This updated Sources Sought Notice is being issued for market research purposes to gather market feedback on Project Labor Agreements (PLAs). NO SOLICITATION IS AVAILABLE; requests for a solicitation will go unanswered. No award will be made from this Notice. Responses will be used to gain knowledge of potential sources collective bargaining agreements with labor organization(s), whether a PLA has been used in the local area on projects





GENERAL SCOPE:





This notice is for the evaluation of Project Labor Agreements (PLAs) ONLY.





The U.S. Army Corps of Engineers (USACE) Sacramento District (SPK) is conducting market research by soliciting comments from the construction community addressing the potential use of PLAs and to obtain data on the recent history of construction projects in the local labor market of the project under consideration.





USACE-SPK anticipates a potential requirement for construction of multiple facilities and utility infrastructure systems to support the planned and future development of the east side of Hill Air Force Base (HAFB), Utah (UT). The work includes the construction of airfield paving (taxiways and tow-ways), associated drainage, and airfield lighting systems. Work will also include construction of a communication information technology node (ITN) building, the relocation of a Tactical Air Navigation (TACAN) facility as well as upgrades and new utility infrastructure to various privately owned (City Light and Power and American Water), public owned, and government owned utility systems including water production (well), storage (water tank), and distribution; sanity sewer, storm sewer, and industrial waste; electrical distribution and communications; natural gas, and compressed air. All facilities and infrastructure systems will be permanent construction in accordance with applicable Department of Defense (DOD) Unified Facilities Criteria (UFC).





The potential requirement may result in a solicitation issued approximately 11 March 2024.





If solicited, the Government intends to award the contemplated requirement as a firm-fixed-price contract by approximately August 2024. It is estimated that the potential requirement can be completed within 730 calendar days.





In accordance with Defense Federal Acquisition Regulation Supplement (DFARS) 236.204(iii), the Government currently estimates the magnitude of construction for this project to be between $100,000,000 and $250,000,000.





Responses must be limited to four (4) 8.5 x 11-inch pages with a minimum font size of 12-point.





PLA Survey. A PLA is a pre-hire collective bargaining agreement with labor organization(s) that establishes the terms and conditions of employment for a specific construction project. Pursuant to Executive Order 14063, Use of Project Labor Agreements for Federal Construction Projects, agencies are mandated to use PLAs for large-scale construction projects (defined as projects where the total cost to the Government of the project is estimated to be at least $35,000,000.00) unless exempted by the agency Senior Procurement Executive.






  1. Do you have knowledge that a PLA has been used in the local area on projects of this kind? If so, please provide supporting documentation.


  2. Are you aware of skilled labor shortages in the area for those crafts that will be needed to complete the referenced project? If so, please elaborate and provide supporting documentation where possible.


  3. Are you aware of time sensitive issues/scheduling requirements that would affect the rate at which the referenced project should be completed? If so, please elaborate and provide supporting documentation where possible.


  4. Identify specific reasons why or how you believe a PLA would advance the Federal Government’s interest in achieving economy and efficiency in Federal procurement.


  5. Identify specific reasons why you do not believe a PLA would advance the Federal Government’s interest in achieving economy and efficiency in Federal procurement.


  6. Identify any additional information you believe should be considered on the use of a PLA on the referenced project.


  7. Identify any additional information you believe should be considered on the non-use of a PLA on the referenced project. (Items A-G are the minimum questions that must be included if the requirement is estimated to be >$35M. Items H-R, or any other questions, may be included upon recommendation from the KO, or deleted.)


  8. Have PLAs been used on similar projects undertaken by Federal, State, municipal, or private entities in the geographic area where work will be performed? If so, please provide contract number(s) and points of contact.


  9. Will multiple construction Contractors and/or Subcontractors employing workers in multiple crafts or trades be required to complete the anticipated work?


  10. Is it difficult to recruit or retain a skilled workforce in the anticipated work location?


  11. Do you think completion of the project will require an extended period of time?


  12. Do you anticipate any unique, compelling, time-sensitive issues, or other schedule requirements to complete the anticipated work (aside from those already noted) or that would affect the rate at which the anticipated project could be completed? If so, please elaborate and provide supporting documentation where possible.


  13. Are you aware of any other large-scale projects begin completed in the area during the anticipated period of performance?


  14. Do you think requiring a PLA will increase contract costs or contribute to cost savings? Why or why not? How?


  15. How do open shop and union wage rates influence prevailing wage rates in the local market area? How does unionization in the local market impact wages? Please provide supporting documentation.


  16. Do you think requiring a PLA will increase contract risk? Why or why not? How?


  17. If you have previously been party to a PLA, approximately how long did it take to negotiate the terms of the PLA? Did PLA negotiation delay construction start? If so, by how long?


  18. Are unionized and non-unionized contractors available to participate on this project?


  19. Any other information you think should be considered regarding the use of PLAs for the anticipated project.

Responses will not be considered an offer, proposal, or bid for any solicitation that may result from this Notice. Moreover, responses will not restrict the Government to an ultimate acquisition approach. This Notice is for information and planning purposes only. Respondents will not be notified of the results of any PLA Survey conducted or the responses received.
