Description of Action: This acquisition is conducted under the authority of the Multiple Award Schedule Program. The material or service is listed in part 3 below and is a sole source, therefore, consideration of the number of contractors required by FAR Subpart 8.4 Federal Supply Schedules, is precluded for the reasons indicated below.

This is for service, warranty work and Certification Testing Tapes for the 7 CMOP sites, located in: Charleston SC, Chelmsford MA, Murfreesboro TN, Hines IL, Leavenworth KS, Dallas TX, and Tucson AZ.
Data Security Inc. is the manufacturer of the HD-5T degaussers and the only provider of warranties. This is proprietary to Data Security Inc., and they have no distributors.
Description of Supplies or Services required to meet the Agency s need
The CMOP National IT Office (770 AZ) is requesting one year of on-site service maintenance at the seven CMOP sites. The NAICS Code for the requested service is 541511, computer software support services, custom.
ORDER AGAINST FSS: Authority of the Multiple Award Schedule Program, Title III of the Federal Property and Administrative Services Act of 1949 (41 USC 251, et seq.); Title 40 USC 501, Services for Executive Agencies; and Section 803 of the National Defense Authorization Act of 2002 (PL 107-107) and implemented by FAR 8.405-6. Mark the applicable exception:
An urgent and compelling need exists, and following the procedures would result in unacceptable delays(FAR 8.405-6(a)(1)(i)(A);
Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized; (FAR 8.405-6(a)(1)(i)(B));
In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order and the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order was not previously issued under sole-source or limited-sources procedures (FAR 8.405-6(a)(1)(i)(C)); or
Items peculiar to one manufacturer. An item peculiar to one manufacturer can be a particular brand name, product, or a feature of a product, peculiar to one manufacturer). A brand name item, whether available on one or more schedule contracts, is an item peculiar to one manufacturer (FAR 8.405-6(b)).
Rational/explanation to support cited authority:
All seven sites use the HD-5T Degausser equipment and they must have the extended warranty and the certification test tape for one year. Degausing is the process of reducing or eliminating an unwanted magnetic field or data stored on tape and disk media, such as computer and laptop hard drives, diskettes, reels, cassettes, and cartridge tapes. This warranty service and support is proprietary to Data Security Inc. Only Data Security can perform maintenance virtually or by phone. They have no authorized re-sellers of this service.
It is in the best interest of the CMOP to award to Data Security Inc. because we previously bought this equipment from them and the maintenance and updates can only be provided by them.
I posted a Request for Information/Sources Sought on September 13, 2017 seeking a SDVOSB or VOSB that could perform this warranty work. I got no responses from the posted RFI, but Ms. Kimberly Heimes, Contracts Administrator at Data Security, contacted me to tell me this is proprietary to Data Security.
Note that this determination satisfies the requirements of FAR 8.405-6. The requirement to prepare a written justification IAW FAR 6.303 does not apply to Federal Supply Schedules.
