Description: NOTICE OF INTENT TO AWARD A SOLE SOURCE

The Department of Veterans Affairs (VA), Network Contracting Office (NCO) 9, intends to issue a Firm Fixed Priced contract under the authority of Federal Acquisition Regulation (FAR) 8.405-6(b), Items peculiar to one manufacturer. Award is anticipated to occur on or about December 15, 2022 to Nobel Biocare LLC. The period of performance will be for sixty calendar days after issuance of the notice to proceed.

This requirement includes the purchase of dental implant equipment and supplies in support of the Dental Service at the Knoxville Dental Clinic of the James H. Quillen Veterans Affairs Medical Center. Equipment and supplies includes items such as various sizes of drivers, depth probes, wrenches, handles, screwdrivers, drills, screw taps, screws, healing abutments, and snappy abutments as well as various conical connections and are required for the activation of a new dental clinic in Knoxville, TN to serve the expanding veteran population. These will be used to replace teeth after extraction, where and when clinically indicated. Contractor will be responsible for the delivery of the dental implant equipment and supplies to the James H. Quillen Veterans Affairs Medical Center in a timely manner.

The basis for this non-competitive sole source award to Nobel Biocare, LLC is due to this contractor provides the equipment and supplies to James H. Quillen VAMC. Many of the veteran patients seen at the James H. Quillen VAMC will also be seen at the Knoxville Dental Clinic. Some of these patients already have Nobel Biocare dental implants and will require the same brand of component for any follow-up work. Additionally, some dentists and dental assistants will work at both facilities and will need continuity of equipment and material to provide the best patient care. As a result, any contractor other than Nobel Biocare, LLC that would provide the dental implant equipment and supplies to the facility may result in unintentional extra treatments for veteran patients and/or a higher probability of mistakes by dentists and dental assistants. Both could result in extra discomfort for the veteran patients and higher cost for the government.

The North American Industry Classification System (NAICS) code for this requirement is 339114 with the size standard of 750. The applicable Product Service Code is 6520. This notice of intent is not a request for proposals or quotes. However, all responsible service-disabled veteran owned small business and veteran owned small business sources may submit a technical capabilities/narrative that proves by clear and convincing evidence that similar dental implant supplies and equipment are available that will provide comparable capabilities for the facility. If said technical capabilities/narrative is received within fourteen (14) calendar days of publication of this notice, the narrative may be considered by NCO 9. All responses must be submitted to the Government point of contact at the email address shown below. A determination by the Government not to open the requirement to competition based upon the responses to this notice is solely within the discretion of the Government. Information received will generally be considered solely for the purpose of determining whether to conduct a competitive procurement.
