Section III: Legal, economic, financial and technical information

III.1) Conditions relating to the contract
III.1.1) Deposits and guarantees required:
Cuantumul garantiei de participare si val. ce se retine este 1 % din valoarea maxim estimata a acordului cadru cf. HG 866/2016 ( a se vedea informatii privind loturile. Perioada de valab a garantiei de part. va fi cel putin egala cu perioada minima de valabilitate a ofertei, adica 120 zile de la data limita de depunere a ofertelor. Modul de constituire a garantiei pentru participare: 1. Virament bancar sau un instr. de garantare emis in conditiile legii de o societate bancara ori de o soc. de asigurari; 2. Scrisoare de garantie bancara in favoarea autoritatii contractante; 3. Numerar la caseria unitatii caz in care ofertantul va prezenta chitanta) 4. Ordin de plata vizat de banca sau fila cec. Cont RO97TREZ4065006XXX015626,Trez. Iasi. Echivalenta in RON/alta valuta va fi cea stabilita de cursul BNR inainte cu 5 zile de data limita stabilita pentru depunerea ofertelor. In cazul depunerii ofertelor pentru mai multe loturi se va completa un centralizator din care sa rezulte loturile pentru care s-a depus garantia de participare si valoarea totala a garantiei de participar.Instrumentul de garantare trebuie sa prevada ca plata garantiei de participare se va executa neconditionat, respectiv la prima cerere a beneficiarului, pe baza declaratiei acestuia cu privire la culpa persoanei garantate, si se prezinta autoritatii contractante, pana cel mai tarziu la data si ora limita de depunere a ofertelor, conform dispozitiile art. 2 alin. 3 din HG 866/2016 pentru modificarea si completarea HG nr. 395/2016.In cazul depunerii de oferte in asociere, garantia de participare trebuie constituita in numele asocierii si sa mentioneze ca acopera in mod solidar toti membrii grupului de operatori economici. Operatorul economic se obliga sa constituie garantia de buna executie a contractului in cuantum de 10 % din pretul contractului, exclusiv TVA in termen de 5 zile de la semnarea prezentului contract, prin virament bancar sau printr-un instrument de garantare emis in conditiile legii de o societate bancara sau de o societate de asigurari, conf. paragrafului 5 din Hotararea 395/2016.Garantia de buna executie va fi valabila pana la data ultimului proces verbal de receptie a produselor livrate.

III.2.1) Personal situation of economic operators, including requirements relating to enrolment on professional or trade registers
Information and formalities necessary for evaluating if the requirements are met: 1.1. Ofertantii, tertii sustinatorii, subcontractantii nu trebuie sa se regaseasca in situatiile prevazute la art. 164, 165, 167 din Legea 98/2016
I. In vederea demonstarii indeplinirii acestei cerinte se va complete DUAE de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei lor.Documentele justificative care probeaza indeplinirea celor asumate prin DUAE urmeaza a fi prezentate la solicitarea autoritatii contractante, doar de catre ofertantii clasati pe primele 3 locuri in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor.
Aceste documente sunt:
1. Certificate constatatoare privind lipsa datoriilor restante cu privire la plata impozitelor, taxelor sau a contributiilor la bugetul general consolidat (buget local, buget de stat etc) la momentul prezentarii.
2. Cazierul judiciar al operatorului economic si al membrilor organului de administrare, de conducere sau de supraveghere al respectivului operator economic, sau a celor ce au putere de reprezentare, de decizie sau de control in cadrul acestuia, a?a cum rezulta din certificatul constatator emis de ONRC / actul constitutiv.
3. Dupa caz, documente prin care se demonstreaza faptul ca operatorul economic poate beneficia de derogarile prevazute la art. 166 alin. (2), art. 167 alin. (2), art. 171 din Legea 98/2016 privind achizitiile publice.

Referent Birou Achizitii Raluca Olaru Operatorii economici ce depun oferta trebuie sa dovedeasca o forma de inregistrare in conditiile legii din tara de rezidenta, sa reiasa ca operatorul economic este legal constituit, ca nu se afla in nici una dintre situatiile de anulare a constituirii precum si faptul ca are capacitate profesionala de a realiza activitatile care fac obiectul contractului.
Avizul Ministerului Sanatatii emis in baza prevederilor Legii 95/2006, art. 926 privind reforma in domeniul sanatatii, cu modificarile si completarile ulterioare, pentru activitatile de comercializare, distributie si de prestari servicii in domeniul dispozitivelor medicale desfasurate de operatorul economic care depune oferta in cadrul procedurii sau in cazul persoanelor juridice(sau fizice, dupa caz)straine vor prezenta documente echivalente pentru demonstrarea indeplinirii capacitatii de exercitare a activitatii profesionale, insotite de o traducere autorizata a acestora in limba romana. Avizul trebuie sa fie valabil la data prezentarii.
Se vor prezenta pentru fiecare lot ofertat autorizatiile de punere pe piata emise de Agentia Nationala a Medicamentului conform Legii 95/2006, art. 704, in termen de valabilitate la data prezentarii sau insotite de documente care fac dovada prelungirii acestuia.
Completare DUAE cu certificat constatator emis de ONRC, sau in cazul ofertantilor straini documente echivalente emise de tara de rezidenta, documente ce urmeaza a fi prezentate la solicitarea autoritatii contractante doar de catre ofertantii clasati pe primele 3 locuri in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor.

