The City of Durham will open sealed formal Bids submitted by qualified Bidders at 2:00 pm on April 24, 2024 for
Contract 13958, Project: Eno River LS and Lick Creek LS Valve Replacement at the Department of Water
Management Water Sewer Maintenance Conference Room, 1600 Mist Lake Drive, Durham, North Carolina. The
Project involves the furnishing of all materials, labor, equipment, tools, and LS bypass, etc. unless otherwise
specified, for the complete installation of:
Eno River LS (5090 Denfield Street, Durham, NC 27704)
• Remove and replace portions of pump discharge piping and appurtenances as shown on drawings,
including steel supports.
• Remove and replace two (2) 6inch, two (2) 12inch, twelve (12) 24inch, and one (1) 36inch plug valves,
two (2) 24inch check valves, and two (2) 16inch swing arm check valves.
• Installation of new 7foot x 7foot access hatch and concrete repairs.
• Wet well improvements
Lick Creek LS (623 Stallings Road, Durham, NC 27703)
• Remove and replace one (1) 10inch, three (3) 16inch, and five (5) 18inch plug valves.
• Concrete pad demolition.
• Perimeter fencing modifications.
The foregoing description shall not be construed as a complete description of all work required.
Beginning March 13, 2024, The Contract Documents may be obtained from the Engineer, McKim & Creed, Inc.,
by emailing Karen Mattingly at kmattingly@mckimcreed.com. The Project Manual including Bidding Documents,
Contract Documents, and Technical Specifications, and Drawings, will also be provided to online plan rooms
ConstructConnect, Dodge Data & Analytics, and Hispanic Contractors Association of the Carolinas.
To be sure all bidders are kept up to date on any Addenda, changes, or information notices please send an email
to Karen Mattingly at kmattingly@mckimcreed.com, or Jacob Bowes at jbowes@mckimcreed.com indicting your
intention to prepare a Bid for the Project. Failure to complete this step may render your Bid nonresponsive.
Bidders are encouraged to attend the nonmandatory preBid conference at 10:30 am on March 25, 2024 at the
Department of Water Management in Training Room A, 1600 Mist Lake Drive, Durham, North Carolina.
Each Bidder must be licensed under Chapter 87 of the North Carolina General Statutes. Bidders must conform
with the provisions of the North Carolina Contractor’s Licensing Act of 1925, as amended. All Bids must include a
noncollusion affidavit.
The City of Durham requires the Project to be substantially completed within the following milestone dates:
• Substantial completion of Lick Creek LS 30 days from Notice to Proceed
• Substantial completion of Eno River LS 90 days from Notice to Proceed
• Final Completion 105 days from Notice to Proceed
No Bid shall be considered or accepted unless at the time of its filing the same shall be accompanied by a
deposit of cash or a certified or cashier's check drawn on a bank or trust company insured by the Federal
Deposit Insurance Corporation (FDIC), in an amount equal to five percent (5%) of the amount of the Bid. The
check shall be made payable to the City of Durham. Said deposit shall guarantee that the Contract will be
entered into by the successful Bidder if the award is made. Such deposit of cash or certified or cashier's check
may be held by the City until the successful Bidder has executed and delivered the Contract Documents,
including performance and payment bond, to the City of Durham and returned or kept in accordance with North
Carolina General Statute 143129.
Refer to other Bidding requirements described in Document 00 21 15.
In lieu of the cash deposit or certified or cashier’s check mentioned above, the Bidder may file a Bid bond in the
same amount executed by a corporate surety authorized to execute such bonds in North Carolina and
conditioned as provided by North Carolina General Statute 143129 and in the form attached to the Bidding
Documents (see Appendix F) or on file with the Engineer. Bid bond forms enclosed as part of the Bidding
Documents must be properly executed at the time Bids are submitted before Bid will be considered. Properly
executed Power of Attorney of the corporate surety's agent shall accompany such bond and be attached to the
page provided therefore in the Bidding Documents. The established Minority and Women Business Enterprise
Ordinance (M/WBE) goals for this project are [11 %] goal for MUBE and [7 %] goal for WUBE participation.
Bids shall be submitted under a condition of irrevocability, except as required by law, for a period of ninety (90)
days after Bid opening.
The City of Durham reserves the right to accept or reject any or all Bids, to waive any and all informalities, and to
disregard all nonconforming or conditional Bids or counter Bids, and to accepts the Bid that will be in the best
interest of the City of Durham.
