Bidders are hereby advised to make the following revisions to the Plans and Project Manual:
1. Revise, Any and all documents pertaining to this construction project including but not
limited to the plans and project specifications the NH Project Number shall be updated
from 15731 to 15731C.
2. Revise, Any and all documents pertaining to this construction project including but not
limited to, the plans and projects specifications, the Federal Project Number shall be
updated from A000(909) to A005(252).
3. Add, the following to Specification 31 23 01, Part 1 General.
It is not the design intent to have a neat vertical face. The plan documents show
the minimum removal limits. Payment is made on a per cubic yard basis. No
payment will be made for anything removed below the limits shown on the plans.
4. Revise, Section 31 23 01, the delay period to a minimum of 8 to 25 ms throughout. The
contractor must select a delay period that provides protection of adjacent structures,
protects the removal limits, and does not exceed any permit requirements.
5. Revise, Section 31 23 01, the last sentence in the second paragraph in Paragraph 3.6.1.5
Production Blasting Design to the following.
The maximum charge weight per delay may not exceed 150 pounds of all
combined explosives and blasting agents in each delay period. The minimum
delay period must be between 8 and 25 ms. The contractor must select a delay
period that provides protection of adjacent structures, protects the removal limits,
and does not exceed any permit requirements.
6. Add, “or electronic” after non-electrical in the following paragraphs when discussing
initiation systems – Specification 31 23 01, Paragraphs 1.5.1, 2.2.2.2, 3.6.1, and 3.6.1.3
c.
7. Delete, Section 31 32 01, Paragraph 3.4.5 Blasting Administrator and all references
throughout the specification to a blasting administrator.
8. Revise, Specification 31 23 01 Paragraph 3.4.6 Vibration Monitoring Specialty Firm to
require one seismic specialist and one seismic technician.
9. Replace, the last sentence of Specification 31 23 0, Paragraph 2.2.1 General with the
following.

Blasting will not be allowed when vessels are in the berth or when vessels are
transiting the federal channel. All blasting must be within the permitted window.
10. Add, “whichever is least restrictive” to the end of the sentence in Specification 31 23 01,
Paragraph 2.2.2.1 Requirements.
All explosive materials used on the project must be six months or less of age or
no older than one half the shelf life shown on the explosives manufacturer's
technical data sheet for that product, whichever is least restrictive.
11. Delete, the following sentence in Specification 31 23 01, Paragraph 3.5.3 Daily
Explosives’ Magazine Inventory and Daily Explosives’ Accounting.
No explosive material older than 1 year will be used.
12. Revise, Specification 31 23 01, Paragraph 3.6.1 Master Blasting Plan the following
sentence.
The Owner's Representative will have a maximum of 30 calendar days to review
prior to submitting to the environmental agencies.
13. Add, the following sentence to the end of Section 31 23 01, paragraph 3.6.1.6.a Test
Blast Plan.
Allow 3 working days for review of each test shot area.
14. Add, the following sentence to the end of Section 31 23 01, paragraph 3.6.1.6.g Test
Blast Plan.
Allow for 5 working days for review of the report.
15. Replace, the first paragraph in Section 31 23 01, Paragraph 2.2.3 Magazines.
When the Contractor will maintain the explosive magazines, obtain all necessary
Federal and State magazine permits for the magazines. Magazines must be
located at safe distances as defined by the Bureau of Alcohol, Tobacco and
Firearms (ATF), in addition to the State of New Hampshire's requirements.
Procure off-site explosive storage and expect to transport the daily volume of
explosives to the site. Secure a permit to transport explosives from New
Hampshire State Police when and if required, and transport explosives in
accordance with 49 CFR 177 when carried on public highways.
16. Add, the following after the first sentence in Section 31 23 01, Paragraph 3.3.2.4
Limiting Blast-Induced Vibrations at Green Concrete.
This includes, but is not limited to, the south extension.

17. Revise, the first sentence in Section 31 23 01, paragraph 3.6.1.7 Marine Species
Minimization Measures to the following.
The following minimization measures are required by NMFS under the Essential
Fish Habitat consultation to protect marine species and must be included in the
Master Blasting Plan.
18. Revise, the units in Section 31 23 01, Paragraph 3.6.4.g Individual Shot Reports to
inches per second (ips).
19. Delete, Section 31 23 01, Paragraph 3.6.4.4 Reports of Required Safety, Protective, and
Natural Resource Programs.
20. Add, the Suitability Determination to Appendix E of the Project Manual.
21. Add, the New Hampshire Coastal Program’s Coastal Zone Management Act federal
consistency decision to Appendix E of the Project Manual.
22. Replace, FHWA-1273 Required Contract Provisions Federal-Aid Construction
Contracts – Revised July 5, 2022 with the attached document, FHWA-1273 Required
Contract Provisions Federal-Aid Construction Contracts – Revised October 23, 2023.
23. Revise, the pile size in the legend on sheets S-102 and S-103 to 28” DIA. On sheet S-
502 revise the Pile Shape to PP28x1.000 in the Concrete-Filled Pipe Pile – Pile Length
Schedule for Bidding.
24. Replace, specification section 09 97 13.26 Coating of Steel Waterfront Structures with
the attached.

Re: MPRSA Section 103 Evaluation of the Final Suitability Determination for the Proposed Dredging of
the Pease Development Authority Market Street Marine Terminal, Portsmouth, NH

Dear Mr. Loyd,
I am writing in response to your transmittal of the Final Suitability Determination (SD) on October 2,
2023, for the above referenced project. The EPA Ocean Dumping Program has reviewed the evaluation
and testing requirements for the proposed dredged material disposal project pursuant to Section 103
of the Marine Protection Research and Sanctuaries Act (MPRSA).
Project Summary: The applicant is proposing to mechanically dredge approximately 26,300 cubic yards
(CY) of material from a 3-acre vessel berth area along the Piscataqua River. Dredging is proposed to a
project depth of -36 ft mean lower low water with 1 ft of allowable overdepth. The SD evaluated the
alternative of potential disposal of the dredged material at the Isles of Shoals North (IOSN) disposal
site.
EPA has completed an evaluation of the project in accordance with MPRSA Section 103. This included a
review of the initial physical analysis of the sediment samples as well as the hydrodynamics of the
project setting and potential historical anthropomorphic inputs in the area. Based on this evaluation,
EPA concurs with the findings of NAE’s September 27, 2023, Final SD that all the proposed dredged
material meets the MPRSA criteria for exclusion from further testing and is suitable for unconfined
open water disposal at IOSN.
As a reminder, all MPRSA projects also require EPA concurrence on the final permit. Therefore, EPA
expects to review and receive a request for concurrence for the NAE-2018-1619 permit and its
conditions for once prepared. As we understand from the project description and communication with
your evaluation team that an additional 800 CY of rock will be removed that may require blasting, the

dredging permit should include, in its conditions, control measures to limit the potential release a
shock tubing if it is used as part of the blasting.
Finally, given the coarse-grained, high-quality characteristics of the proposed dredged material, we
strongly recommend the applicant consider potential beneficial use of the dredged material as an
alternative to ocean disposal.
