in oferta nu si completarea cu documente care lipsesc din oferta.
Durata acordului-cadru: maximum 20 luni, pana la data de 31.12.2018.
Documentele prezentate in alta limba decat limba romana vor fi insotite, obligatoriu de traducerea acestora efectuata de un traducator autorizat.
In cazul in care se constata ca 2 sau mai multe oferte depuse pentru 1 sau mai multe loturi se claseaza pe locul I cu acelasi punctaj, oferta declarata castigatoare va fi oferta cu cel mai mic pret.
Acordul-cadru nr. 6084 - Lot 3 si contractul subsecvent nr. 1/6085 - Lot 3 au fost incheiate la data de 22.8.2017.
Ulterior incheierii acestora, s-a formulat contestatie la CNSC, inregistrata la autoritatea contractanta sub nr. 6094/22.8.2017. Ca urmare a acestei situatii, acordul-cadru si contractul subsecvent au fost suspendate (nu s-a emis ordin de incepere a lucrarilor) pana la solutionarea contestatiei.
Prin Decizia nr. 2528/C5/3015/28.9.2017, comunicata autoritatii contractactante la data de 2.10.2017, CNSC a respins contestatia, ca fiind tardiva. Pentru motivele expuse, autoritatea contractanta nu a publicat anuntul de atribuire in termenul prevazut la art.145 din Legea 98/2016.
