Bid Opening will be held at: 3331 North First Street, Building A Conference Room A108 San Jose, California 95134 on August 9, 2017 at 2:00 p.m. Bids received after the date and time stated above will be rejected as nonresponsive. It is highly recommended that Bids be hand-delivered. Contract documents (herein referred to as Contract Documents) specifying the requirements of the work to be performed (Work), the terms of the contract between VTA and the successful Bidder, and the details of the bidding procedure can be found at the VTA website. Go to www.vta.org/procurement and select General Information which will lead you through the registration process. Once registered, Bidders can view and download information regarding this procurement, including the Contract Documents. There is no charge for downloading these documents. It is highly recommended that prospective Bidders acquire the Contract Documents directly from the VTA website in order to bid on this Project and be assured that their Bids include all addenda. Bids that do not acknowledge receipt of addenda may be considered nonresponsive. By registering as a VTA vendor, Bidder will automatically receive notifications by email of upcoming VTA bidding opportunities. The time of completion of the Work is 145 calendar days, commencing on the twentieth (20th) calendar day following issuance of the Notice of Award (as defined in Section 2.3) by VTA. The Bidder to whom the Contract will be awarded (Contractor) must, at the time of Bid submittal, possess current licenses in the following classifications issued by the California Department of Consumer Affairs, Contractors State License Board (CSLB): Class A. Contractors subcontractors must also be properly licensed. Contractor and all subcontractors used for the Contract shall be registered, pursuant to Section 1725.5 of the California Labor Code, at the time of Bid Opening with the California State Department of Industrial Relations (DIR) and shall pay their employees the general prevailing rate of per diem wages as incorporated herein by reference. These wage rates are available through the DIR, http://www.dir.ca.gov/DLSR/PWD/ (Labor Code Section 1770. et seq.) and at the Contracts Office of VTA at the above address. This Project is subject to compliance monitoring and enforcement by the DIR. VTA is an Equal Opportunity employer. Contractors shall comply with the Equal Opportunity requirements as set forth in Contract Documents. In the performance of this Contract, Contractor and its subcontractors shall not unlawfully discriminate, harass or allow harassment, against any employee or applicant for employment because of sex, gender, gender identity, gender expression, race, color, ancestry, religious creed, national origin, physical disability (including HIV and AIDS), mental disability, medical condition (cancer), genetic information, marital status, age (over 40), sexual orientation, or military and veteran status. In addition, Contractors and subcontractors shall not unlawfully deny any of their employees family care leave or discriminate against them on the basis of having to use family care leave. VTA affirms that disadvantaged and small business enterprises will be afforded full opportunity to submit Bids in response to this Invitation for Bid. VTA has not established a specific Small Business Enterprise (SBE) goal for this Contract. However, Bidder agrees to cooperate with VTA in meeting VTAs overall goal of 19% annual utilization of Small Business Enterprises. In this regard, Contractor will use its best efforts to ensure that SBEs shall have an equitable opportunity to compete for subcontract work under this Contract. All SBE firms listed on Bid Form #4 must be certified by VTAs Office of Business Diversity Program (OBDP), the California Unified Certification Program (CUCP) or be accepted by VTA at the time of bid to be counted toward the contract SBE goal. Bidders must comply with VTA's Policy on Utilization of Small Business Enterprises (SBEs), as set out in Section 7.0, GC-13. Bid Form #4 and #4a are required to be submitted in accordance with Section 3.0, Instruction to Bidders, 7.10 SBE Documentation. It is the Bidders sole responsibility to verify each subcontractors certification as a SBE to VTA. The list of VTA SBEs is available at http://www.vta.org/about-us/doing-business-with-vta-search-for-sbes. The VTA SBE application is available at http://www.vta.org/osdb. Bidders security in the form of cash, a cashiers check made payable to VTA, a certified check made payable to VTA or a Bidders Bond executed by an admitted surety insurer made payable to VTA, is required on all Bids. Bids shall be submitted on the forms provided in these Contract Documents in signed original as further set forth in Section 3.0, Instruction to Bidders. In accordance with California Public Contract Code Section 22300, Contractor may substitute securities for any money withheld under GC-59, Progress Payments of Section 7.0 General Conditions. At Contractors request and expense, securities equivalent to the amount withheld shall be deposited with VTA, or with a state or federally chartered bank as the escrow agent, who shall pay such monies to Contractor. Upon satisfactory completion of the Contract (as defined herein), the securities shall be returned to Contractor. VTA reserves the right to reject any or all Bids, to waive any informality in Bids, and/or to accept or reject any items of the Bid.
