Section III: Legal, economic, financial and technical information

III.1) Conditions relating to the contract
III.1.1) Deposits and guarantees required:
Cuantumul garantiei de participare: lot I ? 850 RON; lot II ? 950 RON, lot III ? 650 RON; lot IV ? 1 500; lot V ? 1 600 RON; lot VI ? 500 RON.
Perioada de valabilitate a garantiei de participare: 90 zile calendaristice de la data limita stabilita pentru depunerea ofertelor. Dovada constituiri garantiei de participare se va depune in SEAP de catre ofertanti pana la data limita de depunere a ofertelor. Mod de constituire: conform art. 36 alin. (4) din Hotararea nr. 395/2016. In cazul constituirii prin virament bancar se va utiliza contul autoritatii contractante RO75RZBR0000060013046222 - deschis la Raiffeisen Bank. Curs de referinta leu/valuta de la BNR se va lua in considerare cursul comunicat de BNR cu 5 zile inainte de data limita de depunere a ofertei. Autoritatea contractanta are dreptul de a incasa in nume propriu garantia de participare ofertantul pierzand suma constita atunci cand acesta din urma se afla in oricare din situatiile prevazute de art 37 din Hotararea nr. 395/2016. Dovada garantiei de participare se va transmite in SEAP pana la data limita de depunere a ofertelor, in format electronic cu semnatura electronica extinsa. Restituirea garantiei de participare se face conform art. 38 din Hotararea nr. 395/2016.
Lipsa acestui document din oferta depusa va conduce la respingerea ofertelor. Garantia de buna executie a contractului de furnizare este de 5 % din valoarea fara TVA a contractului. Mod de constituire: prin virament bancar, scrisoare de garantie de buna executie sau retineri succesive din sume datorate pentru facturi partiale. Scrisoarea de garantie va fi eliberata de o banca sau o societate de asigurari si se va depune in original. In cazul retinerilor succesive, contractantul are obligatia de a deschide un cont distinct la unitatea Trezoraria Statului din cadrul organului fiscal competent, cont ce trebuie deschis dupa semnarea contractului si oricum inainte de inceperea executiei contractului. Suma initiala care se depune de catre contractant nu trebuie sa fie mai mica de 0,5 % din pretul contractului. Autoritatea contractanta are obligatia de a elibera/restitui garantia de buna executie conform art. 42 alin. (1) din HG 395/2016.

III.2) Conditions for participation
III.2.1) Personal situation of economic operators, including requirements relating to enrolment on professional or trade registers
Information and formalities necessary for evaluating if the requirements are met: 1. Ofertantii, tertii sustinatori si subcontractantii nu trebuie sa se regaseasca in situatiile prevazute la art. 164, 165,167 din Legea nr. 98/2016. Modalitatea prin care poate fi demonstrata indeplinirea cerintei: Se va completa DUAE de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei lor. Documentele justificative care probeaza indeplinirea celor asumate prin completarea DUAE urmeaza a fi prezentate, la solicitarea autoritatii contractante, doar de catre ofertantul clasat pe locul I in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor. Aceste documente pot fi:
a) certificate constatatoare privind lipsa datoriilor restante cu privire la plata impozitelor, taxelor sau a contributiilor la bugetul general consolidat (buget local, buget de stat, etc.) la momentul prezentarii.
b) cazierul judiciar al operatorului economic si al membrilor organului de administrare, de conducere sau de supraveghere al respectivului operator economic, sau a celor ce au putere de reprezentare, de decizie sau de control in cadrul acestuia, asa cum rezulta din certificatul constatator emis de ONRC/actul constitutiv;
c) dupa caz, documente prin care se demonstreaza faptul ca operatorul economic poate beneficia de derogarile prevazute la art. 166 alin (2), art. 167 alin. (2), art. 171 din Legea 98/2016 privind achizitiile publice.
2. Declaratie privind neincadrarea in situatiile prevazute la art. 59 din Legea nr. 98/2016 privind achizitiile publice.
Aceasta cerinta va fi demonstrata, la momentul depunerii ofertelor, prin prezentarea DUAE, urmand ca ofertantul clasat pe locul I in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor sa prezinte Formular nr. 4.

Operatorii economici ce depun oferta trebuie sa dovedeasca o forma de inregistrare in conditiile legii din tara de rezidenta, din care sa reiasa ca operatorul economic este legal constituit, ca nu se afla in niciuna dintre situatiile de anulare a constituirii precum si faptul ca are capacitatea profesionala de a realiza activitatile care fac obiectul contractului.
Modalitatea de indeplinire: se va completa DUAE de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei lor. Documentele justificative care probeaza indeplinirea celor asumate prin completarea DUAE, respectiv certificat constatator emis de ONRC, sau in cazul ofertantilor straini, documente echivalente emise in tara de rezidenta, urmeaza sa fie prezentate, la solicitarea autoritatii contractante, doar de catre ofertantul clasat pe locul I in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor.

Eventualele raspunsuri la clarificari se vor atasa la anuntul de licitatie deschisa. Aceste raspunsuri vor face parte din documentatia de atribuire si este obligatoriu ca la elaborarea ofertei sa fie avute in vedere. Daca pe primul loc in clasamentul preturilor sunt ofertanti cu preturi egale pentru departajare se vor solicita prin clarificari pe SEAP noi oferte financiare care pot fi egale sau diminuate fata de cele initiale, caz in care contractul va fi atribuit ofertantului a carei noua propunere financiara are pretul final cel mai scazut.
