This solicitation is for the repair, blasting and painting of the water tank for the Louisiana Department

of Health (LDH), Pinecrest Support and Services Center located at 100 Pinecrest Drive, Pineville,

Louisiana 71360. The job is to be performed in accordance with the enclosed scope of work and

specifications.

Please see attachments for information about insurance, builder's risk, bond, specifications, jobsite

visit, and contractor's license requirements. Please print all attachments to ensure all documents

related to this solicitation are reviewed prior to bidding. All documents associated with this solicitation

should be included in bidder’s submission.

A jobsite visit is required prior to bid opening. Any vendor intending to submit a bid must have at least

one (1) duly authorized representative attend a mandatory jobsite visit. Please contact Shannon

Aymond or Glennen Jones at (318) 641-2288 to set up a time to visit the jobsite.

A completed Attachment B: Jobsite Verification Form or a signed letter from the agency representative

stating that vendor has visited the jobsite should be included in bidder’s submission. Failure to provide

shall remove the bid from consideration.

IMPORTANT: In accordance with La. R.S. 37:2165 A (1), a Contractors' License Number in the

appropriate classification(s) such as Building Construction and/or 7-48 Municipal and Public Works,

Building Construction and/or 7-48 Painting, Coating and Blasting must appear on the bid opening

envelope on all projects in the amount of $50,000.00 or more (and $1.00 or more if hazardous

materials are involved). Failure to do so shall remove the bid from consideration.

In accordance with La. R.S. 37:2165 C, anyone objecting to the above classification(s) must send a

certified letter to both the Louisiana State Licensing Board for Contractors and the Office of State

Procurement. The letter must be received no later than ten (10) working days prior to the day on which

the bid is to be opened.

For any bid submitted in the amount of $50,000 or more, a bid security (insurance company, bank

money order, certified check, or cashier’s check) must be included with the bidder’s submission in the

sum of five percent (5%) of the amount bid (including base bid and additive alternates, if any) and shall

become the property of the agency in the event the contract and bond are not executed within the time

set forth in the bid solicitation. Failure to do so will remove the bid from consideration. Please refer to

Attachment A: Special Terms and Conditions page four (4) for complete details of this requirement.

ILLUSTRATIONS, DESCRIPTIVE LITERATURE, TECHNICAL DATA) SUFFICIENT FOR STATE OF LOUISIANA TO EVALUATE

QUALITY, SUITABILITY, AND COMPLIANCE WITH THE SPECIFICATIONS IN THE SOLICITATION. FAILURE TO SUBMIT

DESCRIPTIVE INFORMATION MAY CAUSE BID TO BE REJECTED. ANY CHANGE MADE TO A MANUFACTURER'S

PUBLISHED SPECIFICATIONS SUBMITTED FOR A PRODUCT SHALL BE VERIFIABLE BY THE MANUFACTURER. IF ITEM(S) BID DO NOT

16. BID OPENING

BIDDERS MAY ATTEND THE BID OPENING, BUT NO INFORMATION OR OPINIONS CONCERNING THE ULTIMATE CONTRACT AWARD

WILL BE GIVEN AT THE BID OPENING OR DURING THE EVALUATION PROCESS. BIDS MAY BE EXAMINED IN ACCORDANCE WITH LA

R.S. 44.I. INFORMATION PERTAINING TO COMPLETED FILES MAY BE SECURED BY VISITING THE STATE OF LOUISIANA DURING

NORMAL WORKING HOURS.

17. PRICES

UNLESS OTHERWISE SPECIFIED BY THE STATE OF LOUISIANA IN THE SOLICITATION, BID PRICES MUST BE COMPLETE, INCLUDING

TRANSPORTATION PREPAID BY BIDDER TO DESTINATION AND FIRM FOR ACCEPTANCE FOR A MINIMUM OF

30 DAYS. IF ACCEPTED, PRICES MUST BE FIRM FOR THE CONTRACTUAL PERIOD. BIDS OTHER THAN F.O.B. DESTINATION MAY BE

REJECTED. PRICES SHOULD BE QUOTED IN THE UNIT (EACH, BOX, CASE, ETC.) AS SPECIFIED IN

THE SOLICITATION.

18. DELIVERIES

BIDS MAY BE REJECTED IF THE DELIVERY TIME INDICATED IS LONGER THAN THAT SPECIFIED IN THE SOLICITATION.

19. TAXES

VENDOR IS RESPONSIBLE FOR INCLUDING ALL APPLICABLE TAXES IN THE BID PRICE. STATE AGENCIES ARE EXEMPT

FROM ALL STATE AND LOCAL SALES AND USE TAXES.

20. NEW PRODUCTS

UNLESS SPECIFICALLY CALLED FOR IN THE SOLICITATION, ALL PRODUCTS FOR PURCHASE MUST BE NEW, NEVER

PREVIOUSLY USED, AND THE CURRENT MODEL AND/OR PACKAGING. NO REMANUFACTURED, DEMONSTRATOR, USED

OR IRREGULAR PRODUCT WILL BE CONSIDERED FOR PURCHASE UNLESS OTHERWISE SPECIFIED IN THE SOLICITATION. THE

MANUFACTURER'S STANDARD WARRANTY WILL APPLY UNLESS OTHERWISE SPECIFED IN THE SOLICITATION.

21. CONTRACT RENEWALS

UPON AGREEMENT OF THE STATE OF LOUISIANA AGENCY AND THE CONTRACTOR, A TERM CONTRACT MAY BE EXTENDED FOR 2

ADDITIONAL 12-MONTH PERIODS AT THE SAME PRICES, TERMS AND CONDITIONS. IN SUCH CASES, THE TOTAL CONTRACT TERM

CANNOT EXCEED 36 MONTHS.

22. CONTRACT CANCELLATION

THE STATE OF LOUISIANA HAS THE RIGHT TO TERMINATE THE CONTRACT IMMEDIATELY FOR ANY OF THE FOLLOWING REASONS:

(A) MISREPRESENTATION BY THE CONTRACTOR; (B) CONTRACTOR'S FRAUD, COLLUSION, CONSPIRACY OR OTHER UNLAWFUL

MEANS OF OBTAINING ANY CONTRACT WITH THE STATE OF LOUISIANA; (C) CONFLICT OF CONTRACT PROVISIONS WITH

CONSTITUTIONAL OR STATUTORY PROVISIONS OF STATE OR FEDERAL LAW; (D) ABUSIVE OR BELLIGERENT CONDUCT BY

CONTRACTOR TOWARDS AN EMPLOYEE OR AGENT OF THE STATE; (E) CONTRACTOR'S INTENTIONAL VIOLATION OF THE

PROCUREMENT CODE (LA R.S. 39:1551 ET SEQ.) AND ITS CORRESPONDING REGULATIONS; OR, (F) ANY LISTED REASON FOR

DEBARMENT UNDER LA R.S. 39:1672.
