VI.2) Additional information:
1. Caietul de sarcini face parte integranta din documentatia pentru elaborarea si prezentarea ofertei si constiuie ansamblul cerintelor pe baza carora se elaboreaza propunerea tehnica.
2. Cerintele impuse in caietul de sarcini vor fi considerate ca fiind minimale. In acest sens, orice oferta prezentata care se abate de la prevederile caietului de sarcini, va fi luata in considerare numai in masura in care propunerea tehnica presupune asigurarea unui nivel calitativ superior cerintelor din caietul de sarcini.
3. Neindeplinirea tuturor cerintelor minimale mentionate in caietul de sarcini atrage declararea ca neconforma a ofertei, in conformitate cu prevederile art. 137 alin. 2 lit. a din HG 395/2016.
4. Orice denumire comerciala mentionata in caracteristicile tehnice minimale care ar putea individualiza un anumit producator va fi interpretata cu mentiunea ?sau echivalent.
5. In cazul in care, pe parcursul executarii acordului cadru, se constata ca anumite elemente ale propunerii tehnice sunt inferioare sau nu corespund cerintelor prevazute in caietul de sarcini, prevaleaza prevederile caietului de sarcini, conform art. 147 alin. 2 din HG 395/2016.
6. Ofertantii pot depune oferta pentru 1 sau mai multe loturi, avand obligatia sa incarce oferta si toate documentele acesteia la fiecare lot la care participa, in caz contrar oferta va fi neconforma.
7. In cazul in care 2 sau mai multe oferte sunt situate pe primul loc, autoritatea contractanta solicita ofertantilor o noua propunere financiara, iar acordul cadru va fi atribuit ofertantului a carui noua propunere financiara are pretul cel mai scazut.
