PROPOSAL TERMS AND CONDITIONS
LEGACY PARK BENCHES RENOVATION PROJECT
SPECIFICATION NO. 2105
1. Right to Reject Proposals
a. The City retains the right to reject any and all proposals, to waive any
specifications (both City's and written proposed specifications from
proposers) and any informality or irregularity and to sit and act as sole judge
of the merit and qualifications of each product/ service offered. Proposer's
past performance and the City's assurance that each proposer would
provide the materials and labor, equipment, services, and other items as
stated on the plans and in the specifications as proposed will be taken into
consideration when proposals are being evaluated.
b. Proposers agree to honor said proposal for a period of 90 days beyond the
final date of submittal to the City.
c. Proposals are to be submitted on the forms provided in the attached
proposal package. Failure to provide all information required in this
Request for Proposal may result in your proposal being rejected as
incomplete and non-responsive. All prices, terms, availability and any other
conditions shall be complete and in written form.
2. Proposal Evaluation
a. All proposals received shall be evaluated with the emphasis placed on the
proposer's ability to meet the City's requirements, the responsiveness of the
proposals, and cost. Proposers shall have a valid class “A” or “B” license
for the State of California at the time that proposals are opened. Other
factors such as ability to meet delivery dates, quality of work performed in
the past, and general competence of the proposer will be considered
carefully. Cost shall be evaluated in relation to the other qualified

proposers. Award shall be made to the most responsible proposer whose
proposal is determined to be the most advantageous to the City. The
successful proposer will be notified by mail and will be issued a written
Notice to Proceed.
b. This project requires payment of State prevailing rates of wages for Ventura
County. The contractor shall post copies of the prevailing schedule at each
job site. Copies of these rates of wages are available from the State of
California Department of Industrial Relations Prevailing Wage Unit. The
website for this agency is located at www.dir.ca.gov.
This project is subject to prevailing wage compliance monitoring and
enforcement by the Department of Industrial Relations. No contractor or
subcontractor may be listed on the bid proposal unless registered with the
Department of Industrial Relations, pursuant to Labor Code Section 1725.5.
No bid will be accepted from a Contractor without proof of the Contractor’s
and subcontractor’s current registration.
c. This is a competitive sealed proposal and not a competitive sealed bid.
When proposals are opened, prices and other proposal information will not
be made public. There shall be no disclosure of any proposer's information
to competing proposers prior to the award of the proposal. At the time of
award, the executed contract will become public information. Accordingly,
each proposal should be submitted on the vendor's most favorable terms
from a price and technical standpoint.
d. If the unit price and the total amount named by any proposer for any item
are not in agreement, the unit price alone will be considered as representing
the proposer's intentions and the total will be corrected to conform to the
specified unit price.
e. Alterations by erasure or interlineation shall be explained or noted in the
proposal over the signature of the proposer. Proposers will not be released
on account of errors.
f. Use of a brand name or specifications is for the purpose of describing the
standard of quality, performance, and characteristics desired by the City and
is not intended to limit or restrict competition. Substantially equivalent
products to those designated will be considered for award. The City
reserves the right to approve any other as being equivalent or acceptable.
