The Oregon State Police (OSP) intends to purchase one (1) Pendar X10 handheld spectrometer from Pendar Technologies, through the federally managed GSA Contract # 47QSWA20D008W. This notice describes the Agency's needs, reasons, and intent to procure through a Federal Program and provides an informal opportunity for public comment to consider any impact on local business.
In compliance with FAR 8.405-1, Agency has reviewed several GSA Schedule contracts that offer handheld Raman spectrometers, including; the Serstech 100/ARX, DetectaChem Apex R7, and Pendar X10. Of the GSA Schedules reviewed, the Agency has determined that the Pendar X10 from Pendar Technologies represents the best value for the State.
USC Title 40, Section 502(c), Public Law 110-248, ORS 279A.180 and OAR 125-246-0360 grants authority to purchase from this federal program, subject to consideration of its impact on local businesses.
The funds for this purchase comes from a 2023 State Homeland Security Program (SHSP) grant award, sub-recipient grant # 23-253. This purchase is also subject to the requirements of the SHSP Grant, including CFR ? 200.321 which requires affirmative steps to assure that minority businesses, women's business enterprises, and labor surplus area firms are used when possible.

In accordance with Oregon Administrative Rule 125-246-0360(3), the OSP hereby documents the following:
(a) The Local Preparedness Acquisition Act (Public Law 110-248) authorized state and local governments access to Federal Supply Schedule 84, Total Solutions for Law Enforcement, Security, Facility Management Systems, Fire, Rescue, Special Purpose Clothing, Marine Craft, Emergency/Disaster Response, and Schedule 70 for information technology products and services.
(b) The acquisition meets the Agency's needs;
(c) The price and other terms of the acquisition are Advantageous to the State;
(d) Mandatory Department Price Agreements do not exist for Raman spectrometers.
(e) The Agency has considered the acquisition's impact upon local business as follows through posting of this notice.
(f) State and local preference programs, including but not limited to Inmate Labor in accordance with the Oregon Constitution, Article I, Section 41, Products of Disabled Individuals Program of ORS 279.835 to 850, and state requirements Contracts under OAR 125-247-0296, are not waived or otherwise adversely affected by an acquisition through a Federal Program;
(g) Expenditure will not exceed $250,000 so does not require legal sufficiency; and
(h) The Agency is informed of its Federal Program's Procurement Process.
