MIDTOWN BUS TERMINAL REPLACEMENT PROGRAM - DYER DECK-OVERS

PREFACE

The Draft Environmental Impact Statement (EIS) for the Port Authority Bus Terminal Replacement Project was published by the Federal Transit Administration (FTA) on February 2, 2024, in the Federal Register. The Public Comment period commenced on February 2nd and Public Hearings will be taking place the week of February 20th. The Public has been invited to submit comments on the program by March 18th. These comments will be considered when preparing the Final EIS. The Final EIS and Record of Decision are anticipated to be issued by FTA later this year. The Port Authority will not give final authorization to initiate physical construction until completion of the Federal and City environmental review process.

While this process moves forward, the Port Authority plans to begin its initial stages of its procurement process for the Deck-Overs and Phase 1 (Storage and Staging Facility / Ramps) of the project. Once the environmental review process has run its course with appropriate approvals, the Port Authority will modify, as appropriate, these early action packages and move towards awarding initial construction contracts.

By starting the early stages of its procurement process, including the solicitation, evaluation, negotiation, and selection of contractors concurrently with the environmental review process, the Port Authority can be positioned to move this project forward promptly when final regulatory approvals are received. This Information for Bidders for the Deck-Overs is the first of various documents that will be issued this year. This portion of the project would provide decks over the Dyer Ave roadway, which will reconnect portions of the community while also creating space for a variety of purposes once the project moves forward, including bus operations during construction, and ultimately publicly accessible open space.

ANTICIPATED FUNDING

This Contract is to be funded in whole or in part by a combination of a loan under the United Stated Department of Transportation (DOT) Transportation Infrastructure Finance and Innovation Act (TIFIA) program and grants from the Federal Transit Administration (FTA). As a result, this Contract is subject to the requirements set forth in Chapter VII of the Form of Contract entitled "Federal Requirements".

THE OPPORTUNITY

Sealed bids for the following contract will be received by The Port Authority of New York and New Jersey, until 2:30 PM on the date indicated.

The Authority shall accept only those bids in electronic format for which the submission or modification is completed at the time of the Bid Due Date. Bid submissions will be accepted by upload only, at https://panynj.bonfirehub.com/portal/?tab=login and must be uploaded and received by the Authority by 2:30 PM EST on the date indicated in order to be considered. Hand deliveries and mailed deliveries (e.g., UPS, USPS) will not be accepted. The Port Authority may request an original, signed paper submission at any time following the Bid Due Date. If requested, such original, signed paper submission must be identical to the electronic submission. In the event of a discrepancy, the electronic submission shall control.

The Port Authority of New York and New Jersey has temporarily ceased in-person public bid openings and will allow for the digital submission of bids using the Bonfire platform, located at the link below.

Bidders MUST register in order download Bid documents and associated information regarding the below referenced solicitation and in order to upload bid submissions.

Registration on Bonfire platform requires a separate and distinct registration from all other Authority platforms.

Bidders MUST also meet the Information Security Handbook Requirements in order to receive a link from the Authority to download Bid documents containing protected information and associated information regarding the below referenced solicitation.

Contract documents will no longer be available for purchase at the Contract Desk on the 1st Floor, 2 Montgomery Street, Jersey City. Prospective bidders may obtain contract documents (non-protected information) by downloading the documents directly from the Bonfire platform, by logging in to Bonfire after completing a one-time new vendor registration. Prospective bidders may obtain contract documents containing protected information by sending an email request to the Procurement Contract Specialist whose contact information is listed. After meeting the Information Security Handbook Requirements, a link for downloading the contract documents will be provided by the Authority. The contract documents will be made available electronically to the prospective bidder at no cost, as soon as they become available. Bidders are advised that only firms that can satisfactorily demonstrate that they meet Information Security Handbook Requirements can view and/or obtain the Contract Documents. The requirements and instructions for submitting documentation that the requirements have been met are available on-line at https://www.panynj.gov/port-authority/en/business-

opportunities/information-security-handbook-requirements.html . The submission should be sent only to the person whose name and phone number is listed.

Interested bidders should complete the Information Security Requirements submission as soon as possible, as the process may take several weeks. Failure to meet the information security requirements in order to view/obtain the Contract documents may result in your firm's Bid, if submitted, being found not eligible for acceptance by the Authority.

Contract MCP-254.254 – Port Authority Bus Terminal – Midtown Bus Terminal Replacement

Program - Dyer Deck-Overs. Estimate Range: $150M - $200M. Bids Due: Wednesday, April 10 th , 2024. The work under this contract consists generally of construction of concrete and steel decks above the existing approach roadways to the Lincoln Tunnel; site work including excavation, grading, removal of existing retaining walls, and furnishing and installing curbs and pavement markings; modifications to existing parapets and sidewalks; furnishing and installing stormwater detention tanks, stormwater site connections, electrical services, closed circuit television system, changeable message signs and supervisory control and data acquisition system; maintenance of traffic and work area protection; and related work at Dyer Avenue between W37th Street and W39th Street and the vicinity thereof, New York, New York. This project may be federally funded in whole or in part. Accordingly, all bidders and the successful Contractor will be required to comply with any and all required applicable federal provisions and requirements contained in this solicitation and resulting contract.
