Garantia se constituie conform art. 36 alin. 1, 2, 3, 4, din HG 395/2016. In cazul operatorilor care se asociaza in vederea depunerii unei oferte commune, garantia de participare poate fi constituita de oricare dintre operatorii economici asociati. Instrumentul de garantare trebuie sa fie insotit de chitanta de plata a primei de asigurare. Plata prin virament bancar se va face in contul RO66TREZ7025006XXX005592 deschis la Trezoreria Sector 2, CIF 17093691, beneficiar DGASPC Sector 2. In cazul in care valoarea garantiei este mai mica de 5000 lei,se constituie si prin depunere la casieria autoritatii contractante (Str. Olari nr. 11-13, Sector 2, Bucuresti), in numerar.
Dovada constituirii garantiei de participare trebuie sa fie prezentata cel mai tarziu la data si ora limita de depunere a ofertelor, conf. art. 36 alin. 7 din HG nr. 395/2016, in caz contrar oferta va fi respinsa.
Valabilitatea va fi de minim 120 zile cel putin egala cu valabilitatea ofertei.
Garantia se restituie conf. prev. art. 38 alin 1, 2, 3, 4, 5 din HG 395/2016. Autoritatea contractanta are obligatia de a retine garantia de participare conform art. 37
alin. 1 din HG 395/2016. Garantia de buna executie va fi de 2 % din pretul contractului subsecvent fara TVA. Modalitati de constituire: ? scrisoare de garantie bancara
? garantia de buna executie se poate constitui printr-un instrument de garantare emis in conditiile legii de o societate de asigurari;
? virament bancar conf. art. 40 din HG nr. 395/2016, CIF 17093691, beneficiar DGASPC Sect. 2;
- depunere in cont deschis pentru garantii de buna executie la Trezorerie, deschis in favoarea DGASPC Sector 2; ?Contractantul are obligatia de a deschide la unitatea Trezoreriei Statului din cadrul organului fiscal competent, in administrarea acestuia un cont de disponibil distinct la dispozitia autoritatii contractante Conform Hotararii 1045/18.10.2011. - in cazul in care valoarea garantiei de buna executie este mai mica de 5 000 de RON, se accepta constituirea acesteia prin depunerea la casierie a unor sume in numerar de luni pana joi intre orele 8:30-16:00 si vineri intre orele 8:30-13:30

Eliberarea certificatului se va face conform prevederilor art. 112 alin. 3 din Codul de procedura fiscala referitoare la modalitatea de emitere a certificatelor fiscale (form-tip eliberate de autoritatile competente din tara in care candidatul / ofertantul este rezident) original/copie lizibila conf. cu originalul semnata si stampilata - (Se vor prezenta orice documente edificatoare, eliberate de autoritati competente din tara in care acestia sunt rezidenti, prin care sa dovedeasca indeplinirea obligatiilor scadente de plata a impozitelor catre bugetul de stat si bugetul local, in conformitate cu legislatia din tara de rezidenta; traducere autorizata in limba romana de traducator autorizat de Min.de Just.- (daca este cazul);
Declaratie pe proprie raspundere privind neincadrarea in disp.art. 59 Ofertantul / Candidatul / Ofertantul asociat / Subcontractantul / Tertul sustinator care are drept membri in cadrul consiliului de administratie / organ de conducere ori de supervizare si/sau are actionari ori asociati persoane care sunt sot/sotie, ruda sau afin pana la gradul al doilea inclusiv ori care se afla in relatii comerciale, astfel cum sunt acestea prevazute la art. 60, cu persoane ce detin functii de decizie in cadrul autoritatii contractante, este exclus din procedura de atribuire

Se va completa DUAE ? documentele justificative vor fi prezentate la solicitarea autoritatii contractante, doar de catre ofertantul clasat pe primul loc in clasamentul intermediar, in urma aplicarii criteriului de atribuire.
