Section III: Legal, economic, financial and technical information

III.1) Conditions relating to the contract
III.1.1) Deposits and guarantees required:
Cuantumul garantiei de participare este de, reprezentand 1 % din valoarea subsecventului maxim (6 020,66 RO). Garantia de participare este valabila 90 de zile de la data limita de depunere a ofertelor. Modul de constituire a garantiei de participare: Curs de referinta BNR din data publicarii in SEAP a invitatiei de participare. Garantia de participare la procedura de achizitie se constituie, in conformitate cu art. 36 din HG 395/2016, prin virament bancar sau printr-un instrument de garantare emis in conditiile legii de o societate bancara ori de o societate de asigurari, in lei, in conformitate cu prevederile legii, in cuantumul mentionat si cu o perioada de valabilitate egala cu perioada de valabilitate a ofertei, respectiv 90 de zile de la data limita de primire a ofertei. In cazul in care ofertantul opteaza pentru constituirea garantiei de participare prin virament bancar, contul deschis de autoritatea contractanta este urmatorul: RO35TREZ7025005XXX000186, deschis la Trezoreria Sector 2, cod fiscal 9524980, cu conditia confirmarii acestuia de catre banca emitenta,in favoarea autoritatii contractante. Garantie de buna executie in cuantum de 5 % din valoarea fara TVA a contractului subsecvent, cu respectarea prevederilor art. 39 si 40 din HG 395/2016.

III.2) Conditions for participation
III.2.1) Personal situation of economic operators, including requirements relating to enrolment on professional or trade registers
Information and formalities necessary for evaluating if the requirements are met: Ofertantii, tertii sustinatori si subcontractantii nu trebuie sa se regaseasca in situatiile prevazute la art. 164, 165, 167 din Legea nr. 98/2016.
Modalitatea prin care poate fi demonstrata indeplinirea cerintei: se va completa DUAE de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei lor.
Documentele justificative care probeaza indeplinirea celor asumate prin completarea DUAE urmeaza a fi prezentate, la solicitarea autoritatii contractante numai de catre ofertantii clasati pe primele 3 locuri in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor.
Aceste documente pot fi:
1. Certificate constatatoare privind lipsa datoriilor restante cu privire la plata impozitelor, taxelor sau a contributiilor la bugetul general consolidat (buget local, buget de stat, etc.) la momentul prezentarii;
2. Cazierul judiciar al operatorului economic si al membrilor organului de administrare, de conducere sau de supraveghere al respectivului operator economic, sau a celor ce au putere de reprezentare, de decizie sau de control in cadrul acestuia, asa cum rezulta din certificatul constatator emis de ONRC / actul constitutiv;
3. Dupa caz, documente prin care se demonstreaza faptul ca operatorul economic poate beneficia de derogarile prevazute la art. 166 alin. (2), art. 167 alin. (2), art. 171 din Legea 98/2016 privind achizitiile publice;
4. Alte documente edificatoare, dupa caz.
Ofertantii, tertii sustinatori si subcontractantii nu trebuie sa se regaseasca in situatiile prevazute la art. 59-60 din Legea 98/2016. Declaratiile conform art. 59 si 60 din Legea 98/2016 vor fi prezentate de ofertanti, terti sustinatori si subcontractanti odata cu DUAE.
Persoanele cu functie de decizie din cadrul autoritatii contractante, in ceea ce priveste organizarea, derularea si finalizarea procedurii deatribuire, sunt: manager ? prof. dr. Streinu-Cercel Adrian, director financiar-contabil ? ec. Dumitrascu Daniela, director medical ? Petrea Sorin, jurist ? Cruceru Raluca, Comisia de evaluare: Berezitchi Simona Corina Gabriela, Laptici Cristina, Buduroi Ileana, Chiru Daniela.
Operatorii economici ce depun oferta trebuie sa dovedeasca o forma de inregistrare in conditiile legii din tara de rezidenta, sa reiasa ca operatorul economic este legal constituit, ca nu se afla in niciuna dintre situatiile de anulare a constituirii precum si faptul ca are capacitatea profesionala de a realiza activitatile care fac obiectul contractului.

Certificat de marcaj CE emis de un organism notificat sau Declaratie de conformitate CE care atesta ca operatorul economic participant la procedura de atribuire respecta Directiva CE pentru gama de produse comercializata.
Conform art. 179 lit. ?l din Legea nr. 98/2016, prezentarea de esantioane, fotografii sau descrieri (stampilate si semnate de operatorul economic) a caror autenticitate sa poata fi dovedita in cazul in care autoritatea contractanta doreste acest lucru cuprinzand: denumirea produsului, producatorul, continutul si specificatiile.
Respectarea de catre ofertant a unor standarde minime de asigurare a calitatii, care sa se raporteze la sistemele de asigurare a calitatii bazate pe seriile de standarde relevante in legislatia comunitara, certificate de organisme conforme cu seriile de standarde comunitare privind certificarea calitatii ? certificat SR EN ISO 9001 sau echivalent, conforme cu legislatia comunitara privind ertificarea calitatii, corespunzatoare categoriei de importanta a obiectului contractului ce urmeaza a fi atribuit prin prezenta procedura.

In situatia in care, se constata ca ofertele clasate pe primul loc, au preturi egale, autoritatea contractanta va solicita clarificari prin intermediul SEAP, in vederea incarcarii electronice de catre operatorii economici, situati pe primul loc, a unor documente care vor contine noi preturi (reofertare). Orice solicitare de clarificari ale ofertantilor vor fi transmise numai prin intermediul SEAP-ului. Contractele subsecvente vor fi incheiate cu ofertantiii clasati pe primul loc. In cazul in care acestia nu mai pot sa-si sustina pretul sau nu-si indeplinesc obligatiile contractuale in mod corespunzator, atunci autoritatea contractuala va solicita incheierea contractelor subsecvente cu ofertantii clasati pe locul 2, daca exista.
