III.1) Conditions relating to the contract
III.1.1) Deposits and guarantees required:

In cazul unei oferte comune, garantia de participare va fi emisa in numele asocierii, cu nominalizarea tuturor membrilor. Conditii retinere: cf. art. 37 din HG 395/2016 si garantia se restituie cf. art. 38 din HG 395/2016.
Cuantum: 2 % din valoarea totala a contractului pentru fiecare lot in parte, in RON fara TVA, conform cap.17 din contractul de servicii. Mod constituire: conform art. 39-42 din HG nr. 395/2016.

III.2.1) Personal situation of economic operators, including requirements relating to enrolment on professional or trade registers
Information and formalities necessary for evaluating if the requirements are met: Ofertantii, tertii sustinatori si subcontractantii, dupa caz, nu trebuie sa se regaseasca in situatiile prevazute la art. 164, 165, 167 din Legea nr. 98/2016. Modalitatea prin care poate fi demonstrata indeplinirea cerintei: se va completa DUAE de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei lor. Documentele justificative care probeaza indeplinirea celor asumate prin completarea DUAE urmeaza a fi prezentate, la solicitarea autoritatii contractante, doar de catre ofertantul clasat pe locul I in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor. Aceste documente pot fi:
1. certificat privind lipsa datoriilor restante cu privire la plata impozitelor, taxelor sau a contributiilor la bugetul general consolidat din care trebuie sa reiasa lipsa datoriilor restante la momentul prezentarii documentului;
2. cazierul judiciar al operatorului economic/furnizorului de servicii sociale si al membrilor organului de administrare, de conducere sau de supraveghere al respectivului operator economic/furnizor de servicii sociale, sau a celor ce au putere de reprezentare, de decizie sau de control in cadrul acestuia, asa cum rezulta din certificatul constatator emis de ONRC / actul constitutiv;
3. dupa caz, documente prin care se demonstreaza faptul ca operatorul economic/furnizorul de servicii sociale poate beneficia de derogarile prevazute la art. 166 alin. (2), art. 167 alin. (2), art. 171 din Legea 98/2016 privind achizitiile publice;
Odata cu depunerea DUAE pentru fiecare lot pentru care se depune oferta, ofertantii vor prezenta angajamentul tertului sustinator, acordul de asociere si acordul de subcontractare, daca este cazul, urmand ca documentele justificative pentru acestea sa fie prezentate la solicitarea comisiei de evaluare numai de catre ofertantul clasat pe primul loc.
Ofertantii, tertii sustinatori si subcontractantii, dupa caz, nu trebuie sa se regaseasca in situatiile prevazute la art. 60 din Legea nr. 98/2016, astfel se va completa Formularul nr. 8, declaratie care va fi prezentata, pentru fiecare lot in parte, odata cu DUAE de catre ofertant, asociat, subcontractant si tert sustinator, dupa caz.

Operatorii economici ce depun oferta trebuie sa dovedeasca o forma de inregistrare in conditiile legii din tara de rezidenta, sa reiasa ca operatorul economic/furnizorul de servicii sociale este legal constituit, ca nu se afla in niciuna dintre situatiile de anulare a constituirii, precum si faptul ca are capacitatea profesionala de a realiza activitatile care fac obiectul contractului. Modalitate prin care poate fi demonstrata indeplinirea cerintei: se va completa DUAE de catre operatorii economici/furnizorii de servicii sociale participanti la procedura de atribuire cu informatiile aferente situatiei lor. Documentele justificative care probeaza indeplinirea celor asumate prin completarea DUAE, respectiv actul juridic doveditor de infiintare si functionare a furnizorului de servicii sociale public/privat respectiv actul de infiintare a furnizorului public de servicii sociale sau dupa caz statutul furnizorului privat de servicii sociale, insotit de ultimul act aditional cu ultima hotarare judecatoreasca dupa caz, precum si Certificatul de inscriere in Registrul Asociatiilor si Fundatiilor, sau in cazul ofertantilor straini, documente echivalente emise in tara de rezidenta, urmeaza sa fie prezentate, la solicitarea autoritatii contractante, doar de catre ofertantul clasat pe locul I in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor.

Ofertantul/furnizorul de servicii sociale public sau privat trebuie sa faca dovada ca dispune (proprietate, inchiriere, leasing, comodat sau alte forme de punere la dispozitie) de un mijloc de transport, in functie de nevoile individuale ale beneficiarilor pentru indeplinirea corespunzatoare a contractului. Se vor prezenta documente edificatoare din care sa reiasa modul de dispunere.

In cazul in care ofertantul/furnizorul de servicii beneficiaza de sustinerea unui tert, se asociaza sau subcontracteaza, se vor prezenta datele de identificare atat pentru ofertant/furnizor de servicii, cat si pentru tert/asociat/subcontractant. In cazul ofertelor care nu sunt insotite de garantia de participare, in cuantumul, forma si perioada de valabilitate solicitate in Documentatia de Atribuire, comisia de evaluare va clarifica cu ofertantii in maxim 3 zile lucratoare de la data limita de depunere a ofertelor, sub sanctiunea respingerii ofertei ca inacceptabila.
In cazul in care se constata ca ofertele clasate pe primul loc au punctaje egale, departajarea ofertelor se va face prin reofertarea procentului de cofinantare, astfel autoritatea contractanta va solicita clarificari prin intermediul SEAP in vederea incarcarii electronice de catre ofertanti/furnizori de servicii de documente care contin noi preturi pentru departajarea ofertelor.
