In conditiile in care in urma evaluarii ofertelor conform criteriului de atribuire se inregistreaza 2 sau mai multe oferte la egalitate pe primul loc se va proceda la solicitarea unei noi oferte financiare prin intermediul SEAP.
Pentru demonstrarea indeplinirii criteriilor de calificare prevazute in Fisa de Date a achizitiei, ofertantul are dreptul si obligatia de a prezenta initial doar documentul unic european (DUAE) accesand urmatorul link:https//ec.europa.eu/growth/tools-databases/espd/filter. Prin acest document se confirma ca sunt indeplinite cerintele de calificare astfel cum au fost solicitate in documentatia de atribuire.
Se vor completa ulterior documentele dupa cum urmeaza: -ofertantul are obligatia de a prezenta/completa certificatele/documentele edificatoare care probeaza/confirma indeplinirea cerintelor de calificare, atunci cand primeste din partea autoritatii contractante o solicitare in acest sens, in termenul prevazut in respectiva solicitare. Acest termen nu va mai mic de 3 zile lucratoare. -Autoritatea contractanta se va asigura ca ofertantul a carei oferta este declarata castigatoare a prezentat, nu mai tarziu de incheierea raportului procedurii de atribuire, certificatele/documentele solicitate. -In cazul unei oferte comune, situatia personala si capacitatea de exercitare trebuie dovedite de fiecare dintre asociati in parte, iar cerintele privind situatia economico-financiara si capacitatea tehnica si/sau profesionala vor fi indeplinite prin cumul. Solicitarile de clarificari si raspunsurile la solicitarile de clarificari se vor face in SEAP utilizand facilitatile oferite in acest sens de sistem.
In cazul in care, din orice motiv, informatiile suplimentare sau raspunsul entitatii contractante la solicitarea de clarificari nu sunt transmise in termenul legal (6 zile / 4 zile ? urgenta inainte de termenul stabilit pentru depunerea ofertelor, sau in cazul in care documentele achizitiei se modifica semnificativ, entitatea contractanta va prelungi perioada stabilita initial pentru depunerea solicitarilor de participare.
In acest caz, entitatea contractanta va revizui DUAE aferent prezentei proceduri de atribuire a contractului de acordului-cadru in cauza, in situatia in care criteriile de calificare si selectie sunt modificate in sensul micsorarii nivelurilor acestora sau eliminarii lor. Termenul de finalizare a contractului nu va depati data de 10.12.2017.