Ofertantul clasat pe primul loc dupa aplicarea criteriului de atribuire asupra ofertelor admisibile face dovada neincadrarii in situatiile de excludere, prin prezentarea, la solicitarea autoritatii contractante, a urmatoarelor informatii si documente:
? cazierul judiciar al operatorului economic si al membrilor organului de administrare, de conducere sau de supraveghere al respectivului operator economic, sau a celor ce au putere de reprezentare, de decizie sau de control in cadrul acestuia, asa cum rezulta din certificatul constatator emis de ONRC/actul constitutiv;
? certificate constatatoare privind lipsa datoriilor cu privire la plata impozitelor, taxelor sau a contributiilor la bugetul general consolidat (buget local, buget de stat etc.) la momentul prezentarii;
? dupa caz, documente prin care se demonstreaza faptul ca operatorul economic poate beneficia de derogarile prevazute la art. 166 alin. (2), art. 167 alin. (2), art. 171 din Legea 98/2016 privind achizitiile publice;
? alte documente edificatoare, dupa caz.
Se solicita tuturor ofertantilor, ca odata cu depunerea DUAE sa prezinte angajamentul tertului sustinator (impreuna cu documente anexe la angajament, transmise acestora de catre tert/tertii sustinatori, din care rezulta modul efectiv in care se va materializa sustinerea acestuia/acestora), acordul de asociere si acordul de subcontractare. Documentele justificative care probeaza cele asumate in angajamente/acorduri vor fi prezentate la solicitarea autoritatii contractante, doar de catre ofertantul clasat pe primul loc in clasamentul intermediar, in urma aplicarii criteriului de atribuire.
Ofertantii, tertii sustinatori si subcontractantii nu trebuie sa se regaseasca in situatiile prevazute la art. 164, 165 si 167 din Legea nr. 98/2016.
Modalitatea prin care poate fi demonstrata indeplinirea cerintei: se va completa DUAE de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei lor. Documentele justificative care probeaza indeplinirea celor asumate prin completarea DUAE urmeaza a fi prezentate, la solicitarea autoritatii contractante, doar de catre ofertantul clasat pe locul I in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor.
Aceste documente pot fi: certificate constatatoare privind lipsa datoriilor restante cu privire la plata impozitelor, taxelor sau a contributiilor la bugetul general consolidat (buget local, buget de stat etc.) la momentul prezentarii; dupa caz, documente prin care se demonstreaza faptul ca operatorul economic poate beneficia de derogarile prevazute la art. 166 alin. (2), art. 167 alin. (2), art. 171 din Legea 98/2016 privind achizitiile publice; alte documente edificatoare, dupa caz. 3).
Se va avea in vedere obligatia completarii si prezentarii initiale a DUAE de catre ofertanti/candidati (inclusiv pentru asociati/subcontractanti/terti sustinatori) ca prima dovada a neincadrarii in situatiile de excludere si a indeplinirii cerintelor de capacitate.
Se vor depune odata cu DUAE urmatoarele documente: angajamentul ferm al tertului sustinator din care rezulta modul efectiv in care se va materializa sustinerea acestuia, a acordului de subcontractare si /sau a acordului de asociere, dupa caz. Nedepunerea acestora odata cu DUAE, constitue temei pentru solicitarea de clarificari pentru eventualele inadvertente de forma ale informatiilor cuprinse in DUAE, atat ale ofertantului/candidatului, cat si ale subcontractantului/tertului sustinator, acest lucru fiind necesar pentru a asigura desfasurarea corespunzatoare a procedurii de atribuire. Certificat constatator emis de Oficiul Registrului Comertului ? original/copie conform cu originalul semnata si stampilata. Informatiile cuprinse in certificatul constatator trebuie sa fie reale/actuale la momentul prezentarii certificatului;
Certificat constatator emis de ONRC din care sa rezulte obiectul de activitate al respectivului operator economic. Obiectul contractului trebuie sa aiba corespondent in codul CAEN din certificatul constatator emis de ONRC.
Documentele justificative care probeaza indeplinirea celor asumate prin completarea DUAE, respectiv certificat constatator emis de ONRC, sau in cazul ofertantilor straini, documente echivalente emise in tara de rezidenta, urmeaza sa fie prezentate, la solicitarea autoritatii contractante, doar de catre ofertantul clasat pe locul I in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor.
