1.0 PURPOSE AND BACKGROUND
North Carolina General Statutes provide for the seizure, maintenance, storage, and eventual sale of vehicles operated
by drivers arrested for repeat DWI Offences and for Felony Speeding to Elude Arrest. This program is governed under
G.S. 20-28-2 through 20-28.9. North Carolina Surplus Property Agency (the “Agency”) currently manages this program.
This Request for Information (RFI) is intended to collect information and recommendations regarding the soliciting,
evaluation, awarding, and management of the future contract for the program. The State is requesting participation by
interested Vendors to submit its own ideas, information, and suggestions in each of the areas listed in this RFI under
sections 3.0, 4.0, and 5.0. Vendors may also provide any additional information, comments, or recommendations in its
response. The State intends to use this valuable Vendor input to improve the solicitation process and management of
the program. The State plans to solicit for these services in February of 2021.
2.0 GENERAL INFORMATION
2.1 REQUEST FOR INFORMATION DOCUMENT
The RFI is comprised of the base RFI document, any attachments, and any addenda released before the RFI Opening
Date. All attachments and addenda released for this RFI in advance of any Contract award are incorporated herein by
reference.
The State recognizes that considerable effort will be required in preparing a response to this RFI. However, please
note this is a request for information only, and not a request for services. The Vendor shall bear all costs for
preparing this RFI.

2.3 VIRTUAL CONFERENCE CALL
The State will hold a virtual conference call on December 2, 2020 at 2:00PM using MS Teams at the link below. The
purpose of this call is for all prospective Vendors to apprise themselves with the intent and details of information
requested in this RFI. Vendors will be asked to enter their company name and contact information into the chat
window when logging into the call. If calling into the conference over phone, Vendors will be asked to send an email

2.4 QUESTIONS
Upon review of the RFI documents, Vendors may have questions to clarify or interpret the RFI in order to submit the
best information possible. To accommodate the Questions process, Vendors shall submit any such questions by the
above due date.
Written questions shall be emailed to bid.inquiry@doa.nc.gov by the date and time specified above. Vendors should
enter “RFI # 13-MS11933036: Questions” as the subject for the email. Questions submittals should include a reference
to the applicable RFI section and be submitted in a format shown below:

Questions received prior to the submission deadline date, the State’s response, and any additional terms deemed
necessary by the State will be posted in the form of an addendum to the Interactive Purchasing System (IPS),
http://www.ips.state.nc.us, and shall become an Addendum to this RFI. No information, instruction or advice provided
orally or informally by any State personnel, whether made in response to a question or otherwise in
connection with this RFI, shall be considered authoritative or binding. Vendors shall rely only on written material
contained in an Addendum to this RFI.
2.5 RESPONSE SUBMITTAL
All proposal responses shall be submitted electronically via the North Carolina Business Invitation Delivery
System (NC BIDS). For additional information, the NC BIDS for Vendors page includes online training videos and a link
to NC BIDS FAQs for Vendors.
Critical updated information may be included in Addenda to this RFI. It is important that all Vendors planning to respond
on this RFI periodically check the State’s IPS website for any Addenda that may be issued prior to the bid opening date.
All Vendors shall be deemed to have read and understood all information in this RFI and all Addenda thereto.
Content and Format
The State expects concise, detailed, point-by-point responses to each of the RFI response items identified in Sections
3.0, 4.0, 5.0 of this RFI. The State is not interested in brochures or “boilerplate” responses. Instead, responses should
clearly define how the vendor’s proposed solution(s) would meet the State’s business requirements. Any issues or
exceptions to the State’s requirements should also be identified and explained.
2.5 DEFINITIONS, ACRONYMS, AND ABBREVIATIONS
a) AGENCY: For the purpose of this RFI, Agency shall refer to State Surplus Property Agency.
b) BUYER: The employee of the State or Other Eligible Entity that places an order with the Vendor.
c) CONTRACT ADMINISTRATOR: Representative of the Department of Administration, State Surplus Property, who
will administer the contract for the program for the State.
d) CONTRACT LEAD: Representative of the Department of Administration who corresponds with potential Vendors in
order to identify and contract with that Vendor providing the greatest benefit to the State
e) DMV: Department of Motor Vehicles
f) DOA: Department of Administration
g) NC BIDS: The North Carolina Business Invitation Delivery System provides vendors the opportunity to submit bid
responses electronically.
h) NCXCLOUD: Reporting Software used that links to the DMV Vehicle Tracking System (STARS) *replaced XNET
i) ON-TIME DELIVERY: The delivery of all items within a single order to the receiving point designated by the ordering
entity within the delivery time required.

j) OWNER: The person or entity that has legal title to the Seized Vehicle.
k) PROGRAM: The program managed by State Surplus under G.S. 20-28-2 where the seizure, maintenance, storage,
and eventual sale of vehicles operated by drivers arrested for repeat DWI Offences and for Felony Speeding to
Elude Arrest.

n) SEIZED VEHICLE: a vehicle seized under the authority of G.S. 20-28.2 or G.S. 20-28.3.

requirements and specifications of a solicitation.
p) STATE: The State of North Carolina, including any of its sub-units recognized under North Carolina law.
q) VENDOR: Supplier, bidder, proposer, company, firm, corporation, partnership, individual or other entity submitting
a response to a Request for Proposal.
2.6 DISCUSSION PANEL
After responses are received and reviewed by the Agency, Vendors may be requested to attend a Discussion Panel
meeting with the Agency to further clarify the Vendors Response.
2.7 CONFIDENTIALITY
Vendors response to this RFI will not be subject to public record until a Request for Proposals (RFP) results in an
awarded contract where information collected from this RFI was used to aid the State in drafting such RFP.
3.0 DISTRIBUTION OF SERVICES
The State has advertised DWI towing and storage services many times over the past few years. To attract geographic
competition, the contract has been advertised Statewide, Regionally, and by State Highway Patrol districts.
3.1 In your opinion, which geographic preference is most effective? Why?

4.0 SCOPE OF SERVICES
The terms used herein are as defined in G.S. 20-28.2 unless otherwise indicated. Vendor shall provide responses and
recommendations of management of the general scope of services below pursuant to G.S. 20-28.2 through 20-28.5, any
procedural rules established under G.S. 20-28.7, and other applicable law. Vendors response to this RFI shall identify
any recommended changes to the scope of services listed below as well as any additional recommended scope
specifications.
4.1 TOWING SEIZED VEHICLES
Vendor is to submit recommendations as to how the State should manage, solicit, and evaluate the towing and seizure
of vehicles per G.S. 20-28.2 through 20.28.9. This shall include any recommendations on how to manage the
relationship between the local towing company and how the payment of the local tow should be calculated and used in
evaluation. Vendor is to submit recommendations as to how the State and Vendor should manage custody of the
seized vehicles and errors in the reporting on daily seizure reports as well as when a vehicle listed on the daily seizure
report is not received and towed by Vendor. Vendor is to submit recommendations as to how the State should use
rates for subcontracted towing companies that transport vehicles to the Vendor’s location. This should include
information as to how the payment of the tow should be calculated and used in evaluation.
