The Defense Media Activity (DMA) intends to award a single source purchase order to TERRY STEINER INTERNATIONAL, INC., CAGE Code: 1CLT2, address (130 W 57th ST APT 10B, New York, New York, 10019-3311, United States) to provide license to television programming as a distribution rights holder for AMC Entertainment Holdings Inc programming.

The regulatory authority which permits this single source procurement is Federal Acquisition Regulation Subpart (FAR) 13.106-1(b)(1) Soliciting from a single source. This authority is supported by an approved Justification and Approval. The Government anticipates a firm fixed price award. The North American Industry Classification System (NAICS) code 512120 – Motion Picture and Film Distribution. The Product Service Code (PSC) code is 6770: Film, Processed. The anticipated award date is September 2024.

This requirement is a follow-on to an existing licensing agreement between Terry Steiner International, Inc. and AFN-BC. The vendor shall provide proprietary program and movie licensing and materials for base year plus 4 option years from 01 September 2024 to 31 August 2029. This action is to acquire the broadcast distribution rights for television programming material. The materials will enable the American Forces Networks Broadcast Center (AFN-BC) to support the American Forces Network (AFN) mission. This mission is to provide balanced representative selection of popular television information and entertainment programs of particular interest to both the primary AFN audience of DoD personnel stationed overseas and their family members. This programming has been selected in response to requirements established by the military services and AFN survey data on interest/trends/likes/dislikes. It is also required to ensure the accomplishment of the AFN mission to effectively communicate command information to DoD personnel stationed overseas and their family members, while simultaneously providing the level of entertainment needed to make a positive impact on their morale. It will also provide the most efficient medium to ensure the effective communication of information messages inserted within the program as spot announcements in support of DoD internal information themes, goals, and objectives. AFN’s mission tasking per DoD Directive 5120.20 is to support the Internal Communications mission of the Department of Defense by providing a broad range of information and entertainment programming to DoD personnel and their family members overseas, thus attracting an audience for Internal Communications messages placed within AFN programming.

A determination by the Government not to compete this proposed action based upon responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether conducting a competitive procurement is in the best interest of the Government.

All responses received by 4:00 PM Eastern Daylight Time (EDT) on 6 May 2024 will be considered by the Government. This notice is not a request for competitive proposals/quotes. All information submitted should support the offeror's capability to provide the items required and shall be furnished at no cost or obligation to the Government.
