Section III: Legal, economic, financial and technical information

III.1) Conditions relating to the contract
III.1.1) Deposits and guarantees required:
Cuantumul garantiei de participare pentru fiecare lot se regaseste in anexa B ? Loturi si reprezinta 1 % din valoarea fara TVA pentru fiecre lot ofertat. Perioada de valabilitate este de 90 de zile de la termenul limita de depunere a ofertelor.
Garantia de participare se va constitui potrivit art. 36 din HG nr. 395/2016: prin virament bancar in contul nr. RO64TREZ2315006XXX016691 ? Trezoreria Constanta, CUI 4301103 sau printr-un instrument de garantare emis in conditiile legii de o societate bancara ori o societate de asigurari.
Instrumentul de garantare trebuie sa prevada ca plata garantiei de participare se va executa neconditionat, respectiv la prima cerere a beneficiarului, pe baza declaratiei acestuia cu privire la culpa persoanei garantate. GP trebuie sa fie irevocabila. In cazul constituirii garantiei de participare in alta moneda, se va lua in considerare cursul de schimb afisat de catre BNR valabil la data publicarii anuntului de participare.
Dovada constituirii garantiei se va atasa in SEAP in copie scanata dupa original, cel tarziu la data si ora limita de depunere a ofertelor.
Garantia de buna executie: 5 % din valoarea fara TVA a contractului.
Garantia de buna executie se va constitui, conform art. 39 si 40 din HG nr. 395/2016: prin virament bancar sau printr-un instrument de garantare emis in conditiile legii de o societate bancara sau de o societate de asigurari, care devine anexa la contract. Garantia trebuie sa fie irevocabila. Instrumentul de garantare trebuie sa prevada ca plata garantiei se va executa neconditionat, respectiv la prima cerere a beneficiarului, pe baza declaratiei acestuia cu privire la culpa persoanei garantate si se prezinta autoritatii contractante in original.
Daca partile convin, garantia de buna executie se poate constitui si prin retineri succesive din sumele datorate pentru facturi partiale, caz in care contractantul are obligatia de a deschide un cont la dispozitia autoritatii contractante, conform prevederilor art. 40 din HG nr. 395/2016.
Ofertantul declarat castigator are obligatia de a constitui garantia de buna executie a contractului in conditiile de mai sus cel mai tarziu in termen de 5 zile lucratoare de la data semnarii contractului. Autoritatea contractanta are dreptul de a emite pretentii asupra garantiei de buna executie, oricand pe parcursul indeplinirii contractului, in limita prejudiciului creat, in cazul in care contractantul nu isi indeplineste obligatiile asumate prin contract. In cazul asocierii, garantia de buna executie va fi constituita in numele asocierii si se va mentiona ca acopera in mod solidar toti membrii asocierii.

III.2) Conditions for participation
III.2.1) Personal situation of economic operators, including requirements relating to enrolment on professional or trade registers
Information and formalities necessary for evaluating if the requirements are met: Ofertantii, tertii sustinatori (daca este cazul) si subcontractantii (daca este cazul) nu trebuie sa se regaseasca in situatiile prevazute la art.164, 165, 167 si 60 din Legea nr. 98/2016. Modalitatea prin care poate fi demonstrata indeplinirea cerintelor privind situatia personala: se va completa DUAE de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei lor, precizam faptul ca declaratia conform art. 60 din Legea 98/2016 (din sectiunea ?Formulare), va fi completata si depusa de toti participantii la procedura odata cu depunerea DUAE.
Documentele justificative care probeaza indeplinirea celor asumate prin completarea DUAE urmeaza a fi prezentate, la solicitarea autoritatii contractante, doar de catre ofertantul cladat pe locul 1 in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor.

1. certificat constatatoar privind lipsa datoriilor restante cu privire la plata impozitelor, taxelor sau a contributiilor la bugetul general consolidat la momentul prezentarii;
2. dupa caz, documente prin care se demonstreaza faptul ca operatorul economic poate beneficia de derogarile prevazute la art. 166 alin. (2), art. 167 alin. (2), art. 171 din Legea 98/2016 privind achizitiile publice.
3. cazierul judiciar al operatorului economic si al membrilor organului de administrare, de conducere sau de supraveghere al respectivului operator economic sau al celor ce au putere de reprezentare, de decizie sau de control in cadrul acestuia, sau cum rezulta din certificatul constatator emis de ONRC/actul constitutiv.
Persoanele juridice/fizice straine, ce doresc a participa la procedura, vor prezenta orice documente edificatoare, eliberate de autoritati competente din tara in care acestia sunt rezidenti, prin care sa dovedeasca indeplinirea obligatiilor restante cu privire la plata impozitelor si a asigurarilor sociale, la momentul prezentarii acestora. Informatiile cuprinse in certificatul constatator trebuie sa fie valabile la momentul prezentarii acestora.
Conf. art. 63 din Legea 98/2016 persoanele cu functie de decizie din cadrul autoritatii contractante, si conform art. 3 lit. ll) din Legea nr. 98/2016, persoanele cu functii de decizie sunt: conducatorul autoritatii contractante, membrii organelor decizionale ale autoritatii contractante ce au legatura cu procedura de atribuire, precum si orice alte persoane din cadrul autoritatii contractante ce pot influenta continutul documentelor achizitiei si /sau desfasurarea procedurii de atribuire:

Note:
1. documentele emise in alta limba decat limba romana trebuie sa fie insotite de traduceri autorizate in limba romana.
2. in cazul in care exista incertitudini in ceea ce priveste situatia personala a ofertantilor, autoritatea contractanta are dreptul de a solicita in mod direct informatii de la autoritatile competente care emit documente de natura celor prevazute. Prezentarea Certificatului Constatator emis de Oficiul Registrului Comertului de pe langa Tribunalul Teritorial din care sa rezulte ca operatorul economic este legal constituit, ca nu se afla in niciuna dintre situatiile de anulare a constituirii, ca are capacitate profesionala de a realiza activitatile care fac obiectul contractului, respectiv obiectul contractului ce urmeaza a fi atribuit are corespondent in codul CAEN din certificatul constatator. Certificatul constatator va fi solicitat ofertantului (lider asociere, asociati), tertului sustinator si subcontractantului, care trebuie sa indeplineasca aceasta cerinta pentru partea din contract pe care o realizeaza.
In cazul persoanelor juridice straine se vor prezenta documente care dovedesc o forma de inregistrare/atestare ori apartenenta din punct de vedere profesional, in conformitate cu prevederile legale din tara in care este stabilit ofertantul, in original sau copie conform cu originalul, insotite de traducerea autorizata a acestora in limba romana.
Modalitate prin care poate fi demonstrata indeplinirea cerintei: se va completa DUAE de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei lor. Documentele justificative care probeaza indeplinirea celor asumate prin completarea DUAE, respectiv certificat constatator emis de ONRC, sau in cazul ofertantilor straini, documente echivalente emise in tara de rezidenta, urmeaza sa fie prezentate, la solicitarea autoritatii contractante, doar de catre ofertantul clasat pe locul I in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor. Informatiile cuprinse in certificatul constatator, Trebuie sa fie valabile la momentul prezentarii acestora.
