NOTICE TO BIDDERS
The County of Harnett will receive proposals for the Airfield Lighting Rehabilitation project at the office of
the Harnett County Purchasing Agent until December 15, 2020 at 2:00 p.m. Bids received after the stated
time will not be accepted. All accepted proposals will be publicly opened and read aloud at the office of the
Harnett County General Services department on December 15, 2020 at 2:30 p.m.
The work may be generally described as the replacement and removal of the existing taxiway and runway
lighting systems with new LED lights and signs, conduit, cable, and fixtures; the replacement of the
existing PAPI-2s; installation of new REILs; and installation of a new AWOS.
Bid security in the form of a bid bond equal to 5% of the total bid is required. Contract security in the form
of 100% Performance and Payment Bonds will be required.
No bid may be withdrawn after closing time for the receipt of proposals for a period of ninety (90) calendar
days.
A Pre-Bid Conference will be held at the Harnett Regional Jetport on December 1, 2020 at 9:00 a.m. The
purpose of this meeting will be to familiarize the prospective bidders with the proposed project. The meeting
will cover contract scope, bid items, schedule requirements, and any questions from those in attendance.
A representative of the Owner and the Engineer will be on hand to respond to questions from potential
Bidders in attendance. Attendance is highly recommended, but not mandatory.

NOTICE OF REQUIREMENT FOR AFFIRMATIVE ACTION to
ENSURE EQUAL EMPLOYMENT OPPORTUNITY
1. The Offeror's or Bidder's attention is called to the "Equal Opportunity Clause" and the "Standard Federal
Equal Employment Opportunity Construction Contract Specifications" set forth herein.
2. The goals and timetables for minority and female participation, expressed in percentage terms for the
Contractor's aggregate work force in each trade on all construction work in the covered area, are as
follows:

also is subjected to the goals for both its federally involved and non-federally involved construction.

The contractor's compliance with the Executive Order and the regulations in 41 CFR Part 60-4 shall be
based on its implementation of the Equal Opportunity Clause, specific affirmative action obligations
required by the specifications set forth in 41 CFR 60-4.3(a), and its efforts to meet the goals. The hours
of minority and female employment and training must be substantially uniform throughout the length of
the contract, and in each trade, and the Contractor shall make a good faith effort to employ minorities
and women evenly on each of its projects. The transfer of minority or female employees or trainees
from Contractor to Contractor or from project to project, for the sole purpose of meeting the Contractor's
goals, shall be a violation of the contract, the Executive Order, and the regulations in 41 CFR Part 60-
4. Compliance with the goals will be measured against the total work hours performed.
3. The Contractor shall provide written notification to the Director of the Office of Federal Contract
Compliance Program (OFCCP), within ten (10) working days of award of any construction subcontract
in excess of $10,000.00 at any tier of construction work under the contract resulting from this
solicitation. The notification shall list the name, address, and telephone number of the subcontractor;
employer identification number of the subcontractor; estimated dollar amount of the subcontract;
estimated starting and completion dates of the subcontract; and the geographical area in which the
subcontract is to be performed.
4. As used in this notice and in the contract resulting from this solicitation, the "covered area" is Erwin,
Harnett County, North Carolina.
CIVIL RIGHTS TITILE VI SOLICITATION NOTICE
The County of Harnett, in accordance with the provisions of Title VI of the Civil Rights Act of 1964 (78
Stat. 252, 42 USC §§ 2000d to 2000d-4) and the Regulations, hereby notifies all bidders or offerors that it
will affirmatively ensure that any contract entered into pursuant to this advertisement, [select
disadvantaged business enterprises or airport concession disadvantaged business enterprises] will be
afforded full and fair opportunity to submit bids in response to this invitation and will not be discriminated
against on the grounds of race, color, or national origin in consideration for an award.
BUY AMERICAN PREFERENCE
The Contractor agrees to comply with 49 USC § 50101, which provides that Federal funds may not be
obligated unless all steel and manufactured goods used in AIP funded projects are produced in the
United States, unless the Federal Aviation Administration has issued a waiver for the product; the product
is listed as an Excepted Article, Material Or Supply in Federal Acquisition Regulation subpart 25.108; or is
included in the FAA Nationwide Buy American Waivers Issued list. A bidder or offeror must complete and
submit the Buy America certification included herein with their bid or offer. The Owner will reject as
nonresponsive any bid or offer that does not include a completed Certificate of Buy American
Compliance.
CERTIFICATION OF OFFERER/BIDDER REGARDING DEBARMENT
By submitting a bid/proposal under this solicitation, the bidder or offeror certifies that neither it nor its
principals are presently debarred or suspended by any Federal department or agency from participation
in this transaction.
Additional mandatory federal requirements apply to this solicitation and will be made a part of any
contract awarded:
a. Davis Bacon and Related Acts, 29 CFR Parts 1, 3, and 5 as well as 2 CFR § 200, Appendix
II(D).
b. 49 USC § 50104 and 49 CFR part 30 (Foreign Trade Restriction).

c. Disadvantaged Business Enterprises participation Title 49 CFR Part 26 will be required as
described in Subpart D of Regulation 49 CFR Part 26, and all pertinent amendments. The
DBE goal for this project is 0.0% (0.0% MBE and 0.0% WBE).
d. 2 CFR part 180 (Subpart C), 2 CFR part 1200, and DOT Order 4200.5 (Debarment and
Suspension).
e. 31 USC § 1352 Byrd Anti-Lobbying Amendment, 2 CFR part 200, Appendix II(J), and 49

The bidders must be properly licensed under Chapter 87, General Statues of North Carolina (G.S. 87-15).
Bidders submitting a bid must be registered with the North Carolina Department of Transportation (NCDOT)
as being a “Prequalified Bidder” at the time of the Bid Opening. Subcontractors working on the project must
be registered as a “Prequalified Bidder” or “Prequalified Subcontractor” prior to the start of construction.

The County of Harnett reserves the right to waive any informalities or irregularities in or reject any or all
