Autoritatea contractanta poate solicita candidatilor/ofertantilor sa depuna toate sau o parte dintre documentele justificative ca dovada a informatiilor cuprinse in DUAE, in orice moment pe durata desfasurarii unei proceduri de atribuire, daca acest lucru este necesar pentru a asigura desfasurarea corespunzatoare a procedurii.

? Modul in care se poate accesa DUAE in vederea completarii de catre operatorii economici interesati este https://ec.europa.eu/growth/tools-databases/espd/filter conform art. 20 alin. (6) din HG nr. 395/2016

? In cazul in care, in urma stabilirii clasamentului final conform criteriului de atribuire, comisia de evaluare constata ca sunt doua sau mai multe oferte cu acelasi pret, autoritatea contractanta va solicita clarificari prin intermediul SEAP, in vederea incarcarii electronice de catre operatorii economici respectivi de documente care contin noi preturi. In cadrul procesului de reofertare prin intermediul SEAP, ofertantii au obligatia de a imbunatati sau de a mentine oferta initiala transmisa in SEAP. In situatia in care ofertantii nu transmit noile oferte in conformitate cu solicitarile autoritatii contractante sau ofertele transmise nu sunt mai avantajoase decat cele initiale sau cel putin la nivelul acestora, autoritatea contractanta va respinge ofertele respective ca fiind neconforme. Pe parcursul procesului de reofertare, autoritatea contractanta poate solicita clarificari cu privire la documentele primite de la ofertanti, fiind incidente dispozitiile alin. (1) art. 136 din HG 395/2016.
? Orice comunicare, solicitare, informare, notificare si altele asemenea vor fi incarcate in SEAP si vor fi semnate cu semnatura electronica extinsa, bazata pe un certificat calificat, eliberat de un furnizor de servicii de certificare acreditat in conditiile legii.
? Referitor la clarificari:

Solicitarile de clarificari se vor adresa in limba romana, prin intermediul S.E.A.P., Sectiunea ?Intrebari din cadrul procedurii de atribuire derulate prin mijloace electronice iar raspunsurile la acestea vor fi publicate in limba romana, in SEAP la Sectiunea ?Documentatie, clarificari si decizii din cadrul anuntului de participare. Pentru transmiterea solicitarilor de clarificari operatorii economici trebuie sa se inregistreze in S.E.A.P. ( www.e-licitatie.ro ):

? ca operator economic;
? ca participant la procedura de atribuire.
Comisia de evaluare va transmite solicitarile de clarificare in legatura cu oferta, in limba romana, prin utilizarea facilitatilor tehnice disponibile in SEAP (Sectiunea ?Intrebari). Operatorii economici vor transmite raspunsurile la clarificari si eventualele documente solicitate pe parcursul evaluarii ofertelor, prin intermediul SEAP (Sectiunea ?Intrebari), integral in sectiunea corespunzatoare respectivei solicitari, in format electronic, sub forma unuia sau a mai multor documente/fisiere distincte semnate cu semnatura electronica conform prevederilor Legii nr. 455/2001 privind semnatura electronica.
Toate documentele/inscrisurile referitoare la procedura de atribuire, transmise de catre ofertanti (oferta, documente de calificare, solicitari de clarificari, raspunsuri la solicitarile de clarificari) vor fi redactate in limba romana sau vor fi prezentate insotite de traducerea autorizata in limba romana, in cazul persoanelor juridice/fizice straine, ce doresc a participa la procedura.
Toate cerintele sunt obligatorii.
Data limita de transmitere a raspunsului la clarificari: conform prevederilor art. 160 si 161 din Legea nr. 98/2016.
?In cazul ofertantilor de alta nationalitate decat cea romana, documentele vor fi transmise in limba de origine, insotite de o traducere autorizata in limba romana.