Declaratie privind partea/partile din contract care sunt indeplinite de subcontractanti si specializarea acestora daca este cazul
Angajament de sustinere privind experienta similara a ofertantului/candidatului/grupului de operatori economici
Capacitatea tehnica si/sau profesionala poate fi dovedita prin sustinere, in conformitate cu prevederile alin. (1) art. 182 din Legea 98/2016.In cazul in care ofertantul isi demonstreaza capacitatea tehnica si profesionala invocand si sustinerea acordata de catre o alta persoana, atunci acesta are obligatia de a dovedi sustinerea de care beneficiaza prin prezentarea unui angajament ferm al persoanei respective. Angajamentul trebuie sa fie explicit, scris si neconditionat, precizand fara echivoc cerinta pentru care tertul intelege sa acorde sustinerea, precum si modalitatea concreta de acordare a sustinerii, in conditiile legii. Odata cu angajamentul de sustinere, ofertantul are obligatia sa prezinte documente transmise acestuia de catre tertul/tertii sustinator/sustinatori, din care sa rezulte modul efectiv prin care tertul/tertii sustinator/sustinatori va/vor asigura indeplinirea propriului angajament de sustinere, documente care se vor constitui ca anexe la respectivul angajament ? acordul de asociere si acordul de subcontractare. Angajamentul ferm prezentat de ofertant trebuie sa prevada care sunt resursele care sunt aduse in sustinere si sa evidentieze faptul ca disponibilizarea acestora se va realiza neconditionat in functie de necesitatile care apar pe parcursul indeplinirii contractului in cauza, in conditiile si in termenele acestuia. Atunci cand ofertantul demonstreaza indeplinirea cerintei de calificare legata de capacitatea tehnica si /sau profesionala prin invocarea sustinerii acordate de unul sau mai multi terti, capacitatea acestuia/acestora se va cumula cu cea a ofertantului in ceea ce priveste respectiva/respectivele cerinta.

Completare DUAE. Documentele justificative care probeaza indeplinirea cerintei de experienta similara asumata prin documentele DUAE, respectiv prezentarea de certificate/documente emise sau contrasemnate de o autoritate contractanta ori de clientul beneficiar ,urmeaza sa fie prezentate la la solicitarea autoritatii contractante, doar de catre ofertantii clasati pe primele 3 locuri in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor.
In cazul tertilor si subcontractantilor se va solicita completare DUAE.Documentele justificative care probeaza cele asumate in angajamente/acorduri prin completare DUAE urmeaza sa fie prezentate la solicitarea autoritatii contractante, doar de catre ofertantii clasati pe primele 3 locuri in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor
Se va solicita tuturor ofertantilor, ca o data cu depunerea DUAE, sa prezinte angajamentul tertului sustinator (impreuna cu documente anexate la angajament, transmise acestora de catre terti/terti sustinatori, din care rezulta modul efectiv in care se va materializa sustinerea acestuia/acestora), acordul de asociere si acordul de subcontractare.

Daca se constata ca pe locul 1 sunt clasate doua sau mai multe oferte deoarece au preturi egale, in vederea departajarii autoritatea contractanta va solicita operatorilor economici in cauza sa incarce electronic prin intermediul SEAP documente care contin noile preturi. Acordul cadru se va incheia cu cel mult 3 operatori economici. In situatia in care mai multi operatori economici.se claseaza pt. incheierea acordului cadru la egalitate pe locul 2 deoarece au preturi egale, in vederea departajarii autoritatea contractanta va solicita operatorilor economici in cauza sa incarce electronic prin intermediul SEAP documente care contin noile preturi. Aceste noi preturi nu pot fi imbunatatite decat pana la nivelul pretului ofertat de operatorul clasat pe locul 1 in clasament. In situatia in care mai multi operatori economici.se claseaza pt. incheierea acordului cadru la egalitate pe locul 3 deoarece au preturi egale, in vederea departajarii autoritatea contractanta va solicita operatorilor economici in cauza sa incarce electronic prin intermediul SEAP documente care contin noile preturi. Aceste noi preturi pot fi imbunatatite decat pana la nivelul pretului ofertat de operatorul clasat pe locul 2 in clasamentAvand in vedere art. 20 alin.
