Description

INTENT TO AWARD SOLE SOURCE: The Centers for Medicare and Medicaid Services (CMS) intends to negotiate and award a sole source purchase order to Fair Health, Inc., 800 Third Avenue, Suite 900, New York, New York 10022 to fulfill CMS’s statutory responsibilities under the No Surprise Act to conduct Qualifying Payment Amount (QPA) Audits. In order to fulfill CMS’s statutory responsibilities under the No Surprise Act to conduct QPA Audits, CMS requires the support of a contractor with the required expertise and extensive knowledge needed to implement these provisions by the mandated deadlines. The contractor shall provide these services for the following period of performance: 06/01/2024 – 05/31/2025 for the Base Year, the period 06/01/2025 – 05/31/2026 for Option Year One, and 06/01/2026 – 05/31/2027 for Option Year Two. Detail information has been provided in the attached Statement of Work. The sole source award will be made under the authority of 41 U.S.C. 235 ( C ) ( 1 ) as implemented by FAR6.302-1, Only One Responsible Source and No Other Supplies and Services Will Satisfy Agency Requirements. A justification and approval is currently being processed for this requirement.





CMS REQUIREMENTS: The purpose of this requirement is to acquire the services of a contractor that maintains a No Surprise Act Reference File that will allow CMS to review the data that plans and issuers are using to ensure that they are following the QPA methodology requirements outlined in 45 CFR 149.140 so we are able to fulfill our statutory obligation.

INTERESTED PARTIES: All responsible sources may submit a capability statement, proposal, or quotation which shall be considered by the agency. In order to qualify as a potential contractor for this procurement, the organization must provide valid, reliable and standardized health care performance measures to support and advance public accountability, quality improvement efforts, increased patient safety, and value based purchasing. The organization must be able to serve as a national dissemination and implementation conference for health disparities researchers. To be considered, interested vendors must submit technical literature describing their capability to effectively satisfy this requirement, as well as terms and conditions and a complete price quote within 5 days of this notice, to the following electronic mail address: phillip.harrell@cms.hhs.gov.
