NOTICE OF INTENT TO AWARD SOLE SOURCE



INTENT TO AWARD SOLE SOURCE: The Centers for Medicare and Medicaid Services (CMS) intends to negotiate and award a sole source purchase order to the First Data Bank, 500 East 96th Street, Suite 500, Indianapolis, IN 46240-3767 for the annual purchase of First Data Bank’s National Drug Data File (NDDF) Tape, with Monthly Full Replacement Updates in accordance with the Statement of Work which is included in the attachment. The anticipated period of performance is for 1 base year and 3 option years. The sole source award will be made under the authority of 41 U.S.C. 235 (C) (1) as implemented by FAR6.302-1, Only One Responsible Source and No Other Supplies and Services Will Satisfy Agency Requirements. A justification and approval is currently being processed for this requirement. This requirement is intended as a sole source procurement because First Data Bank is a national drug information data base which contains current product, pricing and package information on commercially available multiple source prescription drugs. It is one of the three drug compendia companies in the country providing this data with no other sources available. Data from all three drug compendia are used in determining the Medicaid FULs for certain prescription drugs. The authority to set upper payment limits for certain drugs was provided under section 1902(a)(30)(A) of the Act and is established by regulation at 42 CFR 447.301-333.
