PTAG Part 6.1.1 Synopsis – Intent to Sole Source to Lessor



USPTO FOOD SERVICE EQUIPMENT REPAIR SERVICES



The United States Patent and Trademark Office (USPTO), Office of Chief Administrative Officer (OCAO), intends to make an award of a FAR 13 BPA on a sole source basis to LCOR ALEXANDRIA LLC 400 DULANY ST ALEXANDRIA, VA 22314-5774 (UEI: NDP7EMB48KJ7) for planned and emergency food service equipment maintenance services, repair and replacement (if necessary)

For this procurement, the USPTO is exempt from the Competition in Contracting Act (CICA) as the subject requirement is being procured using the Alternative Competition Method in accordance with the Patent and Trademark Office Acquisition Guidelines (PTAG) and the Patent and Trademark Office Efficiency Act 35 U.S.C. 2(b)(4)(A). LCOR (the Lessor) is responsible for the operation of the USPTO Campus in Alexandria, VA (Main address: 600 Dulany St. Alexandria, VA 22314) in accordance with Lease No. GS-11P-LVA80671 which includes responsibility to maintain the system infrastructure supporting sanitation, plumbing, gas and electricity. As a result, these food service equipment services involve work that is tied to or physically connected to these infrastructure systems that is under control of the lessor. Contracting with the lessor will ensure the lessor remains wholly responsible for the continued maintenance and operation of the food service equipment. The use of an outside contractor would negate the lessor's responsibility for errors or damage that might occur to the buildings system infrastructure.



To make this sole source determination and in accordance with PTAG 6.1.1 (b), the USPTO conducted market research which included a review of LCOR’s aforementioned lease which resulted in the determination that any maintenance, repair or replacement of major food service equipment (such as walk-in chillers, commercial gas stoves or dishwashing units, etc.) must be managed by the lessor as this work is concurrent with their responsibilities in the overall management of the USPTO campus buildings.



As a result, per PTAG 6.1.1 (d) the USPTO intends to negotiate and award a firm fixed price FAR 13 BPA with LCOR. This requirement utilizes NAICS code 531312 and has a period of performance that includes a one-year base period with four option years from date of award.
