Section III: Legal, economic, financial and technical information

III.1.1) Deposits and guarantees required:
Garantia de participare se constituie in conformitate cu prevederile art. 36 din Normele metodologice aprobate prin H.G. nr. 395/2016 cu modificarile si completarile ulterioare, respectiv 1 % din valoarea estimata a acordului cadru. Perioada de valabilitate a garantiei de participare: 90 zile de la data-limita stabilita pentru primirea ofertelor.
Daca garantia se constituie prin virament bancar, transferul va fi efectuat in contul RO19TREZ2915005XXX000154, Cod fiscal 5002142, al autoritatii contractante, deschis la TREZORERIA CRAIOVA.
Garantia de participare se poate constitui si prin depunerea in numerar, la casieria autoritatii contractante.
Pentru garantiile constituite prin instrumente de garantare, instrumentul de garantare trebuie sa prevada ca plata garantiei de participare se va executa neconditionat, respectiv la prima cerere a beneficiarului, pe baza declaratiei acestuia cu privire la culpa persoanei garantate.
Dovada constituirii garantiei de participare prin oricare dintre modalitati se va depune scanata in SEAP (semnata obligatoriu cu semnatura electronica extinsa). Echivalenta pentru o garantie de participare depusa in alta valuta se va face la cursul BNR din data anterioara datei limita de depunere a ofertelor cu 5 zile. In cazul depunerii de oferte in asociere, garantia de participare trebuie constituita in numele asocierii si sa mentioneze ca acopera in mod solidar toti membrii grupului de operatori economici.
Garantia de participare emisa in alta limba decat romana va fi insotita de traducerea autorizata in limba romana.
Cuantumul garantiei de participare: anexaB. Furnizorul se obliga sa constituie garantia de buna executie a contractului in cuantum de 5 % din valoarea contractului, fara T.V.A., doar pentru contractele subsecvente a caror valoare este egala sau mai mare decat valoarea prevazuta la art. 7 alin. (1) din Legea 98/2016, in termen 5 zile lucratoare de la data semnarii contractului de achizitie publica/contractului subsecvent.
Garantia de buna executie se constituie prin virament bancar sau printr-un instrument de garantare emis in conditiile legii de o societate bancara sau de o societate de asigurari, care devine anexa la contract. In cazul in care valoarea garantiei de buna executie este mai mica de 5.000 de lei, autoritatea contractanta
are dreptul de a accepta constituirea acesteia prin depunerea la casierie a unor sume in numerar.

Modalitatea prin care poate fi demonstrata indeplinirea cerintei: se va completa DUAE de catre operatorii economici participanti la procedura de atribuire (inclusiv eventualii terti si subcontractanti) cu informatiile aferente situatiei lor.
Documentele justificative care probeaza indeplinirea celor asumate prin completarea DUAE urmeaza a fi prezentate, la solicitarea autoritatii contractante, doar de catre ofertantul clasat pe locul I in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor.
Aceste documente vor fi:
1.? certificate constatatoare privind lipsa datoriilor RESTANTE cu privire la plata impozitelor, taxelor sau a contributiilor la bugetul general consolidat (buget local, buget de stat etc.) la momentul prezentarii;
2.? cazierul judiciar al operatorului economic si al membrilor organului de administrare, de conducere sau de supraveghere al respectivului operator economic, sau a celor ce au putere de reprezentare, de decizie sau de control in cadrul acestuia, asa cum rezulta din certificatul constatator emis de ONRC/ actul constitutiv.
3.? dupa caz, documente prin care se demonstreaza faptul ca operatorul economic poate beneficia de derogarile prevazute la art. 166 alin.(2), art. 167 alin. (2), art. 171 din Legea 98/2016 privind achizitiile publice;

Operatorii economici nerezidenti (straini) au dreptul de a prezenta orice documente edificatoare, eliberate de autoritatile din tara in care acestia sunt rezidenti prin care sa dovedeasca indeplinirea obligatiilor restante de plata a impozitelor catre bugetul de stat si bugetul local, in conformitate cu legislatia din tara de rezidenta. Documentele se vor prezenta insotite de traducerea autorizata a acestora in limba romana.
2. Ofertantii, tertii sustinatori subcontractantii nu trebuie sa se regaseasca in situatiile prevazute la art.60, din Legea nr. 98/2016
Modalitatea prin care poate fi demonstrata indeplinirea cerintei: se va completa DUAE de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei lor.

Nedepunerea DUAE odata cu oferta (inclusiv pentru asociat/tert sustinator) atrage respingerea acesteia ca inacceptabila.
Nedepunerea odata cu oferta, a DUAE, a angajamentului ferm al tertului sustinator din care rezulta modul efectiv in care se va materializa sustinerea acestuia, sau dupa caz, a acordului de subcontractare si/sau a acordului de asociere, poate face subiectul unei solicitari de clarificare. Operatorii economici ce depun oferta trebuie sa dovedeasca o forma de inregistrare in conditiile legii din tara de rezidenta, sa reiasa ca operatorul economic este legal constituit, ca nu se afla in niciuna dintre situatiile de anulare a constituirii, precum si faptul ca are capacitatea profesionala de a realiza activitatile care fac obiectul contractului.
