****INFORMATION UPDATE FOR RESPONDENTS TO THIS NOTICE 4/15/2024 - The SEC intends to hold a pre-solicitation discussion session on this OEC eFeeds requirement. This pre-solicitation discussion is open to the companies that submitted a response to this DRAFT RFP. The pre-solicitation discussion will only cover the subject of the Data Feeds Agreements with Brokers. The pre-solicitation discussion will be held virtually on Tuesday, April 23, 2024 10:00am-11:00am EST. To receive an invite, vendors who responded to this DRAFT RFP and would like to participate in the SEC’s Pre-Solicitation Discussion on OEC eFeeds Data Feeds Agreements with Brokers shall contact Consuela Ginn via email at ginnc@sec.gov, NLT 10:00am EST on April 19, 2024 and provide the following information:

1. Title the email “SEC’s Pre-Solicitation Discussion on OEC eFeeds Data Feeds Agreements with Brokers”.

2. Company name and address.

3. Company POC name, email address, and phone number.

4. List of company attendees (limited to 5 maximum).

5. Specific questions you have related to Data Feeds Agreements with Brokers. At the meeting April 23, 2024, the SEC will do its best to respond to the written questions received by 10:00am EST on April 19, 2024 by the Contracting Officer as requested in this notice. The SEC cannot guarantee that questions received after this time or at the meeting time permitting, will be answered.

6. Previous experience and/or challenges you have had with other clients around Data Feeds Agreements with Brokers.

7. Your expectations for the length of time it will take to execute broker agreements.

UPDATE 3/1/2024 - The SEC added a Word version of Attachment 6, OEC eFeeds Questions for Industry so vendor responces may be added to this document directly for submission as part of vendor responses to this Draft RFP. A Word version of the Draft Statement of Objectives (SOO) has also been provided in the event vendors wish to make comments directly in this document to provide as part of your submission to the SEC. Any other information you wish to provide to the SEC, such as feedback on Attachment 5, Draft Evaluation Criteria can be provided in a separate Word or PDF document. THIS IS A DRAFT REQUEST FOR PROPOSAL ONLY. THE GOVERNMENT IS SEEKING SOURCES AND REQUESTING FEEDBACK ON THIS DRAFT SOLICITATION FOR EFEEDS SERVICES. NO PROPOSALS ARE BEING SOLICITED AT THIS TIME, THIS IS MARKET RESEARCH ONLY. THE FEEDBACK FROM INDUSTRY ON THIS DRAFT WILL BE USED TO HELP FORMULATE A FINAL SOLICITATION IF ONE IS ISSUED; THEREFORE, THE GOVERNMENT WELCOMES AND APPRECIATES INDUSTRY'S ANSWERS TO THE SEC'S QUESTIONS IN ATTACHMENT 6 TO THIS DRAFT SOLICITATION AND INDUSTRY'S EXPERTISE AND INPUT ON ATTACHMENT 5, DRAFT EVALUATION CRITERIA.

(i) This is a DRAFT combined synopsis/solicitation that will provide electronice data feeds services in acordance with the attached DRAFT Statement of Objectives. This DRAFT RFP is in accordance with the format in the Federal Acquisition Regulation (FAR) Subpart 12.6, as supplemented with additional information included in this notice. This DRAFT announcement IS NOT A solicitation; Offers are NOT being requested at this time. An official combined synopsis/solicitation will be issued at a later time if the Government decides to procure this requirement.

(ii) The DRAFT solicitation number is TBD and is issued as a Request for Proposals (RFP).

(iii) The DRAFT synopsis/solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2024-02 effective January 22, 2024.

(iv) Solicitation number TBD is a full and open competition. The associated NAICS code is 541511; and the applicable business size standard is $34M.

(v) Description of requirements for the items to be acquired. SEE ATTACHMENT 3, DRAFT STATEMENT OF OBJECTIVES (SOO).

(vi) Date(s) and place(s) of delivery and acceptance and FOB point. TBD

The anticipated contract’s period of performance will be for one (1) year from date of award, with four (1) one-year options. Anticipated start date if this requirement is solicited is September 30, 2024.

(viii) The provision at 52.212-1, Instructions to Offerors-Commercial Products and Commercial Services, applies to this acquisition and a statement regarding any addenda to the provision.

(ix) The provision at 52.212-2, Evaluation-Commercial Products and Commercial Services. See ATTACHMENT 5, DRAFT Evaluation Criteria attached to this notice. The SEC is seeking industry's expertise and input on evaluation criteria.

(x) Offerors shall include a completed copy of the provision at FAR 52.212-3, Offeror Representations and Certifications-Commercial Products and Commercial Services, with its offer if an official solicitation is issued.

(xi) FAR 52.212-4, Contract Terms and Conditions-Commercial Products and Commercial Services, is expected to apply to this acquisition if solicited.

(xii) The clause at FAR 52.212-5, Contract Terms and Conditions Required To Implement Statutes or Executive Orders-Commercial Products and Commercial Services, is expected to apply to this acquisition if solicited.

(xiii) Additional contract requirement(s) and terms and conditions that are expected to apply to this requirement if solicited, are included in the ATTACHMENT 7, OEC eFeeds Additional Terms and Conditions.

(xiv) The Defense Priorities and Allocations System (DPAS) is not applicable.

(xv) Questions on this DRAFT RFP will only be accepted in writing to ginnc@sec.gov and are requested as soon as possible, but not later than March 15, 2024 at 2:00pm EST.

(xvi) All questions and responses to this DRAFT RFP shall be submitted to Ms. Consuela Ginn at ginnc@sec.gov. NO PHONE CALLS WILL BE ACCEPTED AT THIS TIME. Thank you for your cooperation.

(xvii) Responses to this DRAFT RFP in the form of answers to the Government's questions and requested information are requested as soon as possible but not later than April 8, 2024 at 2:00pm EST.
