New Castle County seeks a professionally managed Pharmacy Plan for the County Employees.
Interested parties are asked to submit an unpriced proposal to New Castle County Purchasing Division, New Castle
County Government Center, 87 Reads Way, New Castle, DE 19720, stating their interest and qualifications.
Proposals must be received by 2pm on April 24th, 2024, and must include one (1) printed hard copies and one (1)
USB drive containing an electronic version of the proposal within a sealed envelope. The electronic submission will
be considered the original, and must replicate the printed hard copy, with all appropriate signed documents.
Requests to be invited to the mandatory pre-bid meeting at 2pm EST on March 27th, 2024 must be submitted in
writing via email to Frank Penta at frank.j.penta@newcastlede.gov by end of day on March 19th, 2024. No
proposals will be accepted from any vendor who is not represented at the mandatory pre-bid meeting.
INSTRUCTIONS FOR PROPOSAL SUBMISSION
Sealed proposal envelopes must clearly display Bid# 25PP-003 Administrative Pharmacy Plan in the
lower left quadrant on the front.
Facsimile transmissions of proposals are unacceptable and will be rejected without any notice to the bidding vendor.
Bidders are responsible to retrieve the bid specifications and all addendums from the New Castle County
Purchasing website at www.newcastlede.gov/Bids.aspx.
Proposals shall be concise and focused.

Pursuant to New Castle County Code and Delaware State Law, no contract will be awarded to any vendor unless,
before or in conjunction with the actual award of the contract to such vendor, has submitted proof satisfactory to the
County, or to the awarding agency, or the designated representative of the County or the awarding agency, as the
case may be, that it and each and every subcontractor named by it in its bid, if any, will at the time it submits such
proof have valid and effective licenses required by the State and the County, and the political subdivisions, if any, in
which the project is located, and the United States government, in order for each of them (i) to do business therein;
(ii) to comply with all tax laws thereof; and (iii) to perform the labor and/or supply the material involved in the
performance of the contract.
Awards, if any, will be made in conjunction with the Delaware Code, Subchapter 2, Chapter 69, Title 29, and the
New Castle County Code.
Minority and Women-owned Business Enterprises (MWBE) will be afforded full opportunity to submit proposals
and will not be subject to discrimination on the basis of race, color, national origin, sex, religion, age, disability, or
sexual orientation in the consideration of this award.

GENERAL
New Castle County offers one Preferred Provider Organization (PPO), two Indemnity (Coop 80 and Comp 80), and
two Exclusive Provider Organizations (EPO’s) to their active employees and pre-65 retirees. The Active and Under
65 Retiree Indemnity/EPO/PPO plans are currently administered by Blue Cross Blue Shield of Delaware and Aetna
on a self-insured basis.
The County’s objectives in seeking:
• Pharmacy Benefits Management (Standalone or Coupled) with the medical for the
actives and pre-65 retirees. The two Indemnity Plans (Coop 80 and Comp 80) has their
pharmacy bundled with the Medical and are not carved out on a standalone basis and is
not up for bid.
LENGTH OF CONTRACT
Bidders are asked to offer either or both one-year and/or three-year contract terms commencing January 1, 2025.
The County will have the option to renew the contract for an additional one-year extension following the initial
contract term by mutual agreement of both parties and with no less than 90 days notice.
FUNDING OUT
The continuation of this contract is contingent upon funding appropriated by County Council.
TERMINATION OF CONTRACT
The County will retain the right to terminate the contract for any reason with sixty (60) day notice to vendor with no
financial penalty to the County. All rebates earned by the county until the date of termination shall be paid to the
County within 180 days of termination. Additionally, the contract will permit either New Castle County or the
vendor to terminate the contract in the event of a material failure of either party to fulfill its obligation under the
contract.
INDEMNITY
Vendor shall indemnify, defend, and hold harmless New Castle County from and against any and all claims,
demands, suits, judgments, costs, and expenses asserted by a person or persons, including, but not limited to, agents,
employees, or volunteers of vendor, by reason of death or injury to persons, or loss or damage to property, resulting
from operations or use of services, products and/or equipment purchased hereunder, or sustained in or upon the
premises of New Castle County.

DELAWARE LABOR
New Castle County encourages the use of Delaware Labor. Please specify the office location(s) and percentage of
the primary and sub-consultant (if applicable) that will be provided by each office.
INSURANCE
New Castle County requires proof of insurance showing automobile and general liability coverage.
MULTIPLE AWARD
Should New Castle County determine it to be in the best interest of the County, this contract may be awarded to one
or more firms through the evaluation and negotiation process.
STATE OF DELAWARE BUSINESS LICENSE
Within seven (7) days from receiving a notice of award, the successful vendor shall either furnish the County with
proof of a Delaware Business Licensure or initiate the process of application where required. An application may be
requested in writing to: Division of Revenue, Carvel State Building, PO Box 8750, 820 N. French Street,
Wilmington, DE 19899 or by telephone to (302) 577-8200.
CONTRACT ACCESSIBILITY
This contract shall be accessible to State agencies, political subdivisions, school districts, and volunteer fire
companies.
CONFIDENTIALITY
All documents submitted as part of the vendor’s bid/proposal will be deemed confidential during the evaluation
process. Vendor proposals will not be available for review by anyone other than New Castle County’s Evaluation
Committee or its designated agents. There shall be no disclosure of any vendor’s information to a competing vendor
prior to award of the contract.
New Castle County is a public agency and is subject to the Freedom of Information Act (FOIA). Firms must
designate those items that are considered “trade secrets” as defined in the Delaware State Code Title 29, Chapter
100. Vendor(s) are advised that once a proposal/bid is received by NCCo and a decision on contract award is made,
its contents will become public record, and nothing contained in the proposal will be deemed to be confidential
except those proprietary items marked as “trade secrets”.
