Notice of Intent to Award an 8(a)Sole Source Contract to Ozark Kinder JV, LLC

This is a notice of intent of the U.S. Army Corps of Engineers, Memphis District, Contracting Branch to negotiate a sole source award with Ozark Kinder JV, LLC, 3067 S Westwood BLVD, Poplar Bluff, Missouri 63901-7378.. This contract action was accomplished using other than competitive procedures, because a statute exists that expressly authorizes or requires that this acquisition be made from a specific source or through another agency; specifically, FAR 6.302-5(b)(4) for sole source awards under the 8(a) program 15 U.S.C.637(a) and in accordance with 13 CFR 124.1-1(c) and FAR 19.8.

The work for this project is located as indicated on the plans, in the following counties: Desoto County, MS, Coahoma County, MS, Crittenden County, AR, Phillips County, AR and Mississippi County, AR. The exact location will be indicated on the contract

drawings. The intended period of performance is 230 (two hundred thirty) days from time of notice to proceed. The proposed action will result in a firm-fixed price contract.

Big Slough Levee Culvert Replacement project, the work consists of replacing an existing 28” CMP which has structural damage and has exceeded its service life. This existing culvert will be replaced with a 30” RCP culvert which will consist of a flap gate and cast-in-place outlet structure and a precast flared end section on the inlet side of the new culvert. The new culvert will be offset approximately 130’ to the north along the sleeve levee. The existing culvert will remain in place during construction in order to provide drainage to the landside of the levee during construction of the new culvert. Temporary flood protection will be required during the new culvert construction and existing culvert removal. Any borrow material that may be required on the project will be obtained along the waterside batture area. The exact location will be indicated on the contract drawings. The intended Period of Performance for this Contract is 230 (two hundred thirty) days.

The North American Industrial Classification System (NAICS) Code is 237990 (Other Heavy and Civil Engineering Construction) with a Small Business size standard of $45M. The estimated value of this project is between $1,000,000.00 and $2,000,000.00.
