Disposition of Surplus Emergency Vehicles
New Castle County is seeking bids to dispose of surplus emergency vehicles.
Interested parties are asked to submit a priced proposal to New Castle County, Procurement
Division, New Castle County Government Center, 87 Reads Way, New Castle, DE 19720, stating
their interest and qualifications. Proposals must be received by 2pm on Wednesday, April 17th,
2024, and must include one (1) printed hard copy and preferably one (1) USB drive containing
an electronic version of the proposal within a sealed envelope. The electronic submission will
be considered the original, and must replicate the printed hard copy, with all appropriate
signed documents. If there are any discrepancies between the two submissions, the original
(electronic) submission is considered the official version for purposes of evaluation. The hard
copy is only reviewed if the electronic version cannot be viewed due to a technical issue.
Delivery Method for Bid Submission Options:
- You can mail your bid submission to 87 Reads Way, New Castle, Delaware. However, it is
recommended to use a carrier that can guarantee delivery and provide tracking
information, so your bid submission packet arrives at the deadline date and time.
- You can deliver your bid submission packet in person prior to the Bid Opening to the
Government Center, located at 87 Reads Way, New Castle, DE 19720 between the hours of
8 a.m. and 3:30 p.m.
You can go inside the building to the lobby area and do either of the following:
1) Call a member of Administrative Services at 302-395-5965 from the Lobby
Phone or your cell phone, and have a Procurement representative meet you in the lobby and
accept your bid packet and provide a receipt, or
2) You can ask the Receptionist to contact Procurement.
Please remember on the bid opening date, your bid submission must be turned in no later than
2:00 p.m. on Wednesday, April 17th, 2024, to be accepted and you are welcome to attend the
bid opening meeting at that time.

INSTRUCTIONS FOR PROPOSAL SUBMISSION
Sealed proposal envelopes must clearly display Bid #24S-2401, Disposition of Surplus
Emergency Vehicles in the lower left quadrant on the front.
Facsimile and email transmissions of proposals are unacceptable and will be rejected without
any notice to the bidding vendor.
Bidders are responsible to retrieve the bid specifications and all addendums from the New
Castle County Purchasing website at www.newcastlede.gov/Bids.aspx.
Bidders must complete and submit:
- Price Form for each unit you wish to bid on.
- Non-Collusion Statement.
- Authorized Representative Procurement Affidavit.
Failure to sign and return these documents could result in your bid submission being
rejected.
Pursuant to New Castle County Code and Delaware Law, each bidder must submit proof
satisfactory to the County or its designated representative that the bidder and every
subcontractor possesses valid and effective licenses required by the United States, State of
Delaware, County and any applicable political subdivision in which the project is located to do
business within each such jurisdiction and to perform the labor and/or supply the materials
involved in the performance of the contract. No contract will be executed prior to the
submission of such proof and the acceptance thereof by the County or its designated
representative.
Awards, if any, will be made in conjunction with the Delaware Code, Subchapter 2, Chapter 69,
Title 29, and the New Castle County Code.

BACKGROUND
New Castle County Government is seeking bids on three (3) surplus vehicles to be disposed
of. By Administrative Code Section 2.05.502.15, surplus property may be disposed of based
on competitive quotations from prospective purchasers.
The vehicles unit numbers, makes, models and descriptives are listed below on the price
form. Please fill in your bid offer on each individual page for the specific unit we are
seeking to dispose of.
The bid offer chosen will be one that represents the best value for NCC. This may or may
not be the highest bid offer.
WARRANTY
Seller warrants to the Buyer that the property offered for sale is “AS IS” and will conform to its
description as listed on the price form. Any claim for misdescription must be made prior to
removal and payment of the asset.
TERMS AND CONDITIONS OF SALE
All real property, including any vehicles, are sold "AS IS" and without any
representation or warranty whatsoever as to the condition or title,
The County makes no representation, express or implied, as to the condition of any
asset, warranty of title, or as to the suitability of any for any particular use.
The entire purchase price must be paid by money order or guaranteed funds to
New Castle County at time of delivery.
Sales shall be final, absolute and without recourse once the title has closed. In no
event, shall New Castle County be or become liable for any defects in title for any
cause whatsoever, and no claim, demand or suit of any nature shall exist in favor of
the purchaser, his heirs, successors, or assigns, against New Castle County arising
from this sale.

FORM OF PROPOSAL

MULTI-AWARD
Pursuant to New Castle County Code section 2.05.502 B.8., New Castle County may multi award
this contract.
INDEMNITY
Vendor shall indemnify, defend, and hold harmless New Castle County from and against any
and all claims, demands, suits, judgments, costs, and expenses asserted by a person or persons,
including, but not limited to, agents, employees, or volunteers of vendor, by reason of death or
injury to persons, or loss or damage to property, resulting from operations or use of services,
products and/or equipment purchased hereunder, or sustained in or upon the premises of New
Castle County.
CONFIDENTIALITY
All documents submitted as part of the vendor’s bid/proposal will be deemed confidential
during the evaluation process. Vendor proposals will not be available for review by anyone
other than New Castle County’s Evaluation Committee or its designated agents. There shall be
no disclosure of any vendor’s information to a competing vendor prior to award of the contract.
New Castle County is a public agency and is subject to the Freedom of Information Act (FOIA).
State Code Title 29, Chapter 100. Vendor(s) are advised that once a proposal/bid is received by
New Castle County and a decision on contract award is made, its contents will become public
record, and nothing contained in the proposal will be deemed to be confidential except those
proprietary items marked as “trade secrets”.

MINORITY
Minority and Women-owned Business Enterprises (MWBE) will be afforded full opportunity to
submit proposals and will not be subject to discrimination on the basis of race, color, national
origin, sex, religion, age, disability, or sexual orientation in the consideration of this award.
REQUIRED INSURANCE
Workers’ Compensation & Employer’s Liability Insurance
Vendor shall purchase and keep in force and effect workers’ compensation insurance that will
provide the applicable statutory benefits for all of the vendor’s employees who may or do
suffer covered injuries or diseases while involved in the performance of their work for the
Vendor; and, even if permitted to do so by statute, Vendor shall not reject any workers’
compensation insurance option that, in the absence of such a rejection, would be applicable to
any of the said employees. The policy providing the workers’ compensation insurance shall
include: (1) broad form all-states coverage; (2) an endorsement that specifically waives any
subrogation rights the insurer would otherwise have against New Castle County, its officials or
employees.
Vendor shall purchase and keep in force and effect, Employer’s Liability insurance with
minimum limits for each employee of $1,000,000 for each bodily injury by accident, or
occupational disease, and $1,000,000 aggregate minimum limits for all bodily injuries by
accidents and occupational diseases within the coverage period, regardless of the number of
employees who may sustain bodily injuries by accident or occupational disease.
Automobile and General Liability Insurance
Vendor shall purchase: (1) motor vehicle liability coverage, for owned, hired and non-owned
vehicles, covering any and all claims for bodily injury and property damage that arise out of
Vendor’s performance of work for New Castle County, (2) comprehensive Commercial General
Liability (CGL) insurance with limits of no less than $1,000,000 each occurrence and $2,000,000
annual aggregate. The CGL policy shall be extended by endorsement or otherwise to also
include (a) coverage for Contractual Liability assumed by Vendor, with defense provided in
addition to and separate from policy limits for indemnities of the named insured, (b) coverage
for Independent Contractor Liability providing coverage in connection with such portion of the
Services being subcontracted prior to any of the Services being subcontracted, in accordance
